1010 AN ACT to amend 457.03 (2) of the statutes; relating to: rules defining
1111 unprofessional conduct by marriage and family therapists, professional
1212 counselors, and social workers and suspension of a portion of a rule of the
1313 Marriage and Family Therapy, Professional Counseling, and Social Work
1414 Examining Board.

1616 This bill prohibits the Marriage and Family Therapy, Professional Counseling,
1717 and Social Work Examining Board from promulgating any rule that establishes as
1818 unprofessional conduct employing or promoting any intervention or method that has
1919 the purpose of attempting to change a person's sexual orientation or gender identity,
2020 including attempting to change behaviors or expressions of self or to reduce sexual
2121 or romantic attractions or feelings toward individuals of the same gender.
2222 This bill is introduced as required by s. 227.26 (2) (f), stats., in support of the
2323 action of the Joint Committee for Review of Administrative Rules in suspending
2424 section MPSW 20.02 (25), Wis. Adm. Code, a rule of the Marriage and Family
2525 Therapy, Professional Counseling, and Social Work Examining Board on January 12,
2626 2023.
2727 The suspended rule provided that unprofessional conduct related to the
2828 practice of marriage and family therapists, professional counselors, and social
2929 workers includes employing or promoting any intervention or method that has the
3030 purpose of attempting to change a person's sexual orientation or gender identity,

3838 including attempting to change behaviors or expressions of self or to reduce sexual
3939 or romantic attractions or feelings toward individuals of the same gender.
4040 The people of the state of Wisconsin, represented in senate and assembly, do
4141 enact as follows:
4242 SECTION 1. 457.03 (2) of the statutes is amended to read:
4343 457.03 (2) Upon the advice of the social worker section, marriage and family
4444 therapist section, and professional counselor section, promulgate rules establishing
4545 a code of ethics to govern the professional conduct of certificate holders and licensees.
4646 The rules shall specify the services included within the practice of social work,
4747 advanced practice social work, or independent social work that an individual who is
4848 certified under this chapter as a social worker, advanced practice social worker, or
4949 independent social worker may perform and the degree of supervision, if any,
5050 required to perform those services. The rules promulgated under this subsection
5151 may not establish as unprofessional conduct employing or promoting any
5252 intervention or method that has the purpose of attempting to change a person's
5353 sexual orientation or gender identity, including attempting to change behaviors or
5454 expressions of self or to reduce sexual or romantic attractions or feelings toward
5555 individuals of the same gender.
5656 SECTION 2. MPSW 20.02 (25) of the administrative code is repealed.
5757 SECTION 3.0Effective date.
5858 (1) Notwithstanding s. 227.265, this act takes effect on the day after
5959 publication.
