10	10	AN ACT to amend 457.03 (2) of the statutes; relating to: rules defining
11	11	unprofessional conduct by marriage and family therapists, professional
12	12	counselors, and social workers and suspension of a portion of a rule of the
13	13	Marriage and Family Therapy, Professional Counseling, and Social Work
14	14	Examining Board.

16	16	This bill prohibits the Marriage and Family Therapy, Professional Counseling,
17	17	and Social Work Examining Board from promulgating any rule that establishes as
18	18	unprofessional conduct employing or promoting any intervention or method that has
19	19	the purpose of attempting to change a person's sexual orientation or gender identity,
20	20	including attempting to change behaviors or expressions of self or to reduce sexual
21	21	or romantic attractions or feelings toward individuals of the same gender.
22	22	This bill is introduced as required by s. 227.26 (2) (f), stats., in support of the
23	23	action of the Joint Committee for Review of Administrative Rules in suspending
24	24	section MPSW 20.02 (25), Wis. Adm. Code, a rule of the Marriage and Family
25	25	Therapy, Professional Counseling, and Social Work Examining Board on January 12,
26	26	2023.
27	27	The suspended rule provided that unprofessional conduct related to the
28	28	practice of marriage and family therapists, professional counselors, and social
29	29	workers includes employing or promoting any intervention or method that has the
30	30	purpose of attempting to change a person's sexual orientation or gender identity,

38	38	including attempting to change behaviors or expressions of self or to reduce sexual
39	39	or romantic attractions or feelings toward individuals of the same gender.
40	40	The people of the state of Wisconsin, represented in senate and assembly, do
41	41	enact as follows:
42	42	SECTION 1. 457.03 (2) of the statutes is amended to read:
43	43	457.03 (2) Upon the advice of the social worker section, marriage and family
44	44	therapist section, and professional counselor section, promulgate rules establishing
45	45	a code of ethics to govern the professional conduct of certificate holders and licensees.
46	46	The rules shall specify the services included within the practice of social work,
47	47	advanced practice social work, or independent social work that an individual who is
48	48	certified under this chapter as a social worker, advanced practice social worker, or
49	49	independent social worker may perform and the degree of supervision, if any,
50	50	required to perform those services. The rules promulgated under this subsection
51	51	may not establish as unprofessional conduct employing or promoting any
52	52	intervention or method that has the purpose of attempting to change a person's
53	53	sexual orientation or gender identity, including attempting to change behaviors or
54	54	expressions of self or to reduce sexual or romantic attractions or feelings toward
55	55	individuals of the same gender.
56	56	SECTION 2. MPSW 20.02 (25) of the administrative code is repealed.
57	57	SECTION 3.0Effective date.
58	58	(1) Notwithstanding s. 227.265, this act takes effect on the day after
59	59	publication.
