11	11	AN ACT to renumber and amend 118.2935 (1); to amend 118.2935 (5); and to
12	12	create 36.11 (59), 118.2935 (1) (a) and 118.2935 (3p) of the statutes; relating
13	13	to: requiring an automated external defibrillator at youth athletic activities
14	14	operated or sponsored by a public or private school and at athletic events of
15	15	University of Wisconsin System institutions.

17	17	This bill requires automated external defibrillators (AEDs) to be available at
18	18	high school athletic activities and University of Wisconsin System athletic events.
19	19	Youth athletic activities at public and private high schools
20	20	This bill requires each public and private high school that operates or sponsors
21	21	a youth athletic activity to 1) ensure that an AED is available for use at the youth
22	22	athletic activity and there is at least one individual present at the youth athletic
23	23	activity who has current proficiency in the use of an AED achieved through
24	24	instruction provided by a person that is approved by the Department of Health
25	25	Services and 2) develop and implement a plan for the use of an AED at youth athletic
26	26	activities. Under current law and the bill, a “youth athletic activity” is defined as an
27	27	organized athletic activity in which the participants, a majority of whom are under
28	28	19 years of age, are engaged in an athletic game or competition against another team,
29	29	club, or entity, or in practice or preparation for an organized athletic game or
30	30	competition against another team, club, or entity. Current law requires a person who

38	38	operates a youth athletic activity, including a public or private school, to provide
39	39	information about the nature and risk of sudden cardiac arrest during youth athletic
40	40	activities to coaches and participants before a season of a youth athletic activity that
41	41	is offered to individuals who are 12 years of age or older.
42	42	Athletic events at UW System institutions
43	43	The bill also requires UW System institutions to have AEDs available for use
44	44	at athletic events along with individuals proficient in the use of the AED. The bill
45	45	defines an “athletic event” as an intercollegiate athletic competition in which a UW
46	46	System institution's team members participate or an organized event at which team
47	47	members practice or prepare for competition under supervision of a coach. The bill
48	48	also requires the Board of Regents of the UW System to develop a plan for the use
49	49	of AEDs at athletic events and requires UW System institutions to implement the
50	50	plan.

52	52	printed as an appendix to this bill.
53	53	The people of the state of Wisconsin, represented in senate and assembly, do
54	54	enact as follows:
55	55	SECTION 1. 36.11 (59) of the statutes is created to read:
56	56	36.11 (59) AUTOMATED EXTERNAL DEFIBRILLATORS AT ATHLETIC EVENTS. (a) In this
57	57	subsection:
58	58	1. “Athletic event” means an intercollegiate athletic competition in which an
59	59	institution's team members participate or an organized event at which an
60	60	institution's team members practice or prepare for competition under supervision of
61	61	a coach.
62	62	2. “Automated external defibrillator” has the meaning given in s. 256.15 (1) (cr).
63	63	3. “Team members” means student athletes, enrolled in an institution, for
64	64	whom eligibility requirements for athletic participation are established by a national
65	65	association or conference that regulates collegiate athletics.
66	66	(b) The board shall ensure that an automated external defibrillator is available
67	67	for use at each athletic event of an institution.

85	85	(c) The board shall develop a plan for the use of an automated external
86	86	defibrillator at athletic events of an institution and shall require each institution to
87	87	implement the plan.
88	88	(d) The board shall require each institution to have present at an athletic event
89	89	of the institution at least one individual who has current proficiency in the use of an
90	90	automated external defibrillator achieved through instruction by an instructor
91	91	approved under s. 46.03 (38).
92	92	SECTION 2. 118.2935 (1) of the statutes is renumbered 118.2935 (1) (intro.) and
93	93	amended to read:
94	94	118.2935 (1) (intro.) In this section, “youth:
95	95	(b) “Youth athletic activity” has the meaning given in s. 118.293 (1) (c).
96	96	SECTION 3. 118.2935 (1) (a) of the statutes is created to read:
97	97	118.2935 (1) (a) “Automated external defibrillator” has the meaning given in
98	98	s. 256.15 (1) (cr).
99	99	SECTION 4. 118.2935 (3p) of the statutes is created to read:
100	100	118.2935 (3p) A public or private school that operates or sponsors a youth
101	101	athletic activity shall do all of the following:
102	102	(a) Ensure that an automated external defibrillator is available for use at youth
103	103	athletic activities operated or sponsored by the public or private school.
104	104	(b) Develop and implement a plan for the use of an automated external
105	105	defibrillator at youth athletic activities operated or sponsored by the public or
106	106	private school.
107	107	(c) Ensure that there is at least one individual present at each youth athletic
108	108	activity operated or sponsored by the public or private school who has current
109	109	proficiency in the use of an automated external defibrillator achieved through

138	138	education achieved through instruction approved under s. 46.03 (38) to provide such
139	139	instruction.
140	140	SECTION 5. 118.2935 (5) of the statutes is amended to read:
141	141	118.2935 (5) This section Subsection (3m) does not apply after June 30, 2032.
142	142	SECTION 6.0Effective date.
143	143	(1) This act takes effect on the first day of the 7th month beginning after
144	144	publication.
