Date of enactment: March 27, 2024 2023 Assembly Bill 356 Date of publication*: March 28, 2024 2023 WISCONSIN ACT 222 AN ACT to amend 20.465 (3) (qs); and to create 20.465 (3) (qs) and 256.35 (3s) (bx) of the statutes; relating to: grants for incumbent local exchange carriers for costs associated with Next Generation 911 and making an appropria- tion. The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: 2023−24 2024−25 20.465Military Affairs, department of (3) EMERGENCY MANAGEMENT SERVICES (qs)Grant program for incumbent local exchange carriers SEG B −0− 6,000,000 SECTION 2. 20.465 (3) (qs) of the statutes is created to read: 20.465 (3) (qs) Grant program for incumbent local exchange carriers. Biennially, from the police and fire protection fund, the amounts in the schedule for the department to provide grants under s. 256.35 (3s) (bx). No moneys may be encumbered under this paragraph after June 30, 2027. SECTION 2m. 20.465 (3) (qs) of the statutes, as cre- ated by 2023 Wisconsin Act .... (this act), is amended to read: 20.465 (3) (qs) Grant program for incumbent local exchange carriers. Biennially, from the police and fire protection 911 fund, the amounts in the schedule for the department to provide grants under s. 256.35 (3s) (bx). SECTION 3. 256.35 (3s) (bx) of the statutes is created to read: 256.35 (3s) (bx) Grant program for incumbent local exchange carriers. 1. In this paragraph, “incumbent local exchange carrier” has the meaning given in 47 USC 251 (h). 2. From the appropriation under s. 20.465 (3) (qs), the department shall award grants to incumbent local exchange carriers operating as originating service providers for the reimbursement of the incumbent local exchange carriers’ costs associated with the IP−based transport of Next Generation 911, the database used to operate Next Generation 911, and the purchase, installa- tion, and maintenance of Next Generation 911 equip- ment. An incumbent local exchange carrier is not eligible * Section 991.11, WISCONSIN STATUTES: Effective date of acts. “Every act and every portion of an act enacted by the legislature over the governor’s partial veto which does not expressly prescribe the time when it takes effect shall take effect on the day after its date of publication.” − 2 −2023 Wisconsin Act 222 2023 Assembly Bill 356 for a grant under this subdivision unless it is acting as an incumbent local exchange carrier in this state on the effective date of this subdivision .... [LRB inserts date]. 3. The department shall develop a policy that estab- lishes eligibility criteria for grants under subd. 2. The department may seek recommendations from the 911 subcommittee on the awarding of grants under subd. 2., including advice on appropriate grant purposes and eligi- bility criteria for grants. 4. The department may not award more than one grant under subd. 2. per incumbent local exchange carrier per fiscal year. SECTION 4.0Nonstatutory provisions. (1) The department of military affairs shall, by Janu- ary 1, 2027, submit to the chief clerk of each house of the legislature for distribution to the legislature under s. 13.172 (2), a report that includes all of the following: (a) A summary of the status of the emergency ser- vices IP network required under s. 256.35 (3s) (b). (b) A summary of the total amount of grants awarded under s. 256.35 (3s) (bx) 2. for each of the following pur- poses in each fiscal year that the grant program under s. 256.35 (3s) (bx) has operated: 1. Reimbursement of incumbent local exchange car- riers’ costs associated with the IP−based transport of Next Generation 911. 2. Reimbursement of incumbent local exchange car- riers’ costs associated with the database used to operate Next Generation 911. 3. Reimbursement of incumbent local exchange car- riers’ costs associated with the purchase, installation, and maintenance of Next Generation 911 equipment. (c) A projection for additional necessary costs for reimbursement of incumbent local exchange carriers’ costs in the future. (d) A recommendation as to whether the grant pro- gram under s. 256.35 (3s) (bx) should continue to operate after June 30, 2027. SECTION 4m.0Effective dates. This act takes effect on the day after publication, except as follows: (1) 911 FUND NAME CHANGE. The amendment of s. 20.465 (3) (qs) takes effect on July 1, 2024.
