	12	+	AN ACT to create 20.465 (3) (qs) and 256.35 (3s) (bx) of the statutes; relating to:
	13	+	grants for incumbent local exchange carriers for costs associated with Next
	14	+	Generation 911 and making an appropriation.
	15	+	Analysis by the Legislative Reference Bureau
	16	+	Under current law, the Department of Military Affairs must award grants to
	17	+	public safety answering points, more commonly known as 911 call centers, for a
	18	+	variety of purposes related to advanced 911 operations, known as Next Generation
	19	+	911. In addition, under a separate grant program, DMA must award grants to county
	20	+	land information offices for the purpose of preparing geographic information systems
	21	+	data to help enable Next Generation 911.
	22	+	This bill creates an additional grant program under which DMA must award
	23	+	grants to incumbent local exchange carriers operating as originating service
	24	+	providers for the reimbursement of the incumbent local exchange carriers' certain
	25	+	various costs associated Next Generation 911. An “incumbent local exchange
	26	+	carrier” is defined under the bill to have the same meaning as it does under federal
	27	+	law. An “originating service provider” is an entity that provides a service that may
	28	+	be used to generate a request for emergency assistance and that may connect to an
	29	+	emergency number system.

	37	+	The people of the state of Wisconsin, represented in senate and assembly, do
	38	+	enact as follows:
	39	+	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
	40	+	the following amounts for the purposes indicated:

16		-	SECTION 2. 20.465 (3) (qs) of the statutes is created
17		-	to read:
18		-	20.465 (3) (qs) Grant program for incumbent local
19		-	exchange carriers. Biennially, from the police and fire
20		-	protection fund, the amounts in the schedule for the
21		-	department to provide grants under s. 256.35 (3s) (bx).
22		-	No moneys may be encumbered under this paragraph
23		-	after June 30, 2027.
24		-	SECTION 2m. 20.465 (3) (qs) of the statutes, as cre-
25		-	ated by 2023 Wisconsin Act .... (this act), is amended to
26		-	read:

29		-	protection 911 fund, the amounts in the schedule for the
30		-	department to provide grants under s. 256.35 (3s) (bx).
31		-	SECTION 3. 256.35 (3s) (bx) of the statutes is created

	48	+	Biennially, from the police and fire protection fund, the amounts in the schedule for
	49	+	the department to provide grants under s. 256.35 (3s) (bx).
	50	+	SECTION 3. 256.35 (3s) (bx) of the statutes is created to read:
	51	+	256.35 (3s) (bx) Grant program for incumbent local exchange carriers. 1. In
	52	+	this paragraph, “incumbent local exchange carrier” has the meaning given in 47 USC
36	53		251 (h).
37		-	2. From the appropriation under s. 20.465 (3) (qs), the
38		-	department shall award grants to incumbent local
39		-	exchange carriers operating as originating service
40		-	providers for the reimbursement of the incumbent local
41		-	exchange carriers’ costs associated with the IP−based
42		-	transport of Next Generation 911, the database used to
43		-	operate Next Generation 911, and the purchase, installa-
44		-	tion, and maintenance of Next Generation 911 equip-
45		-	ment. An incumbent local exchange carrier is not eligible

51		-	3. The department shall develop a policy that estab-
52		-	lishes eligibility criteria for grants under subd. 2. The
53		-	department may seek recommendations from the 911
54		-	subcommittee on the awarding of grants under subd. 2.,
55		-	including advice on appropriate grant purposes and eligi-
56		-	bility criteria for grants.
57		-	4. The department may not award more than one
58		-	grant under subd. 2. per incumbent local exchange carrier
59		-	per fiscal year.
60		-	SECTION 4.0Nonstatutory provisions.
61		-	(1) The department of military affairs shall, by Janu-
62		-	ary 1, 2027, submit to the chief clerk of each house of the
63		-	legislature for distribution to the legislature under s.
64		-	13.172 (2), a report that includes all of the following:
65		-	(a) A summary of the status of the emergency ser-
66		-	vices IP network required under s. 256.35 (3s) (b).
67		-	(b) A summary of the total amount of grants awarded
68		-	under s. 256.35 (3s) (bx) 2. for each of the following pur-
69		-	poses in each fiscal year that the grant program under s.
70		-	256.35 (3s) (bx) has operated:
71		-	1. Reimbursement of incumbent local exchange car-
72		-	riers’ costs associated with the IP−based transport of
73		-	Next Generation 911.
74		-	2. Reimbursement of incumbent local exchange car-
75		-	riers’ costs associated with the database used to operate
76		-	Next Generation 911.
77		-	3. Reimbursement of incumbent local exchange car-
78		-	riers’ costs associated with the purchase, installation, and
79		-	maintenance of Next Generation 911 equipment.
80		-	(c) A projection for additional necessary costs for
81		-	reimbursement of incumbent local exchange carriers’
82		-	costs in the future.
83		-	(d) A recommendation as to whether the grant pro-
84		-	gram under s. 256.35 (3s) (bx) should continue to operate
85		-	after June 30, 2027.
86		-	SECTION 4m.0Effective dates. This act takes effect
87		-	on the day after publication, except as follows:
88		-	(1) 911 FUND NAME CHANGE. The amendment of s.
89		-	20.465 (3) (qs) takes effect on July 1, 2024.

	83	+	for a grant under this subdivision unless it is acting as an incumbent local exchange
