AN ACT to create 5.051 of the statutes; relating to: the suspension of a rule of
the Elections Commission.
Analysis by the Legislative Reference Bureau
This bill is introduced as required by s. 227.26 (2) (j), stats., in support of the
action of the Joint Committee for Review of Administrative Rules in suspending
emergency rule 2209 of the Wisconsin Elections Commission on July 20, 2022.  The
suspended emergency rule 1) identified what constitutes a complete address for
purposes of a statutory provision that prohibits the counting of an absentee ballot
whose certificate is missing the address of a witness and 2) required municipal clerks
to take one or more specified corrective actions in an attempt to remedy the missing
or inaccurate information.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1.  5.051 of the statutes is created to read:
5.051  Repeal of emergency rule. The emergency rule promulgated by the
elections commission that took effect on July 11, 2022, and that created s. EL 6.06,

Wis. Adm. Code, relating to the correction of absentee ballot certificate envelopes, is
repealed.
