13 | 13 | | quality inspection and evaluation program for public school buildings used by pupils. |

14 | 14 | | DHS may perform random inspections of a public school building used by pupils, and |
---|
15 | 15 | | DHS must respond to complaints about the air quality in a public school building |
---|
16 | 16 | | used by pupils, unless the building was inspected within the previous two years and |
---|
17 | 17 | | no problems were identified or the building was inspected within the previous six |
---|
18 | 18 | | months and problems were identified. DHS may request and receive assistance from |
---|
19 | 19 | | local health departments or qualified third parties in performing its duties under the |
---|
20 | 20 | | bill. If DHS, a local health department, or a qualified third party performs an |
---|
21 | 21 | | inspection of the air quality in a public school building used by pupils, DHS, the local |
---|
22 | 22 | | health department, or the qualified third party must compile a report of the results |
---|
23 | 23 | | of that inspection in areas of the building used by pupils and areas of the building |
---|
24 | 24 | | not used by pupils, including the known potential health consequences of any |
---|
25 | 25 | | problems identified with air quality in the building and any identified potential |
---|
26 | 26 | | sources of air quality issues. DHS, the local health department, or the qualified third |
---|
27 | 27 | | party must present the report to the person who made the complaint, if any; to the |
---|
28 | 28 | | school board or the governing board of a charter school, whichever is applicable, |
---|
29 | 29 | | during an open meeting; and to the local health department, unless the local health |
---|
30 | 30 | | department performed the investigation and compiled the report. If requested, DHS |
---|
31 | 31 | | must then assist the school in developing a reasonable plan to address any air quality |
---|
32 | 32 | | issues found in the inspection. |

39 | 39 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
40 | 40 | | enact as follows: |

41 | 41 | | SECTION 1. 254.23 of the statutes is created to read: |
---|
42 | 42 | | 254.23 Indoor air quality inspection and evaluation program for |
---|
43 | 43 | | public schools. (1) The department shall establish an indoor air quality inspection |
---|
44 | 44 | | and evaluation program for public school buildings used by pupils. The department |
---|
45 | 45 | | may perform random air quality inspections of a public school building used by |
---|
46 | 46 | | pupils and shall respond to complaints received about the quality of air in a public |
---|
47 | 47 | | school building used by pupils, unless the building was inspected within the previous |
---|
48 | 48 | | 2 years and no air quality problems were identified or the building was inspected |
---|
49 | 49 | | within the previous 6 months and air quality problems were identified. The |
---|
50 | 50 | | department may request and receive assistance from local health departments or |
---|
51 | 51 | | qualified 3rd parties in performing its duties under this section. |
---|
52 | 52 | | (2) If the department, a local health department, or a qualified 3rd party |
---|
53 | 53 | | performs an air quality inspection of a public school building used by pupils, the |
---|
54 | 54 | | department, local health department, or qualified 3rd party shall do all of the |
---|
55 | 55 | | following: |
---|
56 | 56 | | (a) Compile a report of the results of the air quality inspection in the areas of |
---|
57 | 57 | | the building that are used by pupils and the areas that are not used by pupils, |
---|
58 | 58 | | including the known potential health consequences of any problems identified with |
---|
59 | 59 | | air quality in the building and any identified potential sources of air quality issues. |

60 | 60 | | (b) Present the report of the results to all of the following: |
---|

---|
96 | 96 | | inspection was completed at random. |
