11	11	AN ACT to repeal 6.36 (1) (ae) and 343.50 (8) (c) 3.; to amend 6.36 (1) (b) 1. a.,
12	12	342.06 (1) (eg) and 343.14 (2j); and to create 6.36 (1) (af) of the statutes;
13	13	relating to: Wisconsin's membership agreement with the Electronic
14	14	Registration Information Center.

16	16	Under current law, the administrator of the Elections Commission is required
17	17	to enter into a membership agreement with the Electronic Registration Information
18	18	Center (ERIC) to assist the commission in maintaining Wisconsin's official voter
19	19	registration list.
20	20	This bill terminates Wisconsin's membership agreement with ERIC and directs
21	21	the administrator of the Elections Commission to undertake all actions necessary
22	22	and proper to effect that termination. The bill also expressly prohibits the
23	23	commission and any other state agency from entering into a membership agreement
24	24	with ERIC.
25	25	For further information see the state fiscal estimate, which will be printed as
26	26	an appendix to this bill.
27	27	The people of the state of Wisconsin, represented in senate and assembly, do
28	28	enact as follows:
29	29	SECTION 1. 6.36 (1) (ae) of the statutes is repealed.

37	37	SECTION 2. 6.36 (1) (af) of the statutes is created to read:
38	38	6.36 (1) (af) Neither the commission nor any other agency, as defined in s.
39	39	13.172 (1), may enter into a membership agreement with Electronic Registration
40	40	Information Center, Inc.
41	41	SECTION 3. 6.36 (1) (b) 1. a. of the statutes is amended to read:
42	42	6.36 (1) (b) 1. a. Except as provided in pars. (ae), (bm), and (bn), no person other
43	43	than an employee of the commission, a county clerk, a deputy county clerk, an
44	44	executive director of a county board of election commissioners, a deputy designated
45	45	by the executive director, a municipal clerk, a deputy municipal clerk, an executive
46	46	director of a city board of election commissioners, or a deputy designated by the
47	47	executive director may view the date of birth, operator's license number, or social
48	48	security account number of an elector, the address of an elector to whom an
49	49	identification serial number is issued under s. 6.47 (3), or any indication of an
50	50	accommodation required under s. 5.25 (4) (a) to permit voting by an elector.
51	51	SECTION 4. 342.06 (1) (eg) of the statutes is amended to read:
52	52	342.06 (1) (eg) Except as provided in par. (eh), if the applicant is an individual,
53	53	the social security number of the applicant. The department of transportation may
54	54	not disclose a social security number obtained under this paragraph to any person
55	55	except to the department of children and families for the sole purpose of
56	56	administering s. 49.22, to the department of workforce development for the sole
57	57	purpose of enforcing or administering s. 108.22, and to the department of revenue
58	58	for the purposes of administering state taxes and collecting debt, and to the elections
59	59	commission for the sole purpose of allowing the chief election officer to comply with
60	60	the terms of the agreement under s. 6.36 (1) (ae).
61	61	SECTION 5. 343.14 (2j) of the statutes is amended to read:

91	91	343.14 (2j) Except as otherwise required to administer and enforce this
92	92	chapter, the department of transportation may not disclose a social security number
93	93	obtained from an applicant for a license under sub. (2) (bm) to any person except to
94	94	the department of children and families for the sole purpose of administering s.
95	95	49.22, to the department of workforce development for the sole purpose of enforcing
96	96	or administering s. 108.22, to the department of revenue for the purposes of
97	97	administering state taxes and collecting debt, or to the driver licensing agency of
98	98	another jurisdiction, or to the elections commission for the sole purpose of allowing
99	99	the chief election officer to comply with the terms of the agreement under s. 6.36 (1)
100	100	(ae).
101	101	SECTION 6. 343.50 (8) (c) 3. of the statutes is repealed.
102	102	SECTION 7.0Nonstatutory provisions.
103	103	(1) TERMINATION OF ERIC AGREEMENT. This state's agreement with the
104	104	Electronic Registration Information Center, entered into under s. 6.36 (1) (ae) 1.,
105	105	2021 stats., is terminated. The chief election officer of this state shall undertake all
106	106	actions necessary and proper to give effect to this subsection.
