1010 AN ACT to renumber and amend 101.16 (2); and to create 101.16 (2) (b) of the
1111 statutes; relating to: prohibiting certain rules related to dispensing liquefied
1212 petroleum gases for vehicle fuel purposes.
1313 Analysis by the Legislative Reference Bureau
1414 This bill prohibits the Department of Safety and Professional Services from
1515 promulgating any rule that does any of the following regarding liquefied petroleum
1616 gases used for vehicle fuel purposes: 1) prohibits self-service dispensing; or 2)
1717 requires completion of training to dispense. Under current law, DSPS must
1818 promulgate rules to establish rules and standards for the design, construction,
1919 location, operation, and maintenance of equipment for storage, handling, use, and
2020 transportation by tank truck or tank trailer of liquefied petroleum gases used for fuel
2121 purposes.
2222 The people of the state of Wisconsin, represented in senate and assembly, do
2323 enact as follows:
2424 SECTION 1. 101.16 (2) of the statutes is renumbered 101.16 (2) (a) and amended
2525 to read:
2626 101.16 (2) (a) The Except as provided in par. (b), the department shall

3737 regulations for the design, construction, location, installation, operation, repair, and
3838 maintenance of equipment for storage, handling, use, and transportation by tank
3939 truck or tank trailer, of liquefied petroleum gases for fuel purposes, and for the
4040 odorization of said gases used therewith, as shall render such equipment safe.
4141 SECTION 2. 101.16 (2) (b) of the statutes is created to read:
4242 101.16 (2) (b) 1. The department may not promulgate a rule that prohibits
4343 self-service dispensing by the general public of liquefied petroleum gases for vehicle
4444 fuel purposes.
4545 2. The department may not promulgate a rule that requires completion of
4646 training to dispense liquefied petroleum gases for vehicle fuel purposes.
