10	10	AN ACT to create 49.45 (61m) of the statutes; relating to: provision of health
11	11	services through telehealth by out-of-state providers under the Medical
12	12	Assistance program.

14	14	Under current administrative code, out-of-state health care providers that
15	15	regularly provide services to Wisconsin Medical Assistance recipients and that
16	16	provide services to Wisconsin Medical Assistance recipients through telehealth may
17	17	apply for certification as a Medical Assistance provider in Wisconsin regardless of
18	18	the provider's location. This bill codifies this administrative code provision by
19	19	prohibiting the Department of Health Services from requiring a health care provider
20	20	that is licensed, certified, registered, or otherwise authorized to provide health care
21	21	services in this state and that exclusively offers health care services in this state
22	22	through telehealth to maintain a physical address or site in this state to be eligible
23	23	for enrollment as a certified provider under the Medical Assistance program.
24	24	Additionally, this bill prohibits DHS from requiring a provider group with health
25	25	care providers that are licensed, certified, registered, or otherwise authorized to
26	26	provide health care services in this state and that exclusively offer health care
27	27	services in this state through telehealth to maintain a physical address or site in this
28	28	state to be eligible for enrollment as a provider group under the Medical Assistance

34	34	program. The Medical Assistance program is a joint state and federal program that
35	35	provides health services to individuals who have limited financial resources.
36	36	The people of the state of Wisconsin, represented in senate and assembly, do
37	37	enact as follows:
38	38	SECTION 1. 49.45 (61m) of the statutes is created to read:
39	39	49.45 (61m) SERVICES PROVIDED THROUGH TELEHEALTH BY OUT-OF-STATE
40	40	PROVIDERS. (a) In this subsection, “telehealth” has the meaning given in sub. (61) (a)
41	41	4.
42	42	(b) The department may not require a health care provider that is licensed,
43	43	certified, registered, or otherwise authorized to provide health care services in this
44	44	state and that exclusively offers health care services in this state through telehealth
45	45	to maintain a physical address or site in this state to be eligible for enrollment as a
46	46	certified provider under the Medical Assistance program.
47	47	(c) The department may not require a provider group with health care
48	48	providers that are licensed, certified, registered, or otherwise authorized to provide
49	49	health care services in this state and that exclusively offer health care services in this
50	50	state through telehealth to maintain a physical address or site in this state to be
51	51	eligible for enrollment as a provider group under the Medical Assistance program.
