43	43	education, insurance coverage, national guard, jury duty, and adoption and in
44	44	the receipt of mental health or vocational rehabilitation services.
45	45	Analysis by the Legislative Reference Bureau
46	46	This bill prohibits discrimination on the basis of an individual's gender identity
47	47	or gender expression, which is defined in the bill as an individual's gender-related
48	48	identity, gender-related appearance, gender-related expression, or gender-related
49	49	behavior, regardless of the individual's assigned sex at birth or gender identifiers on
50	50	official documents issued by a federal, state, or local government agency. The bill also
51	51	make changes to various discrimination laws, including all of the following:
52	52	1. Current law prohibits discrimination in employment, housing, and the equal
53	53	enjoyment of a public place of accommodation or amusement on the basis of a
54	54	person's sex or sexual orientation. Current law also requires certain state agencies,
55	55	authorities, and corporations to include provisions in contracts they execute obliging
56	56	the contractor to similarly not discriminate against any employee or applicant for
57	57	employment. This bill adds gender identity or gender expression as a prohibited
58	58	basis for discrimination in these areas.
59	59	2. Current law prohibits the University of Wisconsin System, the Technical
60	60	College System, public elementary and secondary schools, and charter schools from
61	61	discriminating against a student on the basis of the student's sex or sexual
62	62	orientation. This bill prohibits the same educational institutions from
63	63	discriminating against a student on the basis of the student's gender identity or
64	64	gender expression, and from discriminating against a student based on the protected
65	65	status of the student's parent. This bill also prohibits the UW System Board of
66	66	Regents from investing gifts, grants, and bequests in companies that practice
67	67	discrimination based on sexual orientation or gender identity or gender expression.
68	68	3. Current law prohibits the exclusion of an individual from jury duty on the
69	69	basis of the individual's sex or sexual orientation. This bill adds gender identity or
70	70	gender expression as a prohibited basis for exclusion of an individual from jury duty.
71	71	4. Current law allows only either a single adult or a husband and wife jointly
72	72	to adopt a child. This bill allows only either a single individual or two individuals
73	73	married to each other jointly to adopt a child, and also provides that no otherwise
74	74	qualified person may be denied the benefits of the adoption and guardianship statute
75	75	subchapter because of the person's sex, sexual orientation, or gender identity or
76	76	gender expression.
77	77	5. Current law requires heads of executive departments and agencies to
78	78	determine whether there is arbitrary discrimination on the basis of sex or sexual
79	79	orientation, and to take remedial action if such discrimination is found. This bill
80	80	requires these heads to also determine if there is discrimination on the basis of
81	81	gender identity or gender expression, and take remedial action regarding such
82	82	discrimination.
83	83	6. Current law prohibits discriminating against an employee, prospective
84	84	employee, patient, or resident of an approved treatment facility providing treatment

90	90	of alcoholic, drug dependent, mentally ill, or developmentally disabled persons on
91	91	the basis of sex. This bill adds sexual orientation and gender identity or gender
92	92	expression as prohibited bases of discrimination.
93	93	7. Current law prohibits agency rules from discriminating against a person by
94	94	reason of sex or sexual orientation. This bill adds gender identity or gender
95	95	expression as prohibited bases of discrimination.
96	96	8. Current law prohibits discrimination on the basis of sex in the provision of
97	97	vocational rehabilitation or mental health services. This bill adds sexual orientation
98	98	and gender identity or gender expression to the prohibited bases of discrimination.
99	99	9. Current law prohibits the national guard or state defense force from denying
100	100	membership based on sex or sexual orientation. This bill adds gender identity or
101	101	gender expression as a prohibited basis of discrimination. This bill also provides that
102	102	no member of the national guard or state defense force may be denied equal access
103	103	to facilities most consistent with the person's gender identity.
104	104	10. Current law provides that sex is a bona fide occupational qualification if all
105	105	of the members of one sex are physically incapable of performing the essential duties
106	106	required by a job, or if the essence of the employer's business operation would be
107	107	undermined if employees were not hired exclusively from one sex. This bill adds to
108	108	the sex as a bona fide occupational qualification law that an individual may not be
109	109	treated or regarded inconsistent with the individual's gender identity, or
110	110	discriminated against based on the individual's gender identity or gender
111	111	expression.
112	112	11. Current law allows public places of accommodation or amusement to
113	113	provide separate facilities to persons of different sexes. This bill provides that public
114	114	places of accommodation or amusement may provide separate facilities to persons
115	115	of different sexes, but prohibits those places from denying individuals equal access
116	116	to the facilities most consistent with the individual's gender identity.
117	117	12. This bill prohibits an insurer from discriminating against an individual on
118	118	the basis of age, residence, race, color, creed, religion, national origin, ancestry,
119	119	marital status, occupation, gender identity or gender expression, sex, or sexual
120	120	orientation, and also prohibits motor carriers, automobile insurers, transportation
121	121	network companies, and real estate brokers and salespersons from discriminating
122	122	against an individual on the basis of sexual orientation or gender identity or gender
123	123	expression.
124	124	13. The bill expressly prohibits a school board from discriminating against a
125	125	student-led organization because the organization's mission is related to sexual
126	126	orientation, gender identity, or gender expression.

129	129	The people of the state of Wisconsin, represented in senate and assembly, do
130	130	enact as follows:
131	131	SECTION 1. 15.04 (1) (g) of the statutes is amended to read:1 - 4 -2023 - 2024 Legislature LRB-4578/1

134	134	15.04 (1) (g) Discrimination review. In order to determine whether there is any
135	135	arbitrary discrimination on the basis of race, religion, national origin, sex, marital
136	136	status or, gender identity or gender expression, as defined in s. 111.32 (7j), or sexual
137	137	orientation, as defined in s. 111.32 (13m), examine and assess the statutes under
138	138	which the head has powers or regulatory responsibilities, the procedures by which
139	139	those statutes are administered, and the rules promulgated under those statutes.
140	140	If the department or agency head finds any such discrimination, he or she the agency
141	141	head shall take remedial action, including making recommendations to the
142	142	appropriate executive, legislative, or administrative authority.
143	143	SECTION 2. 16.765 (1) of the statutes is amended to read:
144	144	16.765 (1) Contracting agencies, the University of Wisconsin Hospitals and
145	145	Clinics Authority, the Fox River Navigational System Authority, the Wisconsin
146	146	Aerospace Authority, the Lower Fox River Remediation Authority, the Wisconsin
147	147	Economic Development Corporation, and the Bradley Center Sports and
148	148	Entertainment Corporation shall include in all contracts executed by them a
149	149	provision obligating the contractor not to discriminate against any employee or
150	150	applicant for employment because of age, race, religion, color, handicap disability,
151	151	sex, physical condition, developmental disability, as defined in s. 51.01 (5), sexual
152	152	orientation, as defined in s. 111.32 (13m), gender identity or gender expression, as
153	153	defined in s. 111.32 (7j), or national origin and, except with respect to sexual
154	154	orientation or gender identity or gender expression, obligating the contractor to take
155	155	affirmative action to ensure equal employment opportunities.
156	156	SECTION 3. 16.765 (2) of the statutes is amended to read:
157	157	16.765 (2) Contracting agencies, the University of Wisconsin Hospitals and
158	158	Clinics Authority, the Fox River Navigational System Authority, the Wisconsin

188	188	Aerospace Authority, the Lower Fox River Remediation Authority, the Wisconsin
189	189	Economic Development Corporation, and the Bradley Center Sports and
190	190	Entertainment Corporation shall include the following provision in every contract
191	191	executed by them: “In connection with the performance of work under this contract,
192	192	the contractor agrees not to discriminate against any employee or applicant for
193	193	employment because of age, race, religion, color, handicap disability, sex, physical
194	194	condition, developmental disability, as defined in s. 51.01 (5), sexual orientation, as
195	195	defined in s. 111.32 (13m), gender identity or gender expression, as defined in s.
196	196	111.32 (7j), or national origin. This provision shall include, but not be limited to, the
197	197	following: employment, upgrading, demotion or transfer; recruitment or recruitment
198	198	advertising; layoff or termination; rates of pay or other forms of compensation; and
199	199	selection for training, including apprenticeship. Except with respect to sexual
200	200	orientation or gender identity or gender expression, the contractor further agrees to
201	201	take affirmative action to ensure equal employment opportunities. The contractor
202	202	agrees to post in conspicuous places, available for employees and applicants for
203	203	employment, notices to be provided by the contracting officer setting forth the
204	204	provisions of the nondiscrimination clause". clause."
205	205	SECTION 4. 36.09 (1) (e) of the statutes is amended to read:
206	206	36.09 (1) (e) Subject to par. (em), the board shall appoint a president of the
207	207	system; a chancellor for each institution; a dean for each college campus; the state
208	208	geologist; the director of the laboratory of hygiene; the director of the psychiatric
209	209	institute; the state cartographer; and the requisite number of officers, other than the
210	210	vice presidents, associate vice presidents, and assistant vice presidents of the
211	211	system; faculty; academic staff; and other employees and fix the salaries, subject to
212	212	the limitations under par. (j) and s. 230.12 (3) (e), the duties and the term of office

240	240	for each. The board shall fix the salaries, subject to the limitations under par. (j) and
241	241	s. 230.12 (3) (e), and the duties for each chancellor, vice president, associate vice
242	242	president, and assistant vice president of the system. No sectarian or partisan tests
243	243	or any tests based upon race, religion, national origin, or sex, gender identity or
244	244	gender expression, as defined in s. 111.32 (7j), or sexual orientation, as defined in s.
245	245	111.32 (13m), shall ever be allowed or exercised in the appointment of the employees
246	246	of the system.
247	247	SECTION 5. 36.11 (3) (a) of the statutes is amended to read:
248	248	36.11 (3) (a) The board shall establish the policies for admission within the
249	249	system and within these policies each institution shall establish specific
250	250	requirements for admission to its courses of instruction. No sectarian or partisan
251	251	tests test or any tests test based upon race, color, creed, religion, sex, national origin
252	252	of U.S. citizens or sex, disability, ancestry, age, sexual orientation, as defined in s.
253	253	111.32 (13m), gender identity or gender expression, as defined in s. 111.32 (7j),
254	254	pregnancy, marital status, or parental status shall ever be allowed in the admission
255	255	of students thereto a student to any service, course, program, or facility of the system
256	256	or any of its institutions.
257	257	SECTION 6. 36.12 (1) of the statutes is amended to read:
258	258	36.12 (1) No student may be denied admission to, participation in, or the
259	259	benefits of, or be discriminated against in, any service, program, course, or facility
260	260	of the system or its institutions because of the student's race, color, creed, religion,
261	261	sex, national origin, disability, ancestry, age, sexual orientation, as defined in s.
262	262	111.32 (13m), gender identity or gender expression, as defined in s. 111.32 (7j),
263	263	pregnancy, marital status, or parental status of the student or of the student's
264	264	parent.

294	294	SECTION 7. 36.29 (1) of the statutes is amended to read:
295	295	36.29 (1) All gifts, grants, and bequests for the benefit or advantage of the
296	296	system or any of its institutions, departments, or facilities or to provide any means
297	297	of instruction, illustration, or knowledge in connection therewith, whether made to
298	298	trustees or otherwise, shall be valid notwithstanding any other provision of this
299	299	chapter except as otherwise provided in this subsection and shall be executed and
300	300	enforced according to the provisions of the instrument making the same, including
301	301	all provisions and directions in any such instrument for accumulation of the income
302	302	of any fund or rents and profits of any real estate without being subject to the
303	303	limitations and restrictions provided by law in other cases; but no such income
304	304	accumulation shall be allowed to produce a fund more than 20 times as great as that
305	305	originally given. No investment of the funds of such gifts, grants, or bequests shall
306	306	knowingly be made in any company, corporation, subsidiary, or affiliate that
307	307	practices or condones through its actions discrimination on the basis of race, religion,
308	308	color, creed, or sex, gender identity or gender expression, as defined in s. 111.32 (7j),
309	309	or sexual orientation, as defined in s. 111.32 (13m). Except as otherwise provided in
310	310	this section, the board may invest not to exceed 85 percent of trust funds held and
311	311	administered by the board in common stocks. This subsection does not apply to a gift,
312	312	grant, or bequest that the board declines to accept or that the board is not authorized
313	313	to accept under this section.
314	314	SECTION 8. 38.04 (13) (b) of the statutes is amended to read:
315	315	38.04 (13) (b) No person may, on the ground of sex, gender identity or gender
316	316	expression, as defined in s. 111.32 (7j), sexual orientation, as defined in s. 111.32

345	345	activity funded in whole or in part with funds made available under this subsection.
346	346	SECTION 9. 38.23 (1) of the statutes is amended to read:
347	347	38.23 (1) No student may be denied admission to, participation in, or the
348	348	benefits of, or be discriminated against in, any service, program, course, or facility
349	349	of the board or any district because of the student's race, color, creed, religion, sex,
350	350	national origin, disability, ancestry, age, sexual orientation, as defined in s. 111.32
351	351	(13m), gender identity or gender expression, as defined in s. 111.32 (7j), pregnancy,
352	352	marital status, or parental status of the student or of the student's parent.
353	353	SECTION 10. 38.23 (4) of the statutes is amended to read:
354	354	38.23 (4) Nothing in this section or s. 36.12 prevents institutions from
355	355	segregating students in dormitories based on sex, except that no person may be
356	356	denied equal access to the dormitory most consistent with the person's gender
357	357	identity.
358	358	SECTION 11. 47.02 (3m) (f) of the statutes is amended to read:
359	359	47.02 (3m) (f) Assure that eligibility for vocational rehabilitation services
360	360	under this chapter is determined without regard to the sex, gender identity or gender
361	361	expression, as defined in s. 111.32 (7j), sexual orientation, as defined in s. 111.32
362	362	(13m), race, age, creed, color, or national origin of the individual applying for
363	363	services, that no class of individuals is found ineligible solely on the basis of type of
364	364	disability, and that no age limitations for eligibility exist which that, by themselves,
365	365	would result in ineligibility for vocational rehabilitation services.
366	366	SECTION 12. 48.82 (1) (a) of the statutes is amended to read:

409	409	SECTION 15. 66.0125 (3) (a) of the statutes is amended to read:
410	410	66.0125 (3) (a) The purpose of the commission is to study, analyze, and
411	411	recommend solutions for the major social, economic, and cultural problems that
412	412	affect people residing or working within the local governmental unit, including
413	413	problems of the family, youth, education, the aging, juvenile delinquency, health and
414	414	zoning standards, discrimination in employment and public accommodations and
415	415	facilities on the basis of sex, class, race, religion, gender identity or gender
416	416	expression, as defined in s. 111.32 (7j), sexual orientation, as defined in s. 111.32
417	417	(13m), or ethnic or minority status and discrimination in housing on the basis of sex,
418	418	class, race, religion, sexual orientation, as defined in s. 111.32 (13m), gender identity
419	419	or gender expression, as defined in s. 111.32 (7j), ethnic or minority status, or status
420	420	as a victim of domestic abuse, sexual assault, or stalking.

448	448	66.0125 (3) (c) 1. b. To ensure to all residents of a local governmental unit,
449	449	regardless of sex, race, sexual orientation, as defined in s. 111.32 (13m), gender
450	450	identity or gender expression, as defined in s. 111.32 (7j), or color, the right to enjoy
451	451	equal employment opportunities and to ensure to those residents, regardless of sex,
452	452	race, sexual orientation, as defined in s. 111.32 (13m), gender identity or gender
453	453	expression, as defined in s. 111.32 (7j), color, or status as a victim of domestic abuse,
454	454	sexual assault, or stalking, the right to possess equal housing opportunities.
455	455	SECTION 17. 66.0125 (9) of the statutes is amended to read:
456	456	66.0125 (9) INTENT. It is the intent of this section to promote fair and friendly
457	457	relations among all the people in this state, and to that end race, creed, sexual
458	458	orientation, as defined in s. 111.32 (13m), gender identity or gender expression, as
459	459	defined in s. 111.32 (7j), or color ought not to be made tests in the matter of the right
460	460	of any person to earn a livelihood or to enjoy the equal use of public accommodations
461	461	and facilities and race, creed, sexual orientation, as defined in s. 111.32 (13m), gender
462	462	identity or gender expression, as defined in s. 111.32 (7j), color, or status as a victim
463	463	of domestic abuse, sexual assault, or stalking ought not to be made tests in the matter
464	464	of the right of any person to sell, lease, occupy, or use real estate.
465	465	SECTION 18. 66.1011 (1) of the statutes is amended to read:
466	466	66.1011 (1) DECLARATION OF POLICY. The right of all persons to have equal
467	467	opportunities for housing regardless of their sex, race, color, disability, as defined in

624	624	significant portion of the housing business in this state and should be regulated.

1080	1080	aid or protection. Municipal employees have the right to refrain from any and all
1081	1081	such activities. A general municipal employee has the right to refrain from paying
1082	1082	dues while remaining a member of a collective bargaining unit. A public safety
1083	1083	employee or a transit employee, however, may be required to pay dues in the manner
1084	1084	provided in a fair-share agreement; a fair-share agreement covering a public safety
1085	1085	employee or a transit employee must contain a provision requiring the municipal
1086	1086	employer to deduct the amount of dues as certified by the labor organization from the
1087	1087	earnings of the employee affected by the fair-share agreement and to pay the amount
1088	1088	deducted to the labor organization. A fair-share agreement covering a public safety
1089	1089	employee or transit employee is subject to the right of the municipal employer or a
1090	1090	labor organization to petition the commission to conduct a referendum. Such
1091	1091	petition must be supported by proof that at least 30 percent of the employees in the
1092	1092	collective bargaining unit desire that the fair-share agreement be terminated. Upon
1093	1093	so finding, the commission shall conduct a referendum. If the continuation of the
1094	1094	agreement is not supported by at least the majority of the eligible employees, it shall
1095	1095	terminate. The commission shall declare any fair-share agreement suspended upon
1096	1096	such conditions and for such time as the commission decides whenever it finds that
1097	1097	the labor organization involved has refused on the basis of race, color, sexual
1098	1098	orientation, as defined in s. 111.32 (13m), gender identity or gender expression, as
1099	1099	defined in s. 111.32 (7j), creed, or sex to receive as a member any public safety
1100	1100	employee or transit employee of the municipal employer in the bargaining unit
1101	1101	involved, and such agreement is subject to this duty of the commission. Any of the
1102	1102	parties to such agreement or any public safety employee or transit employee covered
1103	1103	by the agreement may come before the commission, as provided in s. 111.07, and ask
1104	1104	the performance of this duty.
