15 | 15 | | psychotherapy to consumers through outpatient mental health clinics certified by |

16 | 16 | | the Department of Health Services. Under current administrative code, “qualified |

17 | 17 | | treatment trainee” is defined to mean either a graduate student who is enrolled in |

18 | 18 | | an accredited institution in psychology, counseling, marriage and family therapy, |
---|
19 | 19 | | social work, nursing, or a closely related field or a person with a graduate degree from |
---|
20 | 20 | | an accredited institution and course work in psychology, counseling, marriage and |
---|
21 | 21 | | family therapy, social work, nursing, or a closely related field who has not yet |
---|
22 | 22 | | completed applicable supervised practice requirements. This bill adds to the |
---|
23 | 23 | | definition of qualified treatment trainee for purposes of providing psychotherapy to |
---|
24 | 24 | | consumers through outpatient mental health clinics a person with a graduate degree |
---|
25 | 25 | | from an accredited institution in psychology, counseling, marriage and family |
---|
26 | 26 | | therapy, social work, nursing or a closely related field who has submitted an |
---|
27 | 27 | | application for a training license as a social worker, marriage and family therapist, |
---|
28 | 28 | | or professional counselor until the person is granted a training license or for one year |
---|
29 | 29 | | following the date that the person submitted an application for a training license, |
---|
30 | 30 | | whichever occurs first. |

38 | 38 | | promulgate rules to allow qualified treatment trainees and persons with a graduate |
---|
39 | 39 | | degree from an accredited institution in psychology, counseling, marriage and family |

40 | 40 | | therapy, social work, nursing, or a closely related field who have submitted an |

41 | 41 | | application for a training license as a social worker, marriage and family therapist, |
---|
42 | 42 | | or professional counselor within the previous year but have not yet been granted a |
---|
43 | 43 | | training license to provide psychotherapy to patients through an outpatient mental |
---|
44 | 44 | | health clinic certified by DHS while under clinical supervision as defined by DHS. |

45 | 45 | | Additionally, the bill directs the Marriage and Family Therapy, Professional |
---|
46 | 46 | | Counseling, and Social Work Examining Board to promulgate rules establishing |
---|
47 | 47 | | standards of conduct for qualified treatment trainees to engage in psychotherapy in |
---|
48 | 48 | | an outpatient mental health clinic certified by DHS including a requirement that |
---|
49 | 49 | | qualified treatment trainees be supervised while engaging in psychotherapy. |

52 | 52 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
53 | 53 | | enact as follows: |

54 | 54 | | SECTION 1. 51.42 (7) (b) 12. of the statutes is created to read: |
---|
55 | 55 | | 51.42 (7) (b) 12. Allow qualified treatment trainees, as defined in s. 457.01 (8r), |
---|
56 | 56 | | and persons with a graduate degree from an accredited institution in psychology, |
---|
57 | 57 | | counseling, marriage and family therapy, social work, nursing, or a closely related |
---|
58 | 58 | | field who have submitted an application for a training license under s. 457.09, |
---|
59 | 59 | | 457.11, or 457.13 within the previous year but have not yet been granted a training |
---|
60 | 60 | | license to provide psychotherapy to patients through an outpatient mental health |
---|
61 | 61 | | clinic certified by the department while under clinical supervision as defined by the |
---|
62 | 62 | | department by rule. |

63 | 63 | | SECTION 2. 457.01 (8r) of the statutes is created to read: |

64 | 64 | | 457.01 (8r) “Qualified treatment trainee” means either of the following: |
---|
65 | 65 | | (a) A graduate student who is enrolled in an accredited institution in |
---|
66 | 66 | | psychology, counseling, marriage and family therapy, social work, nursing, or a |
---|
67 | 67 | | closely related field. |

94 | 94 | | section, and professional counselor section, promulgate rules establishing standards |

95 | 95 | | of conduct for qualified treatment trainees to engage in psychotherapy through an |

96 | 96 | | outpatient mental health clinic certified by the department of health services |

97 | 97 | | including a requirement that qualified treatment trainees be supervised while |

98 | 98 | | engaging in psychotherapy. |

99 | 99 | | SECTION 4. 457.035 (3) of the statutes is created to read: |

100 | 100 | | 457.035 (3) The individual is a qualified treatment trainee and the individual |

101 | 101 | | engages in psychotherapy through an outpatient mental health clinic certified by the |

102 | 102 | | department of health services while supervised as provided by the examining board |

104 | 104 | | SECTION 5. DHS 35.03 (17m) (b) of the administrative code is amended to read: |
