15 | 15 | | This bill establishes a right of health care providers to express their |
---|
16 | 16 | | professional opinions related to health or medical information or guidance, including |
---|
17 | 17 | | any statements, policies, studies, publications, or orders. The bill prohibits any |
---|
18 | 18 | | health care entity from retaliating against, discriminating against, or taking |
---|
19 | 19 | | adverse action against a health care provider for expressing his or her professional |
---|
20 | 20 | | opinions. However, the bill excepts health care entities that are faith-based or |
---|
21 | 21 | | religious institutions that have published religious, moral, or ethical policies or |
---|
22 | 22 | | guidelines from the requirements of the bill to the extent that an action taken by a |
---|
23 | 23 | | health care provider violates the institution's religious, moral, or ethical policies or |
---|
24 | 24 | | guidelines. Further, the bill prohibits any examining board or affiliated |
---|
25 | 25 | | credentialing board in the Department of Safety and Professional Services from |
---|
26 | 26 | | retaliating against, discriminating against, or taking adverse action against, or |
---|
27 | 27 | | denying, suspending, limiting, or revoking a credential to, a health care provider for |
---|
28 | 28 | | expressing his or her professional opinions. |

36 | 36 | | SECTION 1. 146.98 of the statutes is created to read: |

38 | 38 | | (1) In this section: |

39 | 39 | | (a) “Health care entity” has the meaning given for “health care provider” in s. |

40 | 40 | | 146.81 (1) (i) to (p). |

41 | 41 | | (b) “Health care provider” has the meaning given in s. 146.81 (1) (a) to (hp). |

52 | 52 | | (1) In this section, “health care provider” has the meaning given in s. 146.81 (1) (a) |

---|
54 | 54 | | (2) No credentialing board may retaliate against, discriminate against, or take |
---|
55 | 55 | | adverse action against, or deny, suspend, limit, or revoke a credential to, a health |
---|

---|
57 | 57 | | to any health or medical information or guidance, including any statements, policies, |
