If the right to receive reimbursement for dental care and related services is assigned to a provider of dental care or related services, then the insurer must directly pay the provider the amount of any claim under the same criteria and payment schedule under which the insurer would have reimbursed the insured individual. An insurer may require an assignment to be documented in writing. If an insurer receives a written assignment, then the insurer must send a copy of the written assignment to the provider to whom the assignment is made. ASSEMBLY AMENDMENT 1 Assembly Amendment 1 permits an insured person to assign the right to receive reimbursement for dental care and related services under a limited-scope dental benefit, as opposed to a health benefit plan in 2023 Assembly Bill 62. Additionally, Assembly Amendment 1 removes the requirement that an insurer must send a copy of the written assignment to the provider to whom the assignment is made. Assembly Amendment 1 permits an insurer to require revocation of assignment t0 be documented in writing and allows documentation of assignment or revocation of assignment to be submitted electronically.
