1212 This bill authorizes a county, city, town, or village to install and maintain
1313 cameras in highway work zones for the purpose of capturing video or photographic
1414 evidence of traffic accidents and other violations of the law. Evidence captured by
1515 a camera authorized under the bill may be accessed only by a law enforcement agency
1616 and only if a police report is filed in connection with a traffic accident or other
1717 violation. Evidence captured by a camera authorized under the bill may not
1818 otherwise be used to determine compliance with any state law or local ordinance.
1919 The people of the state of Wisconsin, represented in senate and assembly, do
2020 enact as follows:
2121 SECTION 1. 349.238 of the statutes is created to read:
2222 349.238 Authority to install cameras in work zones. (1) A political
2323 subdivision may install and maintain cameras where persons are engaged in work
2424 in a highway maintenance or construction area for the purpose of capturing video or
2525 photographic evidence of traffic accidents and other violations of the law.

3434 SECTION 1 ASSEMBLY BILL 651
3535 (2) Video and photographic evidence captured by a camera authorized under
3636 this section may be accessed only by a law enforcement agency, as defined in s. 165.83
3737 (1) (b), and only if a police report is filed in connection with a traffic accident or other
3838 violation of the law that occurred in the highway maintenance or construction area
3939 where the camera is installed.
4040 (3) Except as provided in sub. (2), no state or local authority may use video or
4141 photographic evidence captured by a camera authorized under this section to
4242 determine compliance with the laws of this state or local ordinances.
