2023 ASSEMBLY BILL 659 
2023 Assembly Bill 659 eliminates the provision of current law that prohibits the remote notarization of 
documents that create or execute powers of attorney. This would generally permit individuals to engage 
in remote notarization transactions for the purposes of creating or executing any powers of attorney. 
ASSEMBLY SUBSTITUTE AMENDMENT 1 
Assembly Substitute Amendment 1 creates an exception to the current prohibition on the use of remote 
notarization for the purposes of the creation or execution of powers of attorney for a limited financial 
power of attorney for a real estate transaction. This would generally permit individuals to engage in 
remote notarization for the purposes of powers of attorney for real estate transactions only.
