1010 AN ACT to amend 196.03 (4) of the statutes; relating to: the amount certain
1111 public utilities may recover in rates relating to amounts assessed by the Public
1212 Service Commission.

1414 This bill lowers the total amount that certain public utilities can recover in
1515 rates for PSC proceeding expenditures.
1616 Under current law, a public utility, sewerage system, or power district
1717 (collectively, utility) may not raise the rates that it charges to customers without first
1818 applying to the PSC for approval of the change. The PSC may assess to utilities
1919 certain amounts corresponding to the PSC's expenditures in carrying out its duties
2020 relating to utilities. Generally under current law, a public utility that supplies gas
2121 or electricity to its customers and that is not a city, town, or village may recover in
2222 rates any expenditure for costs in a proceeding before the PSC up to four times the
2323 total amount assessed to that public utility by the PSC. This bill reduces this limit
2424 to the total amount assessed to that public utility by the PSC.
2525 The people of the state of Wisconsin, represented in senate and assembly, do
2626 enact as follows:

3434 196.03 (4) Any public utility which that is not a city, town, or village and which
3535 that supplies gas or electricity to its customers may not recover in rates set by the
3636 commission from any customer for any expenditure for costs in a proceeding before
3737 the commission which that exceed 4 times the total amount assessed to the utility
3838 under s. 196.85 (1) and (2) unless the object of the expenditure has been ordered by
3939 the commission. The commission, by rule, shall establish procedures whereby a
4040 public utility may recover its expenditures under this subsection.
