12	12	AN ACT to create 16.312 and 20.505 (7) (d) of the statutes; relating to: grants
13	13	to provide legal services to tenants in eviction actions, granting rule-making
14	14	authority, and making an appropriation.

16	16	This bill requires the Department of Administration to establish a grant
17	17	program to provide funds to attorneys to provide legal services for low-income
18	18	tenants in eviction actions or in actions in which the tenant alleges he or she was
19	19	wrongfully evicted. Under the bill, the grant moneys may only be used to provide
20	20	legal services to a tenant whose family has an income at or below 200 percent of the
21	21	federal poverty line.
22	22	For further information see the state and local fiscal estimate, which will be
23	23	printed as an appendix to this bill.
24	24	The people of the state of Wisconsin, represented in senate and assembly, do
25	25	enact as follows:
26	26	SECTION 1. 16.312 of the statutes is created to read:
27	27	16.312 Grants to provide legal services for tenants in eviction actions.
28	28	(1) The department shall establish and administer a grant program to provide funds

37	37	to attorneys or law firms to provide legal services to tenants in eviction actions and
38	38	actions in which a tenant alleges that the tenant was excluded, forcibly evicted, or
39	39	constructively evicted from the tenant's dwelling unit other than by an eviction
40	40	procedure under ch. 799.
41	41	(2) (a) The department shall promulgate rules for awarding grants under sub.
42	42	(1).
43	43	(b) The rules promulgated under par. (a) shall require that the recipient of a
44	44	grant may provide the legal services under sub. (1) only to a tenant whose family
45	45	income is at or below 200 percent of the federal poverty line, as defined under 42 USC
46	46	9902 (2), for a family the size of the tenant's family.
47	47	SECTION 2. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
48	48	the following amounts for the purposes indicated:

54	54	SECTION 3. 20.505 (7) (d) of the statutes is created to read:
55	55	20.505 (7) (d) Legal services for tenants in eviction actions. The amounts in the
56	56	schedule to provide grants for providing legal services under s. 16.312.
57	57	SECTION 4.0Effective date.
58	58	(1) This act takes effect on the day after publication or on the 2nd day after
59	59	publication of the 2023 biennial budget act, whichever is later.
