1212 AN ACT to create 704.07 (6) of the statutes; relating to: rent abatement for
1313 tenants and granting rule-making authority.

1515 Under current law, generally, if a leased property is damaged or has a condition
1616 that is hazardous to the health or safety of the tenant, the tenant is entitled to abate
1717 rent to the extent that the tenant is deprived of the full normal use of the leased
1818 property. This bill requires the Department of Agriculture, Trade and Consumer
1919 Protection to promulgate rules that specify items for which a tenant may be entitled
2020 to rent abatement and the amount of abatement a tenant would be entitled to for each
2121 item.

2424 The people of the state of Wisconsin, represented in senate and assembly, do
2525 enact as follows:
2626 SECTION 1. 704.07 (6) of the statutes is created to read:

3232 704.07 (6) RULES. The department of agriculture, trade and consumer
3333 protection shall promulgate rules that specify items for which a tenant is entitled to
3434 rent abatement under sub. (4) and the amount of rent abatement for each item.
