1212 AN ACT to create 49.45 (62) and 49.46 (2) (b) 24. of the statutes; relating to:
1313 reimbursement of services to find and sustain housing under the Medical
1414 Assistance program.

1616 This bill directs the Department of Health Services to request from the
1717 secretary of the federal Department of Health and Human Services any waiver of
1818 federal law, state plan amendment, or other federal approval necessary to allow DHS
1919 to reimburse certified providers for services to help recipients of Medical Assistance
2020 find and sustain housing. Under the bill, assistance to find and sustain housing may
2121 include, among other things, financing for utility deposits, payments, or arrears;
2222 payment of security deposits and first month's rent; onetime transition and moving
2323 costs; early detection and intervention for behaviors that may jeopardize housing,
2424 such as late rental payments and lease violations; and assistance with the housing
2525 recertification process. If the federal Department of Health and Human Services
2626 does not approve a waiver of federal law, state plan amendment, or other federal
2727 approval as provided in the bill, DHS is not allowed to reimburse certified providers
2828 for services to help recipients find and sustain housing under the bill. The Medical
2929 Assistance program is a joint federal and state program that provides health services
3030 to individuals who have limited financial resources.

3838 The people of the state of Wisconsin, represented in senate and assembly, do
3939 enact as follows:
4040 SECTION 1. 49.45 (62) of the statutes is created to read:
4141 49.45 (62) HOUSING ASSISTANCE. (a) The department shall request from the
4242 secretary of the federal department of health and human services any waiver of
4343 federal law, state plan amendment, or other federal approval necessary to permit the
4444 department to reimburse certified providers for services to help Medical Assistance
4545 recipients find and sustain housing under the Medical Assistance program under
4646 this subchapter. If a waiver of federal law, state plan amendment, or other federal
4747 approval under this paragraph is granted, the department shall reimburse certified
4848 providers for services to help Medical Assistance recipients find and sustain housing
4949 pursuant to this paragraph and state and federal law and regulations. Assistance
5050 to find and sustain housing may include any of the following services as permitted
5151 under this paragraph:
5252 1. Financing for utility deposits, payments, or arrears.
5353 2. Payment of security deposits and first month's rent.
5454 3. Onetime transition and moving costs.
5555 4. Short-term post hospitalization housing.
5656 5. Education and training on the role, rights, and responsibilities of a tenant
5757 and landlord.
5858 6. Early detection and intervention for behaviors that may jeopardize housing,
5959 such as late rental payments and lease violations.
6060 7. Assistance with the housing recertification process.

8686 8. Coordination with services and service providers for primary care, substance
8787 use disorder treatment, mental health providers, and vocational and employment

8989 (b) If the federal department of health and human services does not approve
9090 a waiver of federal law, state plan amendment, or other federal approval under par.
9191 (a), the department may not reimburse certified providers for services to help
9292 Medical Assistance recipients find and sustain housing under this subsection.
9393 SECTION 2. 49.46 (2) (b) 24. of the statutes is created to read:
9494 49.46 (2) (b) 24. Subject to s. 49.45 (62), assistance to find and sustain housing.
