12	12	AN ACT to create 49.45 (62) and 49.46 (2) (b) 24. of the statutes; relating to:
13	13	reimbursement of services to find and sustain housing under the Medical
14	14	Assistance program.

16	16	This bill directs the Department of Health Services to request from the
17	17	secretary of the federal Department of Health and Human Services any waiver of
18	18	federal law, state plan amendment, or other federal approval necessary to allow DHS
19	19	to reimburse certified providers for services to help recipients of Medical Assistance
20	20	find and sustain housing. Under the bill, assistance to find and sustain housing may
21	21	include, among other things, financing for utility deposits, payments, or arrears;
22	22	payment of security deposits and first month's rent; onetime transition and moving
23	23	costs; early detection and intervention for behaviors that may jeopardize housing,
24	24	such as late rental payments and lease violations; and assistance with the housing
25	25	recertification process. If the federal Department of Health and Human Services
26	26	does not approve a waiver of federal law, state plan amendment, or other federal
27	27	approval as provided in the bill, DHS is not allowed to reimburse certified providers
28	28	for services to help recipients find and sustain housing under the bill. The Medical
29	29	Assistance program is a joint federal and state program that provides health services
30	30	to individuals who have limited financial resources.

38	38	The people of the state of Wisconsin, represented in senate and assembly, do
39	39	enact as follows:
40	40	SECTION 1. 49.45 (62) of the statutes is created to read:
41	41	49.45 (62) HOUSING ASSISTANCE. (a) The department shall request from the
42	42	secretary of the federal department of health and human services any waiver of
43	43	federal law, state plan amendment, or other federal approval necessary to permit the
44	44	department to reimburse certified providers for services to help Medical Assistance
45	45	recipients find and sustain housing under the Medical Assistance program under
46	46	this subchapter. If a waiver of federal law, state plan amendment, or other federal
47	47	approval under this paragraph is granted, the department shall reimburse certified
48	48	providers for services to help Medical Assistance recipients find and sustain housing
49	49	pursuant to this paragraph and state and federal law and regulations. Assistance
50	50	to find and sustain housing may include any of the following services as permitted
51	51	under this paragraph:
52	52	1. Financing for utility deposits, payments, or arrears.
53	53	2. Payment of security deposits and first month's rent.
54	54	3. Onetime transition and moving costs.
55	55	4. Short-term post hospitalization housing.
56	56	5. Education and training on the role, rights, and responsibilities of a tenant
57	57	and landlord.
58	58	6. Early detection and intervention for behaviors that may jeopardize housing,
59	59	such as late rental payments and lease violations.
60	60	7. Assistance with the housing recertification process.

86	86	8. Coordination with services and service providers for primary care, substance
87	87	use disorder treatment, mental health providers, and vocational and employment
88	88	support.
89	89	(b) If the federal department of health and human services does not approve
90	90	a waiver of federal law, state plan amendment, or other federal approval under par.
91	91	(a), the department may not reimburse certified providers for services to help
92	92	Medical Assistance recipients find and sustain housing under this subsection.
93	93	SECTION 2. 49.46 (2) (b) 24. of the statutes is created to read:
94	94	49.46 (2) (b) 24. Subject to s. 49.45 (62), assistance to find and sustain housing.
