| 15 | 15 | | production agriculture or the exploration, production, use, transport, sale, or |
|---|
| 16 | 16 | | manufacture of fossil fuel–based energy. |
|---|
| 17 | 17 | | 2. Consider social and governance criteria; diversity, equity, and inclusion |
|---|
| 18 | 18 | | policies; or political and ideological factors. |
|---|
| 19 | 19 | | The bill does not apply to the State of Wisconsin Investment Board or any assets |
|---|
| 20 | 20 | | under its management. |

| 21 | 21 | | The people of the state of Wisconsin, represented in senate and assembly, do |

| 22 | 22 | | enact as follows: |

| 23 | 23 | | SECTION 1. 20.933 of the statutes is created to read: |

| 24 | 24 | | 20.933 Prohibited considerations in awarding financial assistance. (1) |

| 25 | 25 | | DEFINITIONS. In this section: |

| 26 | 26 | | (a) “Covered activity” means any of the following: |

| 38 | 38 | | (b) “Local governmental unit” has the meaning given in s. 66.0135 (1) (c). |

| 39 | 39 | | (c) “Prohibited basis” means any of the following: |

|---|
| 41 | 41 | | 2. Diversity, equity, and inclusion policies. |

|---|
| 43 | 43 | | (2) PROHIBITION. (a) Except as expressly provided by statute, no state agency |
|---|
| 44 | 44 | | or local governmental unit may do any of the following in awarding a grant or loan |
|---|
| 45 | 45 | | or other financial assistance to any person: |
|---|
| 46 | 46 | | 1. Discriminate against the person on the basis of the person's participation in |
|---|
| 47 | 47 | | a covered activity. |
|---|
| 48 | 48 | | 2. Consider a prohibited basis. |
|---|
| 49 | 49 | | (b) Paragraph (a) does not apply to the investment board or any assets under |
|---|
| 50 | 50 | | its management. |
