10	10	AN ACT to create 20.410 (1) (bp) and 302.092 of the statutes; relating to:
11	11	technology service access by inmates of state correctional institutions and
12	12	county jails and houses of correction and making an appropriation.

14	14	This bill provides that inmates of a state correctional institution or county jail
15	15	or house of correction be allowed access to email, live audiovisual calling services,
16	16	and electronic media services if they have a personal computing device. Under the
17	17	bill, the Department of Corrections or the sheriff or person in charge of a county jail
18	18	or house of correction may charge the inmate for the services, but the charge to the
19	19	inmate may not exceed the cost charged to DOC or the county by the service provider
20	20	for such services, and each inmate must be provided a weekly stipend of $17.50 to
21	21	purchase such services.
22	22	This bill provides to DOC $13,213,800 in the 2023-24 fiscal year and
23	23	$19,820,700 in the 2024-25 fiscal year to pay for DOC inmate technology access
24	24	stipends and $3,033,300 in the 2023-24 fiscal year and $4,550,000 in the 2024-25
25	25	fiscal year to reimburse counties for county jail or house of correction inmate
26	26	technology access stipends.
27	27	For further information see the state and local fiscal estimate, which will be
28	28	printed as an appendix to this bill.
29	29	The people of the state of Wisconsin, represented in senate and assembly, do
30	30	enact as follows:

36	36	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
37	37	the following amounts for the purposes indicated:

44	44	SECTION 2. 20.410 (1) (bp) of the statutes is created to read:
45	45	20.410 (1) (bp) Reimbursement of counties for inmate technology access
46	46	stipends. The amounts in the schedule for payments to counties under s. 302.092 (2)
47	47	(d) for county jail or house of correction inmate technology access stipends.
48	48	SECTION 3. 302.092 of the statutes is created to read:
49	49	302.092 Technology service access by inmates of state correctional
50	50	institutions and county jails or houses of correction. (1) (a) The department
51	51	shall ensure that each inmate of a state correctional institution is allowed to access
52	52	email, live audiovisual calling services, and electronic media services if the inmate
53	53	has a personal computing device.
54	54	(b) The department may impose a charge for accessing email, live audiovisual
55	55	calling services, and electronic media services under par. (a), but the department
56	56	may not charge an inmate more than the cost charged to the department by the
57	57	service provider for such services.

83	83	(c) The department shall provide to each inmate in a state correctional
84	84	institution a weekly technology access stipend of $17.50 to purchase services under
85	85	par. (a).
86	86	(2) (a) The sheriff or person in charge of a county jail or house of correction shall
87	87	ensure that each inmate of the county jail or house of correction is allowed to access
88	88	email, live audiovisual calling services, and electronic media services if the inmate
89	89	has a personal computing device.
90	90	(b) The sheriff or person in charge of a county jail or house of correction may
91	91	impose a charge for accessing email, live audiovisual calling services, and electronic
92	92	media services under par. (a), but the sheriff or person in charge of the county jail or
93	93	house of correction may not charge an inmate more than the cost charged to the
94	94	county by the service provider for such services.
95	95	(c) The sheriff or person in charge of a county jail or house of correction shall
96	96	ensure that each inmate in the county jail or house of correction is provided a weekly
97	97	technology access stipend of $17.50 to purchase services under par. (a).
98	98	(d) Annually, a county board may apply to the department for reimbursement
99	99	of its costs for inmate technology access stipends under par. (c) for inmates in the
100	100	county jail or house of correction. After verification by the department, the
101	101	department shall reimburse the county its actual costs for such technology access
102	102	stipends from the appropriation under s. 20.410 (1) (bp). If the amounts provided
103	103	under s. 20.410 (1) (bp) for any fiscal year are insufficient to provide complete
104	104	reimbursement under this paragraph, the department shall establish a system to
105	105	prorate the reimbursements.

133	133	(1) INMATE TECHNOLOGY SERVICES. In the schedule under s. 20.005 (3) for the
134	134	appropriation to the department of corrections under s. 20.410 (1) (a), the dollar
135	135	amount for fiscal year 2023-24 is increased by $13,213,800 to pay for the cost of
136	136	inmate technology access stipends under s. 302.092 (1) (c). In the schedule under s.
137	137	20.005 (3) for the appropriation to the department of corrections under s. 20.410 (1)
138	138	(a), the dollar amount for fiscal year 2024-25 is increased by $19,820,700 to pay for
139	139	the cost of inmate technology access stipends under s. 302.092 (1) (c).
