1010 AN ACT to create 118.60 (3) (am) and 119.23 (3) (am) of the statutes; relating
1111 to: pupil applications to attend a private school participating in a parental
1212 choice program.

1414 This bill allows a private school participating in the Milwaukee Parental Choice
1515 Program, Racine Parental Choice Program, or the Wisconsin Parental Choice
1616 Program (parental choice program) to allow parents and guardians of pupils
1717 participating in a parental choice program to opt to use an automatic application
1818 process to attend the private school under the parental choice program in subsequent
1919 school years. If a parent or guardian opts to use an automatic application process
2020 offered by a private school, the parent or guardian is considered to have annually
2121 submitted an application to the private school for the pupil to attend the private
2222 school under the parental choice program, as required by law, until 1) the parent or
2323 guardian submits a notice to the private school to stop the automatic application
2424 process or 2) the pupil is enrolled in the highest grade offered by the private school.
2525 If the pupil is participating in the WPCP, an application submitted through an
2626 automatic application process is considered to be accepted by the private school
2727 during the WPCP application period.
2828 Under current law, a private school participating in the WPCP is allowed to
2929 accept applications for the following school year between the first weekday in
3030 February and the third Thursday in April from pupils. Current law requires private
3131 schools participating in the WPCP to report the number of pupils who apply during

3737 this application period to the Department of Public Instruction for DPI to determine
3838 whether accepted applications exceed school district pupil participation limits, and
3939 if necessary, implement the school district participation limits.
4040 The people of the state of Wisconsin, represented in senate and assembly, do
4141 enact as follows:
4242 SECTION 1. 118.60 (3) (am) of the statutes is created to read:
4343 118.60 (3) (am) A private school participating in a program under this section
4444 may allow the parent or guardian of a pupil attending the private school under this
4545 section to use an automatic application process under which the pupil is considered
4646 to have annually applied to attend the private school under this section until the
4747 pupil's parent or guardian submits a notice to the private school indicating that the
4848 pupil will not attend the private school under this section in the following school year
4949 or until the pupil is enrolled in the highest grade offered by the private school. If a
5050 parent or guardian opts to use an automatic application process under this
5151 paragraph, the parent or guardian is considered to have submitted an application
5252 under par. (a) for each school year to which the automatic application process applies.
5353 For pupils who reside in a school district, other than an eligible school district or a
5454 1st class city school district, applications submitted through an automatic
5555 application process are considered accepted by the private school within the
5656 application period under par. (ar) 1.
5757 SECTION 2. 119.23 (3) (am) of the statutes is created to read:
5858 119.23 (3) (am) A private school participating in a program under this section
5959 may allow the parent or guardian of a pupil attending the private school under this
6060 section to use an automatic application process under which the pupil is considered
6161 to have annually applied to attend the private school under this section until the

8686 pupil's parent or guardian submits a notice to the private school indicating that the
8787 pupil will not attend the private school under this section in the following school year
8888 or until the pupil is enrolled in the highest grade offered by the private school. If a
8989 parent or guardian opts to use an automatic application process under this
9090 paragraph, the parent or guardian is considered to have submitted an application
9191 under par. (a) for each school year to which the automatic application process applies.
