10	10	AN ACT to create 118.60 (3) (am) and 119.23 (3) (am) of the statutes; relating
11	11	to: pupil applications to attend a private school participating in a parental
12	12	choice program.

14	14	This bill allows a private school participating in the Milwaukee Parental Choice
15	15	Program, Racine Parental Choice Program, or the Wisconsin Parental Choice
16	16	Program (parental choice program) to allow parents and guardians of pupils
17	17	participating in a parental choice program to opt to use an automatic application
18	18	process to attend the private school under the parental choice program in subsequent
19	19	school years. If a parent or guardian opts to use an automatic application process
20	20	offered by a private school, the parent or guardian is considered to have annually
21	21	submitted an application to the private school for the pupil to attend the private
22	22	school under the parental choice program, as required by law, until 1) the parent or
23	23	guardian submits a notice to the private school to stop the automatic application
24	24	process or 2) the pupil is enrolled in the highest grade offered by the private school.
25	25	If the pupil is participating in the WPCP, an application submitted through an
26	26	automatic application process is considered to be accepted by the private school
27	27	during the WPCP application period.
28	28	Under current law, a private school participating in the WPCP is allowed to
29	29	accept applications for the following school year between the first weekday in
30	30	February and the third Thursday in April from pupils. Current law requires private
31	31	schools participating in the WPCP to report the number of pupils who apply during

37	37	this application period to the Department of Public Instruction for DPI to determine
38	38	whether accepted applications exceed school district pupil participation limits, and
39	39	if necessary, implement the school district participation limits.
40	40	The people of the state of Wisconsin, represented in senate and assembly, do
41	41	enact as follows:
42	42	SECTION 1. 118.60 (3) (am) of the statutes is created to read:
43	43	118.60 (3) (am) A private school participating in a program under this section
44	44	may allow the parent or guardian of a pupil attending the private school under this
45	45	section to use an automatic application process under which the pupil is considered
46	46	to have annually applied to attend the private school under this section until the
47	47	pupil's parent or guardian submits a notice to the private school indicating that the
48	48	pupil will not attend the private school under this section in the following school year
49	49	or until the pupil is enrolled in the highest grade offered by the private school. If a
50	50	parent or guardian opts to use an automatic application process under this
51	51	paragraph, the parent or guardian is considered to have submitted an application
52	52	under par. (a) for each school year to which the automatic application process applies.
53	53	For pupils who reside in a school district, other than an eligible school district or a
54	54	1st class city school district, applications submitted through an automatic
55	55	application process are considered accepted by the private school within the
56	56	application period under par. (ar) 1.
57	57	SECTION 2. 119.23 (3) (am) of the statutes is created to read:
58	58	119.23 (3) (am) A private school participating in a program under this section
59	59	may allow the parent or guardian of a pupil attending the private school under this
60	60	section to use an automatic application process under which the pupil is considered
61	61	to have annually applied to attend the private school under this section until the
