1212 AN ACT to create 302.074 of the statutes; relating to: free feminine hygiene
1313 products for inmates of state correctional institutions or county jails or houses

1616 This bill requires the Department of Corrections to ensure that each state
1717 correctional institution has a commissary that provides all of the following feminine
1818 hygiene products free of charge to any inmate with an active menstrual cycle: at least
1919 three brands of tampons, with at least one brand having a plastic applicator, in
2020 appropriate absorbencies for varying levels of menstrual flow; at least three brands
2121 of menstrual pads in appropriate absorbencies for varying levels of menstrual flow;
2222 and at least one brand of reusable menstrual cup. The department must also ensure
2323 that the state correctional institution has the means to sanitize inmate menstrual
2424 cups on an as-needed basis.
2525 The bill requires the sheriff to ensure that each county jail or house of correction
2626 has a commissary that provides all of the following feminine hygiene products free
2727 of charge to any inmate with an active menstrual cycle: at least three brands of
2828 tampons, with at least one brand having a plastic applicator, in appropriate
2929 absorbencies for varying levels of menstrual flow; at least three brands of menstrual
3030 pads in appropriate absorbencies for varying levels of menstrual flow; and at least
3131 one brand of reusable menstrual cup. The sheriff must also ensure that the county
3232 jail or house of correction has the means to sanitize inmate menstrual cups on an
3333 as-needed basis.

4141 The people of the state of Wisconsin, represented in senate and assembly, do
4242 enact as follows:
4343 SECTION 1. 302.074 of the statutes is created to read:
4444 302.074 Feminine hygiene products for inmates of state correctional
4545 institutions and county jails. (1) (a) The department shall ensure that each state
4646 correctional institution has a commissary that provides all of the following feminine
4747 hygiene products free of charge to any inmate with an active menstrual cycle:
4848 1. At least 3 brands of tampons, with at least one brand having a plastic
4949 applicator, in appropriate absorbencies for varying levels of menstrual flow.
5050 2. At least 3 brands of menstrual pads, in appropriate absorbencies for varying
5151 levels of menstrual flow.
5252 3. At least one brand of reusable menstrual cup.
5353 (b) The department shall ensure that each state correctional institution has the
5454 means to sanitize inmate menstrual cups on an as-needed basis.
5555 (2) (a) The sheriff shall ensure that each county jail or house of correction has
5656 a commissary that provides all of the following feminine hygiene products free of
