11	11	AN ACT to create 302.073 and 302.074 of the statutes; relating to: personal
12	12	hygiene products for inmates of state correctional institutions and county jails
13	13	and houses of correction and making an appropriation.

15	15	This bill requires the Department of Corrections to provide all of the following
16	16	personal hygiene products in each state correctional institution commissary:
17	17	1. At no more than 125 percent of the sales price of the product at the
18	18	highest-grossing retail chain in the state, at least two varieties of the following
19	19	personal hygiene products: deodorant, antiperspirant, shampoo, hair conditioner,
20	20	liquid body wash, bar soap, body lotion, face wash, facial lotion, toothpaste,
21	21	toothbrush, dental floss, razor, shaving cream, sunscreen, comb, hairbrush, and
22	22	cleansing wipes.
23	23	2. At no more than 100 percent of the sales price of the product at the
24	24	highest-grossing retail chain in the state, at least two varieties of the following
25	25	culturally sensitive personal hygiene products: shampoo, conditioner, natural hair
26	26	oil, and shaving cream that are appropriate for types 2, 3, and 4 hair, bar soap, and
27	27	cocoa-butter-based body lotion.
28	28	The bill also requires DOC to provide each inmate with a monthly personal
29	29	hygiene stipend of $25 to purchase personal hygiene products from the commissary.
30	30	The bill provides $6,450,000 to DOC in each year of the 2023-25 biennium to provide
31	31	personal hygiene stipends.
32	32	The bill also requires sheriffs to provide the same personal hygiene products in
33	33	the commissaries of county jails and houses of correction at the prices established by

39	39	DOC for those products in state correctional institutions and requires sheriffs to
40	40	provide each inmate with a monthly personal hygiene stipend of $25 to purchase
41	41	personal hygiene products from the commissary.

43	43	printed as an appendix to this bill.
44	44	The people of the state of Wisconsin, represented in senate and assembly, do
45	45	enact as follows:
46	46	SECTION 1. 302.073 of the statutes is created to read:
47	47	302.073 State correctional institution inmate personal hygiene
48	48	products. (1) In this section:
49	49	(a) “Benchmark retailer” means the retail chain in this state that has at least
50	50	one physical store in the state and has the highest annual gross receipts of any retail
51	51	chain in the state.
52	52	(b) “Sales price” has the meaning given in s. 77.51 (15b).
53	53	(2) The department shall ensure that each state correctional institution has
54	54	a commissary that provides all of the following personal hygiene products for
55	55	acquisition by inmates:
56	56	(a) To be sold at all state correctional facilities for no more than 125 percent of
57	57	the sales price of the same product at the benchmark retailer, at least 2 varieties of
58	58	all of the following products:
59	59	1. Deodorant.
60	60	2. Antiperspirant.
61	61	3. Shampoo.
62	62	4. Hair conditioner.

141	141	products. (1) The sheriff shall ensure that each county jail or house of correction
142	142	has a commissary that provides all of the following personal hygiene products for
143	143	acquisition by inmates:
144	144	(a) To be sold for no more than the price set for the same product under s.

204	204	SECTION 3.0Fiscal changes.
205	205	(1) PERSONAL HYGIENE STIPENDS. In the schedule under s. 20.005 (3) for the
206	206	appropriation to the department of corrections under s. 20.410 (1) (a), the dollar
207	207	amount for fiscal year 2023-24 is increased by $6,450,000 to provide personal
208	208	hygiene stipends under s. 302.073 (3). In the schedule under s. 20.005 (3) for the
209	209	appropriation to the department of corrections under s. 20.410 (1) (a), the dollar
210	210	amount for fiscal year 2024-25 is increased by $6,450,000 to provide personal
211	211	hygiene stipends under s. 302.073 (3).
