48 | 48 | | provides, instead, that an aboveground storage tank that is used to contain a liquid |

49 | 49 | | that is flammable or combustible or that is a hazardous substance is exempt from |

50 | 50 | | regulation by DATCP if 1) it has a capacity of less than 110 gallons; 2) it has a capacity |
---|
51 | 51 | | of less that 1,100 gallons and is installed at a fleet vehicle motor fuel dispensing |
---|
52 | 52 | | facility or is used to store certain types of liquids; 3) is a portable tank; or 4) is an |
---|
53 | 53 | | asphalt plant tank. |
---|
54 | 54 | | 3. Requires DATCP to maintain an inventory of storage tanks used to contain |
---|
55 | 55 | | regulated products. The bill requires the inventory to include every aboveground |
---|
56 | 56 | | storage tank with a capacity of at least 110 gallons and every underground storage |
---|
57 | 57 | | tank with a capacity of at least 60 gallons. The bill defines a “regulated product” as |
---|
58 | 58 | | a liquid that is a substance derived from petroleum, natural gas, or asphalt deposits |
---|
59 | 59 | | or a liquid that is a federally regulated hazardous substance or regulated by certain |
---|
60 | 60 | | other federal regulations. Current law requires DATCP to maintain an inventory of |
---|
61 | 61 | | every aboveground and underground storage tank that is used to contain a |
---|
62 | 62 | | petroleum product and that has a capacity of at least 60 gallons. |
---|
63 | 63 | | 4. Authorizes DATCP to promulgate rules to require the certification or |
---|
64 | 64 | | registration of persons who design, install, test, or maintain corrosion prevention |
---|
65 | 65 | | systems on storage tanks used to contain flammable or combustible liquids or |
---|
66 | 66 | | hazardous substances. |
---|
67 | 67 | | 5. Authorizes DATCP to establish fees by rule for fuel quality inspections and |
---|
68 | 68 | | investigations. |

69 | 69 | | 6. Requires the Department of Justice or proper district attorney, upon |

70 | 70 | | DATCP's request, to prosecute actions to enforce the storage tank statutes and rules. |

196 | 196 | | skids, mountings, or accessories to facilitate handling of the tank by mechanical |

197 | 197 | | means, that is not intended for use as a fixed installation, and that is located on a |

198 | 198 | | property for not more than 24 consecutive months. “Portable tank” includes all of the |

305 | 305 | | provide substantially similar protection for the waters of the state. The rule shall |

306 | 306 | | include maintenance requirements related to the detection and prevention of leaks. |
---|
307 | 307 | | (1r) The rule promulgated under sub. (1) may require any person supplying |
---|
308 | 308 | | heating oil to any noncommercial storage tank for consumptive use on the premises |
---|
309 | 309 | | to submit to the department, within 30 days after the department requests, the |
---|
310 | 310 | | location, contents, and size of any such tank. |
---|
311 | 311 | | SECTION 18. 168.23 (1g) of the statutes is created to read: |
