1717 Analysis by the Legislative Reference Bureau
1818 This bill makes changes involving the Department of Agriculture, Trade and
1919 Consumer Protection's regulation of petroleum products and the storage of
2020 dangerous substances.  Under current law, DATCP regulates and promulgates rules
2121 addressing the installation, maintenance, and abandonment of storage tanks that
2222 contain flammable or combustible liquids or federally regulated hazardous
2323 substances.  Current law also authorizes DATCP to make inspections and conduct
2424 investigations involving petroleum products.
2525 The bill does the following involving petroleum products and storage of
2626 dangerous substances:

3737 1.  Changes the definition of “combustible liquid,” thereby changing which
3838 substances are subject to DATCP regulation.  Current law defines “combustible
3939 liquid” as a liquid having a flash point at or above 100 degrees Fahrenheit and below
4040 200 degrees Fahrenheit.  Under the bill, “combustible liquid” is defined as a liquid
4141 having a flash point at or above 100 degrees Fahrenheit and below 200 degrees
4242 Fahrenheit when stored in a tank that is installed above ground level or, for liquids
4343 stored in an underground storage tank, having a flash point at or above 100 degrees
4444 Fahrenheit.
4545 2.  Changes a current law exemption for certain aboveground storage tanks
4646 from regulation by DATCP.  Current law exempts aboveground storage tanks that
4747 have a capacity of less than 5,000 gallons from regulation by DATCP.  The bill
4848 provides, instead, that an aboveground storage tank that is used to contain a liquid
4949 that is flammable or combustible or that is a hazardous substance is exempt from
5050 regulation by DATCP if 1) it has a capacity of less than 110 gallons; 2) it has a capacity
5151 of less that 1,100 gallons and is installed at a fleet vehicle motor fuel dispensing
5252 facility or is used to store certain types of liquids; 3) is a portable tank; or 4) is an
5353 asphalt plant tank.
5454 3.  Requires DATCP to maintain an inventory of storage tanks used to contain
5555 regulated products.  The bill requires the inventory to include every aboveground
5656 storage tank with a capacity of at least 110 gallons and every underground storage
5757 tank with a capacity of at least 60 gallons.  The bill defines a “regulated product” as
5858 a liquid that is a substance derived from petroleum, natural gas, or asphalt deposits
5959 or a liquid that is a federally regulated hazardous substance or regulated by certain
6060 other federal regulations.  Current law requires DATCP to maintain an inventory of
6161 every aboveground and underground storage tank that is used to contain a
6262 petroleum product and that has a capacity of at least 60 gallons.
6363 4.  Authorizes DATCP to promulgate rules to require the certification or
6464 registration of persons who design, install, test, or maintain corrosion prevention
6565 systems on storage tanks used to contain flammable or combustible liquids or
6666 hazardous substances.
6767 5.  Authorizes DATCP to establish fees by rule for fuel quality inspections and
6868 investigations.
6969 6.  Requires the Department of Justice or proper district attorney, upon
7070 DATCP's request, to prosecute actions to enforce the storage tank statutes and rules.
7171 7.  Authorizes DATCP to promulgate fire safety rules for the storage and
7272 handling of flammable or combustible liquids or hazardous substances.
7373 8.  Authorizes DATCP to contract with persons for services to administer or
7474 implement storage tank requirements.

8383 SECTION 1. 168.06 (4) of the statutes is created to read:
8484 168.06 (4)  The department may by rule set fees for department costs incurred
8585 in performing miscellaneous fuel quality inspections or investigations authorized
8686 under this subchapter.
8787 SECTION 2. 168.125 of the statutes is amended to read:
8888 168.125  Reports; payment.  Persons who are liable for the fee under this
8989 subchapter s. 168.12 shall state the number of gallons of petroleum products on
9090 which the fee is due and the amount of their liability for the fee in the reports under
9191 s. 78.12 (1) to (3).  The requirements for payment of the motor vehicle fuel tax under
9292 s. 78.12 (5) apply to the fee under this subchapter s. 168.12.
9393 SECTION 3. 168.21 (1) of the statutes is renumbered 168.21 (1r) and amended
9494 to read:
9595 168.21 (1r)  “Combustible liquid" means a liquid having a flash point at or above
9696 100 degrees fahrenheit Fahrenheit and below 200 degrees fahrenheit Fahrenheit
9797 when stored in a tank that is installed above ground level or a liquid having a flash
9898 point at or above 100 degrees Fahrenheit when stored in an underground storage

100100 SECTION 4. 168.21 (1g) of the statutes is created to read:
101101 168.21 (1g)  “Asphalt plant tank" means a tank that is used as a burner tank
102102 or a material supply tank in the process of producing asphalt if all of the following
103103 apply:
104104 (a)  The products stored in the tank are asphalt cements or Class II or Class III
105105 liquids as defined under national fire protection association standard NFPA 30,
106106 including heating oil, used oil, or a number 4 or number 5 heavy oil that conforms
107107 with ASTM International specifications.

135135 (b)  The tank configuration is single-walled or double-walled, regardless of
136136 whether the configuration includes heating coils.
137137 (c)  The tank and related asphalt process equipment are located on a property
138138 for no more than 24 consecutive months, regardless of whether the property is owned
139139 by the tank owner and regardless of whether the tank owner or other persons
140140 undertake commercial or industrial activities on the property in addition to the
141141 production of asphalt, including the operation of a quarry.
142142 SECTION 5. 168.21 (2m) of the statutes is created to read:
143143 168.21 (2m)  “Farm tank” means an aboveground tank system installed on a
144144 farm premises, as defined in s. 102.04 (3), that is less than 5,000 gallons in capacity.
145145 SECTION 6. 168.21 (4) of the statutes is amended to read:
146146 168.21 (4)  “Flammable liquid" means a liquid having a flash point below 100
147147 degrees fahrenheit Fahrenheit.
148148 SECTION 7. 168.21 (5) of the statutes is amended to read:
149149 168.21 (5)  “Flash point" means the minimum temperature at which a
150150 flammable liquid or combustible liquid will give off sufficient flammable vapors to
151151 form an ignitable mixture with air near the surface of the liquid or within the vessel
152152 which contains the liquid.
153153 SECTION 8. 168.21 (5d), (5h), (5p) and (5t) of the statutes are created to read:
154154 168.21 (5d)  “Fleet vehicle motor fuel dispensing facility” means a motor fuel
155155 dispensing facility at a commercial, industrial, governmental, or manufacturing
156156 property where motor fuels are dispensed into the fuel tanks of motor vehicles that
157157 are used in connection with the business or operation of that property by persons
158158 employed by or contracted with the business or operation.

187187 (5h)  “Intermediate bulk container” means a container that is manufactured
188188 and marked in accordance with 49 CFR part 178, is intended for the storage of
189189 regulated substances within warehouses and other storage areas with automatic
190190 wet-pipe sprinkler systems, and has a liquid capacity of 793 gallons or less.
191191 (5p)  “Motor fuel dispensing facility” means a property or portion of a property
192192 where motor fuels are stored and dispensed from fixed equipment into the fuel tanks
193193 of motor vehicles or into approved containers, including all equipment used in
194194 connection with such storing and dispensing.
195195 (5t)  “Portable tank” means an aboveground closed vessel that is equipped with
196196 skids, mountings, or accessories to facilitate handling of the tank by mechanical
197197 means, that is not intended for use as a fixed installation, and that is located on a
198198 property for not more than 24 consecutive months.  “Portable tank” includes all of the
199199 following:
200200 (a)  An intermediate bulk container.
201201 (b)  A tank from which motor fuels are dispensed into the fuel tanks of motor
202202 vehicles that are used in connection with the business or operation of the tank owner
203203 by persons employed by or contracted with the business or operation.
204204 SECTION 9. 168.21 (6m) of the statutes is created to read:
205205 168.21 (6m)  “Tank system” means a tank and its associated piping and
206206 equipment.
207207 SECTION 10. 168.22 (title) of the statutes is amended to read:
208208 168.22  (title)  Storage tanks tank systems.

243243 168.22 (2)  This subchapter does not apply to storage tanks which tank systems
244244 that require a hazardous waste license under s. 291.25.
245245 SECTION 13. 168.22 (3) of the statutes is renumbered 168.22 (3) (intro.) and

247247 168.22 (3) (intro.)  This subchapter does not apply to storage tanks which tank
248248 systems that are installed above ground level and which are less than 5,000 gallons
249249 in capacity. that meet any of the following conditions:
250250 SECTION 14. 168.22 (3) (a), (b), (c) and (d) of the statutes are created to read:
251251 168.22 (3) (a)  The tank system is less than 110 gallons in capacity.
252252 (b)  The tank system is less than 1,100 gallons in capacity and is installed at a

258258 SECTION 15. 168.22 (4) (intro.) of the statutes is amended to read:
259259 168.22 (4) (intro.)  Any rules promulgated under s. 168.23 requiring an owner
260260 to test the ability of a storage tank, connected piping or ancillary equipment system
261261 to prevent an inadvertent release of a stored substance liquid do not apply to storage
262262 tanks tank systems that satisfy all of the following:

293293 168.22 (6)  Except for the reporting of information for the inventory described
294294 in s. 168.28 (2), this subchapter does not apply to farm tanks.
295295 SECTION 17. 168.23 (1) of the statutes is amended to read:
296296 168.23 (1)  The department shall promulgate by rule construction,
297297 maintenance, and abandonment standards applicable to tanks tank systems for the
298298 storage, handling, or use of liquids that are flammable or liquids, combustible
299299 liquids, or liquids that are federally regulated hazardous substances, and to the
300300 property and facilities where the tanks tank systems are located, for the purpose of
301301 protecting the waters of the state from harm due to contamination by liquids that are
302302 flammable or liquids, combustible liquids, or liquids that are federally regulated
303303 hazardous substances.  The rule shall comply with ch. 160.  The rule may include
304304 different standards for new and existing tanks tank systems, but all standards shall
305305 provide substantially similar protection for the waters of the state.  The rule shall
306306 include maintenance requirements related to the detection and prevention of leaks.
307307 (1r)  The rule promulgated under sub. (1) may require any person supplying
308308 heating oil to any noncommercial storage tank for consumptive use on the premises
309309 to submit to the department, within 30 days after the department requests, the
310310 location, contents, and size of any such tank.
311311 SECTION 18. 168.23 (1g) of the statutes is created to read:
312312 168.23 (1g)  The department may promulgate rules to provide fire and life
313313 safety by ensuring the safe storage, display, installation, operation, use,
314314 maintenance, and transportation of flammable liquids, combustible liquids, or
315315 liquids that are federally regulated hazardous substances and the equipment,
316316 facilities, buildings, and premises that are used to store, transfer, and dispense those
317317 liquids.

345345 SECTION 19. 168.23 (2) of the statutes is amended to read:
346346 168.23 (2)  The department may transfer any information which that the
347347 department receives under sub. (1) (1r) to any other agency or governmental unit.
348348 The department and any such agency shall treat the name of the owner and the
349349 location of any noncommercial storage tank which that stores heating oil for
350350 consumptive use on the premises, required to be submitted to the department under
351351 sub. (1) (1r), as confidential and shall not permit inspection or copying under s. 19.35
352352 of any record containing the information.
353353 SECTION 20. 168.23 (3) of the statutes is amended to read:
354354 168.23 (3)  The rule promulgated under sub. (1) may require the certification
355355 or registration of persons who install, remove, clean, line, perform tightness testing
356356 on and inspect tanks tank systems; persons who design, install, test, and maintain
357357 cathodic protection systems for tank systems; and persons who perform site
358358 assessments.  Any rule requiring certification or registration shall also authorize the
359359 revocation or suspension of the certification or registration.  The department may not
360360 require an individual who is eligible for the veterans fee waiver program under s.
361361 45.44 to pay any fee that may be charged pursuant to such a rule.
362362 SECTION 21. 168.23 (4) of the statutes is amended to read:
363363 168.23 (4)  The department shall promulgate a rule specifying fees for plan
364364 review and inspection of tanks tank systems for the storage, handling, or use of
365365 flammable or liquids, combustible liquids, or liquids that are federally regulated
366366 hazardous substances and for any certification or registration required under sub.
367367 (3).
368368 SECTION 22. 168.23 (5) (a) of the statutes is amended to read:

397397 168.23 (5) (a)  Subject to par. (b), in addition to any fee charged by the
398398 department by rule for plan review and approval for the construction of a new or
399399 additional installation or change in operation of a previously approved installation
400400 for the storage, handling, or use of a liquid that is flammable or liquid, combustible
401401 liquid, or liquid that is a federally regulated hazardous substance, as defined in s.
402402 168.21 (3), the department shall collect a groundwater fee of $100 for each plan
403403 review submittal.  The moneys collected under this subsection shall be credited to the
404404 environmental fund for environmental management.
405405 SECTION 23. 168.23 (5) (b) of the statutes is amended to read:
406406 168.23 (5) (b)  Notwithstanding par. (a), an installation for the storage,
407407 handling, or use of a liquid that is flammable or liquid, combustible liquid, or liquid
408408 that is a federally regulated hazardous substance, as defined in s. 168.21 (3), that has
409409 a capacity of less than 1,000 gallons is not subject to the groundwater fee under par.
410410 (a).
411411 SECTION 24. 168.25 (1m) of the statutes is created to read:
412412 168.25 (1m)  The department may contract with any person for services to
413413 administer or implement this subchapter.
414414 SECTION 25. 168.255 of the statutes is created to read:
415415 168.255  Attorney general and district attorney to prosecute.  Upon
416416 request of the department, the attorney general or proper district attorney shall
417417 prosecute any action to enforce this subchapter.
418418 SECTION 26. 168.28 (title) of the statutes is amended to read:
419419 168.28  (title)  Inventory of petroleum product storage tanks for certain

458458 SECTION 30. 168.28 (1) (b) of the statutes is amended to read:
459459 168.28 (1) (b)  “Storage tank" means an enclosed container with a capacity in
460460 excess of 60 gallons which that is used to hold a petroleum regulated product,
461461 regardless of the duration of storage and which that is intended for use as a fixed,
462462 rather than as a portable, installation.
463463 SECTION 31. 168.28 (2) of the statutes is amended to read:
464464 168.28 (2)  INVENTORY OF STORAGE TANKS.  The department shall undertake a
465465 program to inventory and determine the location of every aboveground storage tanks
466466 tank with a capacity of 110 gallons or more and every underground storage tanks
467467 tank with a capacity of 60 gallons or more.  The department may require its deputies
468468 and any person engaged in the business of distributing petroleum regulated products
469469 to provide information on the location of aboveground storage tanks and
