1010 AN ACT to create 302.073 of the statutes; relating to: inmate access to the
1111 outdoors.

1313 This bill requires the Department of Corrections and county sheriffs to provide
1414 every inmate being held in a state correctional institution or county house of
1515 correction with three hours per week of outdoor time, unless the inmate is being held
1616 in the Milwaukee secure detention facility, in which case the three-hour per week
1717 requirement does not apply until the inmate's 91st day of holding at that institution.

2020 The people of the state of Wisconsin, represented in senate and assembly, do
2121 enact as follows:
2222 SECTION 1. 302.073 of the statutes is created to read:
2323 302.073 Outdoor access by inmates of state correctional institutions or
2424 county houses of correction. (1) (a) Except as provided in par. (b), the warden
2525 or superintendent of a state correctional institution shall ensure that each inmate

3434 is permitted to access the outdoors for 3 hours per week unless the inmate is subject
3535 to a prison lockdown or is being held in solitary confinement.
3636 (b) The requirement under par. (a) does not apply to inmates being held in the
3737 state correctional institution under s. 302.01 (1) (i) until their 91st day of holding in
3838 that state correctional institution.
3939 (2) The county sheriff shall ensure that each inmate in a county house of
4040 correction is permitted to access the outdoors for 3 hours per week unless the inmate
4141 is subject to a jail lockdown or is being held in solitary confinement.
4242 SECTION 2.0Initial applicability.
4343 (1) MILWAUKEE SECURE DETENTION FACILITY. The treatment of s. 302.073 (1) first
4444 applies to the state correctional institution under s. 302.01 (1) (i) on January 1, 2026.
