12	12	AN ACT to amend 119.04 (1); and to create 20.255 (2) (dv) and 115.457 of the
13	13	statutes; relating to: an energy efficiency grant program for school districts,
14	14	granting rule-making authority, and making an appropriation.

16	16	This bill creates a $10,000,000 per year grant program under which the
17	17	Department of Public Instruction must award grants to school districts for energy
18	18	efficiency projects in school buildings. For the first two school years of the grant
19	19	program, DPI must give preference in awarding grants to projects that relate to
20	20	heating, ventilation, and air conditioning systems. DPI may promulgate rules to
21	21	implement the grant program.
22	22	For further information see the state and local fiscal estimate, which will be
23	23	printed as an appendix to this bill.
24	24	The people of the state of Wisconsin, represented in senate and assembly, do
25	25	enact as follows:
26	26	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
27	27	the following amounts for the purposes indicated:

39	39	SECTION 2. 20.255 (2) (dv) of the statutes is created to read:
40	40	20.255 (2) (dv) Energy efficiency projects; grants. The amounts in the schedule
41	41	for grants to school districts under s. 115.457.
42	42	SECTION 3. 115.457 of the statutes is created to read:
43	43	115.457 Energy efficiency projects; grants. (1) Beginning in the
44	44	2023-2024 school year, the department shall award grants to school districts for
45	45	energy efficiency projects in school buildings.
46	46	(2) In awarding grants under this section for the 2023-24 and 2024-25 school
47	47	years, the department shall give preference to projects that relate to heating,
48	48	ventilation, and air conditioning systems.
49	49	(3) The department may promulgate rules to implement this section.
50	50	SECTION 4. 119.04 (1) of the statutes is amended to read:

86	86	(5), and (15) to (27), 120.125, 120.13 (1), (2) (b) to (g), (3), (14), (17) to (19), (26), (34),
87	87	(35), (37), (37m), and (38), 120.137, 120.14, 120.20, 120.21 (3), and 120.25 are
88	88	applicable to a 1st class city school district and board but not, unless explicitly
89	89	provided in this chapter or in the terms of a contract, to the commissioner or to any
90	90	school transferred to an opportunity schools and partnership program.
91	91	SECTION 5.0Effective date.
92	92	(1) This act takes effect on the day after publication, or on the 2nd day after
93	93	publication of the 2023 biennial budget act, whichever is later.
