14 | 14 | | This bill prohibits a retailer who sold a lottery ticket, the administrator of the |
---|
15 | 15 | | state lottery, and the Department of Revenue, which administers the lottery, from |
---|
16 | 16 | | disclosing the name, address, or social security number of a lottery prize winner of |
---|
17 | 17 | | $1,000,000 or more for up to one year after the winner becomes entitled to the lottery |
---|
18 | 18 | | prize, if the winner requests confidentiality. The bill provides exceptions where |
---|
19 | 19 | | disclosure is allowed, including disclosures made to withhold taxes from the |
---|
20 | 20 | | winnings, to determine whether the winner is delinquent in tax payment or |
---|
21 | 21 | | court-ordered child support, to determine any withholding for child, spousal, or |
---|
22 | 22 | | family support, and to determine any withholding for unpaid court judgments. |

23 | 23 | | Additionally, the bill exempts from the right to inspection, copying, or receipt under |

24 | 24 | | public records law written records of a confidential winner's name, address, or social |

25 | 25 | | security number for up to one year after the winner becomes entitled to the lottery |

37 | 37 | | department to keep his or her identity confidential under s. 565.30 (6v) for up to one |

39 | 39 | | SECTION 2. 565.30 (6v) of the statutes is created to read: |

40 | 40 | | 565.30 (6v) PRIZE WINNER PRIVACY. (a) If a winner of a lottery prize or lottery |

41 | 41 | | share equal to or greater than $1,000,000 makes a request to the retailer, |
---|
42 | 42 | | administrator, or department for his or her identity as a winner to be treated as |
---|
43 | 43 | | confidential, the administrator, department, and retailer may not disclose the name, |
---|
44 | 44 | | address, or social security number of that winner for up to one year after the winner |
---|
45 | 45 | | becomes entitled to the lottery prize under sub. (1) except under any of the following |
---|
46 | 46 | | circumstances: |
---|
47 | 47 | | 1. The disclosure is made by the retailer, administrator, or department to an |
---|
48 | 48 | | employee or contractor of the department for the purpose of administering the state |
---|
49 | 49 | | lottery. |
---|
50 | 50 | | 2. The disclosure is made to a parent or guardian of a minor under sub. (2). |
---|
51 | 51 | | 3. The disclosure is made for the purpose of withholding income taxes under |
---|
52 | 52 | | sub. (4) or is made under sub. (5), (5m), or (5r). |
---|
53 | 53 | | 4. The disclosure is made in conjunction with a proceeding under sub. (6m) or |
---|
54 | 54 | | (6r). |
---|
55 | 55 | | (b) Written records containing the name, address, or social security number of |
---|
56 | 56 | | any winner of a lottery prize or lottery share equal to or greater than $1,000,000 who |
---|
57 | 57 | | has requested confidentiality under par. (a) are exempt from the right to inspection, |

58 | 58 | | copying, or receipt under s. 19.35 for up to one year after the winner becomes entitled |
