1111 AN ACT to create 565.27 (1) (g) and 565.30 (6v) of the statutes; relating to:
1212 privacy of lottery winner.
1313 Analysis by the Legislative Reference Bureau
1414 This bill prohibits a retailer who sold a lottery ticket, the administrator of the
1515 state lottery, and the Department of Revenue, which administers the lottery, from
1616 disclosing the name, address, or social security number of a lottery prize winner of
1717 $1,000,000 or more for up to one year after the winner becomes entitled to the lottery
1818 prize, if the winner requests confidentiality. The bill provides exceptions where
1919 disclosure is allowed, including disclosures made to withhold taxes from the
2020 winnings, to determine whether the winner is delinquent in tax payment or
2121 court-ordered child support, to determine any withholding for child, spousal, or
2222 family support, and to determine any withholding for unpaid court judgments.
2323 Additionally, the bill exempts from the right to inspection, copying, or receipt under
2424 public records law written records of a confidential winner's name, address, or social
2525 security number for up to one year after the winner becomes entitled to the lottery
2626 prize.
2727 The people of the state of Wisconsin, represented in senate and assembly, do
2828 enact as follows:
2929 SECTION 1. 565.27 (1) (g) of the statutes is created to read:

3535 565.27 (1) (g) The procedure for a winner of a lottery prize or lottery share equal
3636 to or greater than $1,000,000 to request a retailer, the administrator, or the
3737 department to keep his or her identity confidential under s. 565.30 (6v) for up to one
3838 year after the winner becomes entitled to the lottery prize under s. 565.30 (1).
3939 SECTION 2. 565.30 (6v) of the statutes is created to read:
4040 565.30 (6v) PRIZE WINNER PRIVACY. (a) If a winner of a lottery prize or lottery
4141 share equal to or greater than $1,000,000 makes a request to the retailer,
4242 administrator, or department for his or her identity as a winner to be treated as
4343 confidential, the administrator, department, and retailer may not disclose the name,
4444 address, or social security number of that winner for up to one year after the winner
4545 becomes entitled to the lottery prize under sub. (1) except under any of the following
4646 circumstances:
4747 1. The disclosure is made by the retailer, administrator, or department to an
4848 employee or contractor of the department for the purpose of administering the state
4949 lottery.
5050 2. The disclosure is made to a parent or guardian of a minor under sub. (2).
5151 3. The disclosure is made for the purpose of withholding income taxes under
5252 sub. (4) or is made under sub. (5), (5m), or (5r).
5353 4. The disclosure is made in conjunction with a proceeding under sub. (6m) or
5454 (6r).
5555 (b) Written records containing the name, address, or social security number of
5656 any winner of a lottery prize or lottery share equal to or greater than $1,000,000 who
5757 has requested confidentiality under par. (a) are exempt from the right to inspection,
5858 copying, or receipt under s. 19.35 for up to one year after the winner becomes entitled
5959 to the lottery prize under sub. (1).

8989 SECTION 3.0Initial applicability.
9090 (1) This act first applies to selections of winners of lottery prizes or lottery
9191 shares on the effective date of this subsection.
