4	4		AN ACT to renumber and amend 347.385 (1m) (b) and 347.385 (1m) (c); to amend 347.385 (title), 347.385 (2m),
5	5		347.385 (5) (a) and 347.385 (5) (b); and to create 347.385 (1m) (d), 347.385 (1m) (e), 347.385 (1m) (g), 347.385
6	6		(2r) and 347.385 (6) of the statutes; relating to: traffic control signal priority devices for snow removal vehicles.
7	7		The people of the state of Wisconsin, represented in
8	8		senate and assembly, do enact as follows:
9	9		SECTION 1. 347.385 (title) of the statutes is amended
10	10		to read:
11	11		347.385 (title) Auxiliary lamps on emergency
12	12		vehicles; traffic Traffic control signal emergency pre-
13	13		emption and priority devices.
14	14		SECTION 2. 347.385 (1m) (b) of the statutes is renum-
15	15		bered 347.385 (1m) (f) and amended to read:
16	16		347.385 (1m) (f) “Emergency Traffic control signal
17	17		preemption device” means a device, located on or within
18	18		a traffic control signal, that is designed to receive an elec-
19	19		tronic, radio, light, or sound transmission from an
20	20		approaching vehicle that alters the normal sequence of
21	21		the traffic control signal to provide or maintain a green
22	22		signal for the vehicle to proceed through the intersection.
23	23		SECTION 3. 347.385 (1m) (c) of the statutes is renum-
24	24		bered 347.385 (1m) (i) and amended to read:
25	25		347.385 (1m) (i) “Transmitter” means a device that
26	26		emits a signal for the purpose of activating an emergency
27	27		a traffic control signal preemption device or a traffic con-
28	28		trol signal priority device.
29	29		SECTION 4. 347.385 (1m) (d) of the statutes is created
30	30		to read:
31	31		347.385 (1m) (d) “Political subdivision” means a
32	32		county, city, village, or town.
33	33		SECTION 5. 347.385 (1m) (e) of the statutes is created
34	34		to read:
35	35		347.385 (1m) (e) “Snow removal vehicle” means
36	36		any vehicle equipped with a snowplow or anti−icing
37	37		equipment that is used by a political subdivision for snow
38	38		removal and is operated by a political subdivision or the
39	39		agent or lessee of a political subdivision.
40	40		SECTION 6. 347.385 (1m) (g) of the statutes is created
41	41		to read:
42	42		347.385 (1m) (g) “Traffic control signal priority
43	43		device” means a device, located on or within a traffic con-
44	44		trol signal, that is designed to receive an electronic, radio,
45	45		light, or sound transmission from an approaching vehicle
46	46		to request that a green signal be provided or maintained
47	47		for the vehicle to proceed through the intersection.
48	48		SECTION 7. 347.385 (2m) of the statutes is amended
49	49		to read:
50	50		347.385 (2m) An authorized emergency vehicle may
51	51		be equipped and operated with lamps designed and used,
52	52		or with any other transmitter designed and used, to acti-
53	53		vate emergency traffic control signal preemption
54	54		devices.
55	55		SECTION 8. 347.385 (2r) of the statutes is created to
56	56		read:
57	57		347.385 (2r) A snow removal vehicle equipped with
58	58		oscillating, rotating, or flashing lights that is actively

61	61		engaged in snow removal activities may be equipped and
62	62		operated with lamps designed and used, or with any other
63	63		transmitter designed and used, to activate traffic control
64	64		signal priority devices.
65	65		SECTION 9. 347.385 (5) (a) of the statutes is amended
66	66		to read:
67	67		347.385 (5) (a) No person may operate upon a high-
68	68		way a motor vehicle, other than an authorized emergency
69	69		vehicle or snow removal vehicle, that is equipped with a
70	70		transmitter or in which a transmitter is located. This sub-
71	71		section does not apply to a motor carrier or person in the
72	72		business of selling transmitters to authorized users who
73	73		transports a transmitter in original, unopened packaging
74	74		or in an inoperative condition in an enclosed storage
75	75		compartment of the vehicle.
76	76		SECTION 10. 347.385 (5) (b) of the statutes is
77	77		amended to read:
78	78		347.385 (5) (b) No person may sell a transmitter
79	79		except for use for authorized purposes as described in
80	80		sub. (2m) or (2r).
81	81		SECTION 11. 347.385 (6) of the statutes is created to
82	82		read:
83	83		347.385 (6) The authority responsible for mainte-
84	84		nance of a traffic control signal may establish procedures
85	85		for resolving conflicts between multiple requests for sig-
86	86		nal preemption or priority at a traffic signal, except that
87	87		a signal preemption request from an authorized emer-
88	88		gency vehicle must be given priority over any signal pri-
89	89		ority request.
