12	12	AN ACT to create 20.455 (5) (dm) and 165.925 of the statutes; relating to: a
13	13	human trafficking victim services grant program, granting rule-making
14	14	authority, and making an appropriation.

16	16	This bill establishes a grant program, administered by the Department of
17	17	Justice, that provides grants to nonprofit organizations to provide support services
18	18	to trafficking victims. The bill defines “support services” to mean any combination
19	19	of direct victim advocacy, safety planning, housing, substance use disorder
20	20	treatment, medical and behavioral health, job training, and employment support
21	21	services. Under the bill, to be eligible for a grant, a nonprofit organization must
22	22	submit an application that that describes the organization's efforts to coordinate
23	23	with local law enforcement agencies and includes a proposed plan for expenditure
24	24	of the grant moneys, and the nonprofit organization must provide private matching
25	25	funds that are equal to at least 50 percent of the grant amount. The bill provides
26	26	$2,500,000 biennially for such grants.

29	29	The people of the state of Wisconsin, represented in senate and assembly, do
30	30	enact as follows:

36	36	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
37	37	the following amounts for the purposes indicated:

43	43	SECTION 2. 20.455 (5) (dm) of the statutes is created to read:
44	44	20.455 (5) (dm) Trafficking victim services grant program. Biennially, the
45	45	amounts in the schedule to provide grants to nonprofit organizations under s.
46	46	165.925.
47	47	SECTION 3. 165.925 of the statutes is created to read:
48	48	165.925 Trafficking victim services grant program. (1) In this section:
49	49	(a) “Nonprofit organization" means an organization described in section 501 (c)
50	50	(3) of the Internal Revenue Code and that is exempt from federal income tax under
51	51	section 501 (a) of the Internal Revenue Code.
52	52	(b) “Support services” means any combination of direct victim advocacy, safety
53	53	planning, housing, substance use disorder treatment, medical and behavioral
54	54	health, job training, and employment support services.
55	55	(c) “Trafficking victim” means a person who was a victim of trafficking for the
56	56	purposes of a commercial sex act, as defined in s. 940.302 (1) (a), under s. 940.302 or
57	57	948.051 or under 22 USC 7101 to 7112.
58	58	(2) From the appropriation under s. 20.455 (5) (dm), the department of justice
59	59	shall award grants to nonprofit organizations to provide support services to

87	87	trafficking victims. To be eligible for a grant under this subsection, a nonprofit
88	88	organization shall do all of the following:
89	89	(a) Submit an application for a grant to the department of justice that describes
90	90	the organization's efforts to coordinate with local law enforcement agencies and
91	91	includes a proposed plan for expenditure of the grant moneys.
92	92	(b) Provide matching funds that are equal to at least 50 percent of the grant
93	93	amount awarded under this subsection and that come from private funding sources.
94	94	(3) The department of justice may award grants under sub. (2) in the following
95	95	amounts:
96	96	(a) To a nonprofit organization that provides among its services housing
97	97	services, up to $125,000 per fiscal biennium.
98	98	(b) To a nonprofit organization that provides only support services other than
99	99	housing services, up to $50,000 per fiscal biennium.
100	100	(4) (a) In awarding grants under sub. (2), the department of justice shall give
101	101	preference to grant applicants that have a well-established relationship with local
102	102	law enforcement agencies and to grant applicants that are capable of providing
103	103	licensed services with licensed in-house staff or under a contract with a 3rd-party
104	104	provider that oversees provision of licensed services.
105	105	(b) In awarding grants under sub. (2) to nonprofit organizations that provide
106	106	housing services, the department of justice shall give preference to grant applicants
107	107	that have the ability to provide services to the greatest number of trafficking victims.
108	108	(5) The department of justice shall promulgate rules for the administration of
109	109	this section and the distribution of grants under this section, including developing
110	110	additional criteria on which grant awards may be based.
