AN ACT to create 13.08 (5) and 13.123 (1) (d) of the statutes; relating to: per diem
and mileage allowances for legislators.
Analysis by the Legislative Reference Bureau
Under current law, representatives to the assembly and senators may receive
allowances for transportation expenses for travel to and from the state capitol once
every week during a legislative session, and per diem allowances for food and lodging
during a session of the legislature, but none is payable during a recess of the
legislature for 30 days or more unless approved by a joint resolution adopted by both
houses. The allowances are payable once per month.
This bill prohibits payment for these allowances during the period beginning
90 days after the enactment of a biennial budget act that contains any increase in
compensation for public employees and ending on the date the Joint Committee on
Employment Relations takes action on the increase.  Under the bill, the allowances
accrued during such a period are to be paid in a timely manner following action by
JCOER.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1.  13.08 (5) of the statutes is created to read:
13.08 (5) During the period beginning 90 days after the enactment of a biennial
budget act that contains an increase in compensation for any public employee and

ending on the date the joint committee on employment relations takes action on the
increase in compensation, eligible allowances under subs. (2) and (4) shall accrue but
may not be paid to a member of the legislature.  The eligible allowances accrued
under subs. (2) and (4) during the period specified in this subsection shall be paid in
a timely manner after the joint committee on employment relations takes action on
the increase in compensation.
SECTION 2.  13.123 (1) (d) of the statutes is created to read:
13.123 (1) (d) During the period beginning 90 days after the enactment of a
biennial budget act that contains an increase in compensation for any public
employee and ending on the date the joint committee on employment relations takes
action on the increase in compensation, allowances under pars. (a) to (c) shall accrue
but may not be paid to a member of the legislature.  The allowances accrued under
pars. (a) to (c) during the period specified in this paragraph shall be paid in a timely
manner after the joint committee on employment relations takes action on the
increase in compensation.
