1010 AN ACT to create 13.08 (5) and 13.123 (1) (d) of the statutes; relating to: per diem
1111 and mileage allowances for legislators.
1212 Analysis by the Legislative Reference Bureau
1313 Under current law, representatives to the assembly and senators may receive
1414 allowances for transportation expenses for travel to and from the state capitol once
1515 every week during a legislative session, and per diem allowances for food and lodging
1616 during a session of the legislature, but none is payable during a recess of the
1717 legislature for 30 days or more unless approved by a joint resolution adopted by both
1818 houses. The allowances are payable once per month.
1919 This bill prohibits payment for these allowances during the period beginning
2020 90 days after the enactment of a biennial budget act that contains any increase in
2121 compensation for public employees and ending on the date the Joint Committee on
2222 Employment Relations takes action on the increase. Under the bill, the allowances
2323 accrued during such a period are to be paid in a timely manner following action by
2424 JCOER.
2525 The people of the state of Wisconsin, represented in senate and assembly, do
2626 enact as follows:
2727 SECTION 1. 13.08 (5) of the statutes is created to read:
2828 13.08 (5) During the period beginning 90 days after the enactment of a biennial
2929 budget act that contains an increase in compensation for any public employee and

3737 ending on the date the joint committee on employment relations takes action on the
3838 increase in compensation, eligible allowances under subs. (2) and (4) shall accrue but
3939 may not be paid to a member of the legislature. The eligible allowances accrued
4040 under subs. (2) and (4) during the period specified in this subsection shall be paid in
4141 a timely manner after the joint committee on employment relations takes action on
4242 the increase in compensation.
4343 SECTION 2. 13.123 (1) (d) of the statutes is created to read:
4444 13.123 (1) (d) During the period beginning 90 days after the enactment of a
4545 biennial budget act that contains an increase in compensation for any public
4646 employee and ending on the date the joint committee on employment relations takes
4747 action on the increase in compensation, allowances under pars. (a) to (c) shall accrue
4848 but may not be paid to a member of the legislature. The allowances accrued under
4949 pars. (a) to (c) during the period specified in this paragraph shall be paid in a timely
5050 manner after the joint committee on employment relations takes action on the
5151 increase in compensation.
