10	10	AN ACT to create 13.08 (5) and 13.123 (1) (d) of the statutes; relating to: per diem
11	11	and mileage allowances for legislators.

13	13	Under current law, representatives to the assembly and senators may receive
14	14	allowances for transportation expenses for travel to and from the state capitol once
15	15	every week during a legislative session, and per diem allowances for food and lodging
16	16	during a session of the legislature, but none is payable during a recess of the
17	17	legislature for 30 days or more unless approved by a joint resolution adopted by both
18	18	houses. The allowances are payable once per month.
19	19	This bill prohibits payment for these allowances during the period beginning
20	20	90 days after the enactment of a biennial budget act that contains any increase in
21	21	compensation for public employees and ending on the date the Joint Committee on
22	22	Employment Relations takes action on the increase. Under the bill, the allowances
23	23	accrued during such a period are to be paid in a timely manner following action by
24	24	JCOER.
25	25	The people of the state of Wisconsin, represented in senate and assembly, do
26	26	enact as follows:
27	27	SECTION 1. 13.08 (5) of the statutes is created to read:
28	28	13.08 (5) During the period beginning 90 days after the enactment of a biennial
29	29	budget act that contains an increase in compensation for any public employee and

37	37	ending on the date the joint committee on employment relations takes action on the
38	38	increase in compensation, eligible allowances under subs. (2) and (4) shall accrue but
39	39	may not be paid to a member of the legislature. The eligible allowances accrued
40	40	under subs. (2) and (4) during the period specified in this subsection shall be paid in
41	41	a timely manner after the joint committee on employment relations takes action on
42	42	the increase in compensation.
43	43	SECTION 2. 13.123 (1) (d) of the statutes is created to read:
44	44	13.123 (1) (d) During the period beginning 90 days after the enactment of a
45	45	biennial budget act that contains an increase in compensation for any public
46	46	employee and ending on the date the joint committee on employment relations takes
47	47	action on the increase in compensation, allowances under pars. (a) to (c) shall accrue
48	48	but may not be paid to a member of the legislature. The allowances accrued under
49	49	pars. (a) to (c) during the period specified in this paragraph shall be paid in a timely
50	50	manner after the joint committee on employment relations takes action on the
51	51	increase in compensation.
