Penalty for First-Degree Reckless
Homicide
Under Wisconsin law, a person who causes the death of another human being by the unlawful
manufacture, distribution, or delivery of a Schedule I or II controlled substance, a Schedule I or II
controlled substance analog, ketamine, or flunitrazepam, or by administering or assisting in
administering any of these substances without lawful authority to do so is guilty of first-degree reckless
homicide. 2023 Wisconsin Act 29 raises the penalty for this offense from a Class C felony to a Class B
felony.
Effective date: August 6, 2023
