1010 AN ACT to amend 15.405 (17) of the statutes; relating to: the membership of the
1111 Cosmetology Examining Board.
1212 Analysis by the Legislative Reference Bureau
1313 Under current law, the Cosmetology Examining Board, which licenses and
1414 regulates cosmetologists, aestheticians, electrologists, and manicurists, consists of
1515 nine members, including two representatives of cosmetology schools, four members
1616 who are licensed either as aestheticians or cosmetologists, one member who is
1717 licensed as an electrologist, and two public members. This bill adds a licensed
1818 manicurist to the membership of the board and removes one public member.
1919 The people of the state of Wisconsin, represented in senate and assembly, do
2020 enact as follows:
2121 SECTION 1. 15.405 (17) of the statutes is amended to read:
2222 15.405 (17) COSMETOLOGY EXAMINING BOARD. There is created a cosmetology
2323 examining board in the department of safety and professional services. The
2424 cosmetology examining board shall consist of 9 members appointed for 4-year terms.
2525 Four members shall be licensed aestheticians or cosmetologists, 2 members one

3535 member shall be a public members member, one member shall be a representative
3636 of a private school of cosmetology, one member shall be a representative of a public
3737 school of cosmetology and, one member shall be a licensed electrologist, and one
3838 member shall be a licensed manicurist. No more than 4 members may be connected
3939 with or have any financial interest in a cosmetology school.
4040 SECTION 2.0Nonstatutory provisions.
4141 (1) Notwithstanding s. 15.08 (1), the governor may provisionally appoint to the
4242 cosmetology examining board the initial manicurist member authorized by this act.
4343 That provisional appointment shall be in force until withdrawn by the governor or
4444 acted upon by the senate and, if confirmed by the senate, shall continue for the
4545 remainder of the unexpired term, if any, of the member and until a successor is
4646 chosen and qualifies. A provisional appointee may exercise all the powers and duties
4747 of board membership to which the person is appointed during the time in which the
4848 appointee qualifies.
4949 (2) A provisional appointment made under sub. (1) that is withdrawn by the
5050 governor shall, upon withdrawal, lapse and create a vacancy for provisional
5151 appointment of another initial manicurist member authorized by this act of the
5252 cosmetology examining board. Any provisional appointment made under sub. (1)
5353 that is rejected by the senate shall upon rejection lapse and create a vacancy for
5454 nomination and appointment under s. 15.08 (1) of another initial manicurist member
5555 authorized by this act.
5656 (3) Notwithstanding the length of terms specified for the members of the
5757 cosmetology examining board under s. 15.405 (17), the initial manicurist member
