13 | 13 | | Under current law, the Cosmetology Examining Board, which licenses and |
---|
14 | 14 | | regulates cosmetologists, aestheticians, electrologists, and manicurists, consists of |
---|
15 | 15 | | nine members, including two representatives of cosmetology schools, four members |
---|
16 | 16 | | who are licensed either as aestheticians or cosmetologists, one member who is |
---|
17 | 17 | | licensed as an electrologist, and two public members. This bill adds a licensed |
---|
18 | 18 | | manicurist to the membership of the board and removes one public member. |
---|
19 | 19 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
20 | 20 | | enact as follows: |

21 | 21 | | SECTION 1. 15.405 (17) of the statutes is amended to read: |

22 | 22 | | 15.405 (17) COSMETOLOGY EXAMINING BOARD. There is created a cosmetology |
---|
23 | 23 | | examining board in the department of safety and professional services. The |
---|
24 | 24 | | cosmetology examining board shall consist of 9 members appointed for 4-year terms. |
---|
25 | 25 | | Four members shall be licensed aestheticians or cosmetologists, 2 members one |

35 | 35 | | member shall be a public members member, one member shall be a representative |
---|
36 | 36 | | of a private school of cosmetology, one member shall be a representative of a public |
---|
37 | 37 | | school of cosmetology and, one member shall be a licensed electrologist, and one |
---|
38 | 38 | | member shall be a licensed manicurist. No more than 4 members may be connected |
---|
39 | 39 | | with or have any financial interest in a cosmetology school. |
---|
40 | 40 | | SECTION 2.0Nonstatutory provisions. |
---|
41 | 41 | | (1) Notwithstanding s. 15.08 (1), the governor may provisionally appoint to the |
---|
42 | 42 | | cosmetology examining board the initial manicurist member authorized by this act. |
---|
43 | 43 | | That provisional appointment shall be in force until withdrawn by the governor or |
---|
44 | 44 | | acted upon by the senate and, if confirmed by the senate, shall continue for the |
---|
45 | 45 | | remainder of the unexpired term, if any, of the member and until a successor is |
---|
46 | 46 | | chosen and qualifies. A provisional appointee may exercise all the powers and duties |
---|
47 | 47 | | of board membership to which the person is appointed during the time in which the |
---|
48 | 48 | | appointee qualifies. |
---|
49 | 49 | | (2) A provisional appointment made under sub. (1) that is withdrawn by the |
---|
50 | 50 | | governor shall, upon withdrawal, lapse and create a vacancy for provisional |
---|
51 | 51 | | appointment of another initial manicurist member authorized by this act of the |
---|
52 | 52 | | cosmetology examining board. Any provisional appointment made under sub. (1) |
---|
53 | 53 | | that is rejected by the senate shall upon rejection lapse and create a vacancy for |
---|
54 | 54 | | nomination and appointment under s. 15.08 (1) of another initial manicurist member |
---|
55 | 55 | | authorized by this act. |
---|
56 | 56 | | (3) Notwithstanding the length of terms specified for the members of the |
---|
57 | 57 | | cosmetology examining board under s. 15.405 (17), the initial manicurist member |
---|
