9090 FIREARM TRANSFERS AND POSSESSION
9191 Background checks before firearms transfers
9292 Current law provides that a federally licensed firearms dealer may not transfer
9393 a handgun after a sale until the dealer has performed a background check on the
9494 prospective transferee to determine if he or she is prohibited from possessing a
9595 firearm under state or federal law. This bill generally prohibits any person from
9696 transferring any firearm, including the frame or receiver of a firearm, unless the
9797 transfer occurs through a federally licensed firearms dealer and involves a
9898 background check of the prospective transferee. Under the bill, the following are
9999 excepted from that prohibition: a transfer to a firearms dealer or to a law
100100 enforcement or armed services agency; a transfer of a firearm classified as antique;
101101 a transfer for no more than 14 days for the purpose of hunting or target shooting that
102102 involves no more than nominal consideration; or a transfer that is by gift, bequest,
103103 or inheritance to a family member. A person who is convicted of violating the
104104 prohibition is guilty of a misdemeanor and must be fined not less than $500 nor more
105105 than $10,000, may be imprisoned for not more than nine months, and may not
106106 possess a firearm for a period of two years.
107107 Law enforcement access to handgun background checks
108108 Current law outlines the process for the background check that a federally
109109 licensed firearms dealer must perform before transferring a handgun after a sale.
110110 Under current law, the dealer requests the Department of Justice to perform the
111111 background check on the prospective transferee to determine if he or she is
112112 prohibited from possessing a firearm under state or federal law. Current law
113113 prohibits the following persons from possessing a firearm: persons who have been
114114 convicted of a felony; persons found not guilty of a felony by reason of mental disease
115115 or defect; persons who are subject to certain injunctions such as a domestic abuse or
116116 child abuse injunction or, in certain cases, a harassment or an individuals-at-risk
117117 injunction; and persons who have been involuntarily committed for mental health
118118 treatment and ordered not to possess a firearm. Current law also prohibits a person
119119 from intentionally furnishing, purchasing, or possessing a firearm for a person who
120120 is prohibited from possessing a firearm. This practice is commonly called “straw
121121 purchasing.”
122122 Under current law, DOJ must deny access to records regarding background
123123 checks; however there are exceptions. The bill creates three additional exceptions.
124124 First, under current law, if the background check reveals that a prospective
125125 transferee is prohibited from possessing a firearm under state law, the attorney
126126 general may disclose to a law enforcement agency that the person attempted to
127127 purchase a handgun. The bill adds that the attorney general may make such a

132132 disclosure to law enforcement if a prospective transferee is prohibited from
133133 possessing a firearm under federal law as well as state law. Second, the bill adds that
134134 the attorney general may disclose an attempted transfer to a law enforcement agency
135135 if the circumstances surrounding the request for a background check indicate that
136136 the prospective transferee is trying to make a straw purchase of a handgun. Third,
137137 the bill specifies that DOJ may forward the final transaction status of a background
138138 check to the National Instant Criminal Background Check System, commonly
139139 referred to as NICS, as provided under federal law.
140140 Extreme risk protection order
141141 Under current law, a person is prohibited from possessing a firearm, and must
142142 surrender all firearms, if the person is subject to a domestic abuse injunction, a child
143143 abuse injunction, or, in certain cases, a harassment or an individuals-at-risk
144144 injunction. If a person surrenders a firearm because the person is subject to one of
145145 those injunctions, the firearm may not be returned to the person until a court
146146 determines that the injunction has been vacated or has expired and that the person
147147 is not otherwise prohibited from possessing a firearm. A person who is prohibited
148148 from possessing a firearm under such an injunction is guilty of a Class G felony if he
149149 or she violates the prohibition.
150150 The bill creates an extreme risk protection temporary restraining order and
151151 injunction to prohibit a person from possessing a firearm. Under the bill, either a
152152 law enforcement officer or a family or household member of the person may file a
153153 petition with a court to request an extreme risk protection injunction. The petition
154154 must allege facts that show that the person is substantially likely to injure himself
155155 or herself or another if the person possesses a firearm.
156156 Under the bill, the petitioner may request the court to consider first granting
157157 a temporary restraining order. If the petitioner does request a TRO, the petitioner
158158 must include evidence that there is an immediate and present danger that the person
159159 may injure himself or herself or another if the person possesses a firearm and that
160160 waiting for the injunction hearing may increase the immediate and present danger.
161161 If the petitioner requests a TRO, the court must hear the petition in an
162162 expedited manner. The judge must issue a TRO if, after questioning the petitioner
163163 and witnesses or relying on affidavits, the judge determines that it is substantially
164164 likely that the petition for an injunction will be granted and the judge finds good
165165 cause to believe there is an immediate and present danger that the person will injure
166166 himself or herself or another if the person has a firearm and that waiting for the
167167 injunction hearing may increase the immediate and present danger. If the judge
168168 issues a TRO, the TRO is in effect until the injunction hearing, which must occur
169169 within 14 days of the TRO issuance. The TRO must require a law enforcement officer
170170 to personally serve the person with the order and to require the person to
171171 immediately surrender all firearms in his or her possession. If a law enforcement
172172 officer is unable to personally serve the person, then the TRO requires the person to
173173 surrender within 24 hours all firearms to a law enforcement officer or a firearms
174174 dealer and to provide the court a receipt indicating the surrender occurred.
175175 At the injunction hearing, if the court finds by clear and convincing evidence

180180 person possesses a firearm, the court may grant an extreme risk protection
181181 injunction ordering the person to refrain from possessing a firearm and, if the person
182182 was not subject to a TRO, to surrender all firearms he or she possesses. An extreme
183183 risk protection injunction is effective for up to one year and may be renewed. A
184184 person who is subject to an extreme risk protection injunction may petition to vacate
185185 the injunction. If a person surrenders a firearm because the person is subject to an
186186 extreme risk protection TRO or injunction, the firearm may not be returned to the
187187 person until a court determines that the TRO has expired or the injunction has been
188188 vacated or has expired and that the person is not otherwise prohibited from
189189 possessing a firearm.
190190 A person who possesses a firearm while subject to an extreme risk protection
191191 TRO or injunction is guilty of a Class G felony. In addition, a person who files a
192192 petition for an extreme risk protection injunction, knowing the information in the
193193 petition to be false, is guilty of the crime of false swearing, a Class H felony.
194194 Misdemeanor crimes of domestic violence as a firearms disqualifier
195195 Under federal law, a person is prohibited from possessing a firearm if he or she
196196 has been convicted of a misdemeanor crime of domestic violence. Under state law,
197197 a person who is prohibited from possessing a firearm under federal or state law also
198198 may not purchase a firearm or be issued a license to carry a concealed weapon. State
199199 law requires DOJ, before approving a handgun purchase or issuing a license, to
200200 conduct a background check to determine if the person is prohibited from possessing
201201 a firearm. To determine if the person is prohibited under federal law, DOJ must
202202 review court records of all of the person's criminal convictions to identify if any
203203 conviction is for a misdemeanor crime of domestic violence. DOJ must determine if
204204 the relationship between the offender and the victim qualifies as a domestic
205205 relationship and if the offender engaged in violent conduct when committing the
206206 crime. The bill reorganizes two statutes—the crime of disorderly conduct and the
207207 definition of domestic abuse—so that DOJ is able to more easily determine if a
208208 conviction under one of those statutes qualifies as a misdemeanor crime of domestic
209209 violence.
210210 First, under current law, a person is guilty of disorderly conduct if the person
211211 engages in violent, abusive, indecent, profane, boisterous, unreasonably loud, or
212212 otherwise disorderly conduct and if the conduct tends to cause or provoke a
213213 disturbance. A person who has been convicted of disorderly conduct is prohibited
214214 from possessing a firearm if the disorderly conduct was a misdemeanor crime of
215215 domestic violence—that is, if the person engaged in violent conduct and if the
216216 relationship between the person and the victim was domestic. The bill reorganizes
217217 the disorderly conduct statute to separate “violent” conduct from the other types of
218218 disorderly conduct so that the court record clearly indicates that the crime was a
219219 violent crime.
220220 Second, under current state law, “domestic abuse” is defined as certain actions
221221 taken against a victim if the victim is related to the actor, has a child in common with
222222 the actor, or currently resides or has resided with the actor. Unlike state law, federal
223223 law does not define a crime as domestic violence if the only relationship is that the
224224 victim currently resides or has resided with the actor. The bill reorganizes the - 6 -2023 - 2024 Legislature LRB-5958/1

227227 statute defining domestic abuse so that a court record would indicate the exact
228228 nature of the relationship. Therefore, under the bill, the court record would indicate
229229 when a person who is guilty under state law of a crime of domestic abuse is not guilty
230230 under federal law of a misdemeanor crime of domestic violence.
231231 Domestic violence protection orders
232232 Under federal law, a person is prohibited from possessing a firearm if the person
233233 is subject to a court order that restrains the person from harassing, stalking, or
234234 threatening an intimate partner or the partner's child and that contains a finding
235235 that the person represents a credible threat to the safety of the partner or child or
236236 an explicit term that prohibits the person from using, attempting to use, or
237237 threatening to use physical force against the partner or child.
238238 Under the bill, if a person is released on bail or bond and the court issues such
239239 an order, the clerk of court must send a copy of the order to the appropriate sheriff
240240 within one business day of the person's release. The sheriff must then enter the court
241241 order into an information system so that law enforcement has access to the order
242242 similar to how law enforcement has access to other orders for domestic violence,
243243 harassment, or child abuse that prohibit a person from possessing a firearm.
244244 Prohibition on undetectable “ghost” guns
245245 The bill prohibits the manufacture, transportation, sale, possession, and
246246 carrying of firearms that cannot be detected by metal detectors or airport x-ray
247247 machines or scanners. Federal law currently has a comparable prohibition; under
248248 the bill, the person would violate state law as well. A person who violates the state
249249 prohibition is guilty of a Class G felony.
250250 The bill prohibits the sale, posting, provision, or possession of plans for
251251 manufacturing an undetectable firearm. A person who violates the prohibition is
252252 guilty of a Class H felony.
253253 The bill also prohibits the possession of a frame or a receiver of a firearm that
254254 is not marked with a serial number. A person who violates the prohibition is guilty
255255 of a Class I felony.
256256 Penalty increase for the illegal possession of a firearm or for the straw
257257 purchase of a firearm
258258 The bill increases the penalty for the illegal possession of a firearm or for the
259259 straw purchase of a firearm. Under current law either crime is a Class G felony. The
260260 bill increases the penalty to a Class F felony for a repeat offense.
261261 VICTIMS AND WITNESSES
262262 Victim-witness reimbursement payments
263263 Under current law, DOJ reimburses counties for costs they incur in providing
264264 services to victims and witnesses of crime. The bill increases funding for these
265265 reimbursements by $1,503,400 in fiscal year 2023-24 and by $1,901,400 in fiscal
266266 year 2024-25.
267267 Address confidentiality program
268268 The bill provides new general purpose revenue funding for the address
269269 confidentiality program operated by DOJ. Under current law, DOJ's address
270270 confidentiality program, known as “Safe at Home,” provides certain victims of - 7 -2023 - 2024 Legislature

274274 domestic abuse with a substitute legal address that can be used for both public and
275275 private purposes so that the victim's home address can remain confidential.
276276 Intimidation of a witness or a victim
277277 Under current law, the crime of intimidation of a witness or a victim is a Class
278278 A misdemeanor, unless certain aggravating factors are present, in which case it is
279279 a Class H felony. The bill increases the penalty for the crime of intimidation of a
280280 witness or a victim from a Class A misdemeanor to a Class H felony and from a Class
281281 H felony to a Class G felony if the aggravating factors are present.
282282 Victim services
283283 The bill provides an additional $10,000,000 in the 2023-25 biennium for victim
284284 services provided by DOJ across the state.
285285 LAW ENFORCEMENT RECRUITMENT , RETENTION, AND TRAINING
286286 Reimbursement for law enforcement specialized training
287287 Under current law, the Law Enforcement Standards Board reimburses political
288288 subdivisions for certain expenses associated with certification training for law
289289 enforcement officers. Under current law, these reimbursements are funded from a
290290 combination of GPR and penalty surcharges on court fines and forfeitures. The bill
291291 increases GPR funding for law enforcement certification training reimbursements
292292 by $1,000,000 GPR in each fiscal year.
293293 Law enforcement officer recruitment, retention, and wellness grants
294294 The bill requires DOJ to provide $10,000,000 in grants in the 2023-25 fiscal
295295 biennium for programs designed to recruit and retain law enforcement officers and
296296 to promote officer wellness.
297297 OBSTRUCTING JUSTICE
298298 Obstructing justice
299299 Under current law, the crime of obstructing justice is defined as knowingly
300300 giving, for consideration, false information to a judge, court reporter, bailiff, or
301301 district attorney with intent to influence that person in the performance of official
302302 functions and is a Class I felony. Under current law, it is also a Class I felony to
303303 destroy documents that are subject to subpoena, and it is a Class H felony to bribe
304304 a witness.
305305 Under the bill, the crime of obstructing justice is redefined to include a variety
306306 of acts that interfere with a governmental or criminal investigation, including all of
307307 the following:
308308 1. Withholding or destroying records or oral testimony with intent to obstruct
309309 a legal investigation.
310310 2. Interfering with a legal or governmental proceeding through the use of a
311311 bribe or a threat.
312312 3. Interfering, by threat or force, with the exercise of rights or performance of
313313 duties pursuant to a court order.
314314 4. Obstructing or otherwise interfering with the communication to a criminal

318318 5. Altering or destroying a record, document, or other object in order to interfere
319319 with a governmental investigation or administration of any other matter in the
320320 jurisdiction of the state government.
321321 6. Accepting a bribe to influence, obstruct, or impede a legal or governmental
322322 proceeding.
323323 Any of these activities is a Class H felony under the bill.
324324 Battery or threat of a juror or a family member of a juror
325325 Under current law, the crime of battery is defined as intentionally causing
326326 another person bodily harm and is a Class A misdemeanor. Under current law, if the
327327 battery is a special circumstance battery—for example, the battery is committed
328328 against an individual because of the individual's status as a law enforcement officer,
329329 witness in a trial, or juror—the penalty is increased to a Class H felony. Under the
330330 bill, a threat of battery against a juror or battery or a threat of battery against a
331331 family member of a juror is also a Class H felony.
332332 DEPARTMENT OF JUSTICE AND DEP ARTMENT OF CORRECTIONS
333333 PROGRAMS
334334 Treatment alternatives and diversion grant program
335335 Under current law, DOJ, in collaboration with the Department of Corrections
336336 and the Department of Health Services, awards grants to counties or tribes that have
337337 established qualifying treatment alternatives and diversion (TAD) programs that
338338 offer substance abuse or mental health treatment services as alternatives to
339339 prosecution or incarceration in order to reduce recidivism, promote public safety, and
340340 reduce prison and jail populations.
341341 Under current law, in order to qualify for a TAD grant, a county's or tribe's
342342 program is required to match 25 percent of the grant, and a program is required to
343343 charge participants a fee to participate. A county or tribe that receives a TAD grant
344344 must create an oversight committee to administer and evaluate its program. DOJ
345345 is required to make grants available to any county or tribe on a competitive basis
346346 every five years. At the end of the five-year grant cycle, DOJ is required to prepare
347347 a comprehensive report on the grant program based on annual reports and other data
348348 it collects from the counties and tribes.
349349 The bill makes several changes to the TAD grant program. Under the bill, a
350350 program funded by a TAD grant need not focus solely on alcohol and other drug
351351 treatment but must employ evidence-based practices targeted to the population
352352 served by the program. The bill changes the match requirement from 25 percent to
353353 10 percent and changes the competitive grant process to a four-year cycle. The bill
354354 allows, but does not require, an eligible program to charge participants a fee for their
355355 treatment. The bill also eliminates certain requirements pertaining to exposure of
356356 genitals during drug testing.
357357 Under current law, when a person pleads or is found guilty of certain drug
358358 offenses, the court is required to order a substance use assessment. Under current
359359 law, the court does not have to order an assessment if the person is already covered
360360 by such an order, has recently completed an assessment under such an order, or is
361361 participating in a TAD program. The bill specifies that if a person is participating
362362 in any evidence-based substance use disorder treatment program as determined by - 9 -2023 - 2024 Legislature

366366 DOJ, regardless of its status relating to the TAD program, the court does not need
367367 to order an assessment.
368368 The bill provides an additional $15,522,000 of funding for TAD programs in the
369369 2023-25 fiscal biennium.
370370 Community policing and community prosecution grant program
371371 The bill provides $20,000,000 in grant funding in the 2023-25 fiscal biennium
372372 through DOJ to support community policing and community prosecution. In
373373 awarding the grants, DOJ may consider the use of hot-spot policing practices to
374374 address the needs of the community.
375375 Violence prevention grants
376376 The bill provides $10,000,000 in grant funding in the 2023-25 fiscal biennium
377377 through DOJ for violence prevention programs. Under the bill, DOJ must consult
378378 with DHS to determine grant awards.
379379 Becky Young recidivism reduction
380380 The bill increases by $5,000,000 in each fiscal year of the 2023-25 biennium the
381381 funding for community services established by DOC that have the goals of increasing
382382 public safety, reducing the risk that offenders on community supervision will
383383 reoffend, and reducing recidivism among people who are on probation, parole, or
384384 extended supervision.
385385 Increasing position authorizations for Department of Justice programs
386386 The bill authorizes DOJ to create the following positions:
387387 1. Five additional positions for the alternatives to prosecution and
388388 incarceration grant program.
389389 2. Two additional positions for law enforcement officer training and wellness
390390 initiatives.
391391 3. Four additional positions for law enforcement toxicology services.

413413 This bill requires DOJ to develop an Internet-based reporting system and a
414414 telephone hotline for the reporting of hate crimes. Under the bill, DOJ must conduct
415415 a public education campaign on hate crimes and where to report them and must
416416 collect data relating to the reporting of hate crimes. Under the bill, DOJ is required
417417 to submit a biennial report to the legislature on the reporting of hate crimes.
418418 Higher education and special education funding; maintenance of effort
419419 The bill provides additional funding for higher education and for special
420420 education aid the Department of Public Instruction pays to school districts,
421421 independent charter schools, cooperative educational service agencies, and county
422422 children with disabilities education boards, for purposes of maintaining compliance
423423 with maintenance of effort requirements of the federal Consolidated Appropriations
424424 Act and the federal American Rescue Plan Act.
425425 Statute of limitations after discovery of DNA evidence
426426 The bill changes the applicable time limits on prosecution when DNA evidence
427427 implicates an individual in the commission of a felony.
428428 Under current law, prosecution for a felony generally must be commenced
429429 within six years of the commission of the felony, and prosecution of a misdemeanor
430430 must be commenced within three years of the commission of the misdemeanor.
431431 Certain crimes have a longer time limit on prosecutions, and prosecution for certain
432432 crimes, such as homicide, may be commenced at any time.
433433 Under current law, if, within the applicable time limit on prosecution or, if there
434434 is no time limit on prosecution, within six years of the commission of a felony, a DNA
435435 sample is collected that implicates a person in the commission of a felony, the state
436436 may commence prosecution of the person who is the source of the biological material
437437 for the felony or a crime that is related to the felony within 12 months after the DNA
438438 analysis results in a probable identification of the person or within the applicable
439439 time limit on prosecution, whichever is latest.
440440 Under the bill, the statute of limitations is reset at the time a person is
441441 implicated in the commission of a felony by DNA evidence. Under the bill, the state
442442 may commence prosecution of the person for the felony or a crime related to the felony
443443 within the applicable statute of limitations beginning on the day that the person is
444444 implicated in the crime by DNA evidence.
445445 Fraud scheme
446446 The bill creates a new crime of fraud scheme. Under current law, obtaining title
447447 to property of another person by intentionally deceiving the person is a type of theft.
448448 Under current law, multiple thefts may be charged as one offense if they are part of
449449 a single deceptive scheme. The bill creates a new crime that combines these concepts
450450 for circumstances when a single deceptive scheme results in theft by fraud.
451451 Because this bill creates a new crime or revises a penalty for an existing crime,
452452 the Joint Review Committee on Criminal Penalties may be requested to prepare a

17581758 (c) “Law enforcement officer” has the meaning given in s. 165.85 (2) (c).
17591759 (2) COMMENCEMENT OF ACTION AND RESPONSE. No action under this section may
17601760 be commenced by complaint and summons. An action under this section may be
17611761 commenced only by a petition described under sub. (4) (a).
17621762 (2m) PROCEDURE. Procedure for an action under this section is as follows:
17631763 (a) If the petitioner requests an extreme risk protection temporary restraining
17641764 order, the court shall consider the request as provided under sub. (2t). If the court
17651765 issues a temporary restraining order, the court shall set forth the date, that must be
17661766 within 14 days of issuing the temporary restraining order, for the hearing on the
17671767 injunction and shall forward a copy of the temporary restraining order, the
17681768 injunction hearing date, and the petition to the appropriate law enforcement agency
17691769 with jurisdiction over the respondent's residence. The law enforcement agency shall
17701770 immediately, or as soon as practicable, serve the petition on the respondent. If

18001800 personal service cannot be effected upon the respondent, the court may order other
18011801 appropriate service.
18021802 (b) The court shall hold a hearing under sub. (3) on whether to issue an extreme
18031803 risk protection injunction, which is the final relief. If there was no temporary
18041804 restraining order, the respondent shall be served notice of the petition by a law
18051805 enforcement officer and the date for the hearing shall be set upon motion by either
18061806 party. If personal service cannot be effected upon the respondent, the court may
18071807 order other appropriate service. The service shall include the name of the respondent
18081808 and of the petitioner, and, if known, notice of the date, time, and place of the
18091809 injunction hearing.
18101810 (c) When the respondent is served under this subsection, the respondent shall
18111811 be provided notice of the requirements and penalties under s. 941.29.
18121812 (2t) EXTREME RISK PROTECTION TEMPORARY RESTRAINING ORDER. (a) A judge shall
18131813 issue an extreme risk protection temporary restraining order under this subsection
18141814 prohibiting the respondent from possessing a firearm and ordering the respondent
18151815 to surrender all firearms in the respondent's possession if all of the following occur:
18161816 1. A petitioner files a petition alleging the elements under sub. (4) (a), and
18171817 requests a temporary restraining order. The petition requesting a temporary
18181818 restraining order shall be heard by the court in an expedited manner. The court shall
18191819 examine under oath the petitioner and any witness the petitioner may produce or
18201820 may rely on an affidavit submitted in support of the petition.
18211821 2. The judge finds all of the following:
18221822 a. Substantial likelihood that the petition for an injunction will be successful.
18231823 b. Good cause to believe that there is an immediate and present danger that
18241824 the respondent may injure himself or herself or another person if the respondent

18531853 immediate and present danger.
18541854 (b) A temporary restraining order issued under this subsection shall remain
18551855 in effect until a hearing is held on issuance of an injunction under sub. (3). Notice
18561856 need not be given to the respondent before issuing a temporary restraining order
18571857 under this subsection. A temporary restraining order may be entered only against
18581858 the respondent named in the petition and may not be renewed or extended.
18591859 (c) A temporary restraining order issued under this subsection shall inform the
18601860 respondent named in the petition of the requirements and penalties under s. 941.29.
18611861 (d) A temporary restraining order issued under par. (a) shall require one of the
18621862 following:
18631863 1. If a law enforcement officer is able to personally serve the respondent with
18641864 the order, the officer to require the respondent to immediately surrender all firearms
18651865 in the respondent's possession.
18661866 2. If a law enforcement officer is not able to personally serve the respondent
18671867 with the order, the respondent to, within 24 hours of service, surrender all firearms
18681868 in the respondent's possession to a law enforcement officer or transfer or sell all
18691869 firearms in the respondent's possession to a firearms dealer. Within 48 hours of
18701870 service, the respondent shall file with the court that issued the order under par. (a)
18711871 a receipt indicating that the respondent surrendered, transferred, or sold the
18721872 firearms. The receipt must include the date on which the firearm was surrendered,
18731873 transferred, or sold and the manufacturer, model, and serial number of each firearm
18741874 and must be signed by either the law enforcement officer to whom the firearm was
18751875 surrendered or the firearms dealer to whom the firearm was transferred or sold.

19041904 (3) EXTREME RISK PROTECTION INJUNCTION. (a) The court shall hold a hearing on
19051905 whether to issue an extreme risk protection injunction, which is the final relief. At
19061906 the hearing, a judge may grant an injunction prohibiting the respondent from
19071907 possessing a firearm and, if there was no temporary restraining order under sub. (2t),
19081908 ordering the respondent to surrender all firearms in the respondent's possession if
19091909 all of the following occur:
19101910 1. The petitioner files a petition alleging the elements set forth under sub. (4)
19111911 (a).
19121912 2. The petitioner serves upon the respondent a copy or summary of the petition
19131913 and notice of the time for hearing on the issuance of the injunction, or the respondent
19141914 serves upon the petitioner notice of the time for hearing on the issuance of the
19151915 injunction.
19161916 3. The judge finds by clear and convincing evidence that the respondent is
19171917 substantially likely to injure himself or herself or another person if the respondent
19181918 possesses a firearm.
19191919 (b) The judge may enter an injunction only against the respondent named in
19201920 the petition.
19211921 (c) 1. Unless a judge vacates the injunction under par. (d), an injunction under
19221922 this subsection is effective for a period determined by the judge that is no longer than
19231923 one year.
19241924 2. When an injunction expires, the court shall extend the injunction, upon
19251925 petition, for up to one year if the judge finds by clear and convincing evidence that
19261926 the respondent is still substantially likely to injure himself or herself or another
19271927 person if the respondent possesses a firearm.

19541954 (d) A respondent who is subject to an injunction issued under this subsection
19551955 may request in writing a judge to vacate the injunction one time during any
19561956 injunction period. If a respondent files a request under this paragraph, the
19571957 petitioner shall be notified of the request before the judge considers the request. The
19581958 judge shall vacate the injunction if the respondent demonstrates by clear and
19591959 convincing evidence that the respondent is no longer substantially likely to injure
19601960 himself or herself or another person if the respondent possesses a firearm.
19611961 (e) An injunction issued under this subsection shall inform the respondent
19621962 named in the petition of the requirements and penalties under s. 941.29.
19631963 (4) PETITION. (a) The petition shall allege facts sufficient to show the following:
19641964 1. The name of the petitioner and, unless the petitioner is a law enforcement
19651965 officer, how the petitioner is a family or household member of the respondent.
19661966 2. The name of the respondent.
19671967 3. That the respondent is substantially likely to injure himself or herself or
19681968 another person if the respondent possesses a firearm.
19691969 4. If the petitioner knows, the number, type, and location of any firearm that
19701970 the respondent possesses.
19711971 5. If requesting a temporary restraining order, evidence of an immediate and
19721972 present danger that the respondent may injure himself or herself or another person
19731973 if the respondent possesses a firearm and that waiting for the injunction hearing may
19741974 increase the immediate and present danger.
19751975 (b) The clerk of the circuit court shall provide simplified forms to help a person
19761976 file a petition.
19771977 (c) Only the following persons may file a petition under this section:
19781978 1. A law enforcement officer.

20092009 (5) ENFORCEMENT ASSISTANCE. (a) 1. If a temporary restraining order is issued
20102010 under sub. (2t) or an injunction is issued, extended, or vacated under sub. (3), the
20112011 clerk of the circuit court shall notify the department of justice of the action and shall
20122012 provide the department of justice with information concerning the period during
20132013 which the order or injunction is in effect or the date on which the injunction is vacated
20142014 and with information necessary to identify the respondent for purposes of
20152015 responding to a request under s. 165.63 or for purposes of a firearms restrictions
20162016 record search under s. 175.35 (2g) (c) or a background check under s. 175.60 (9g) (a).
20172017 2. Except as provided in subd. 3., the department of justice may disclose
20182018 information that it receives under subd. 1. only to respond to a request under s.
20192019 165.63 or as part of a firearms restrictions record search under s. 175.35 (2g) (c) or
20202020 a background check under s. 175.60 (9g) (a).
20212021 3. The department of justice shall disclose any information that it receives
20222022 under subd. 1. to a law enforcement agency when the information is needed for law
20232023 enforcement purposes.
20242024 (b) Within one business day after a temporary restraining order is issued under
20252025 sub. (2t) or an injunction is issued, extended, or vacated under this section, the clerk
20262026 of the circuit court shall send a copy of the temporary restraining order, of the
20272027 injunction, or of the order extending or vacating an injunction, to the sheriff or to any
20282028 other local law enforcement agency that is the central repository for injunctions and
20292029 that has jurisdiction over the petitioner's premises.
20302030 (c) No later than 24 hours after receiving the information under par. (b), the
20312031 sheriff or other appropriate local law enforcement agency under par. (b) shall enter
20322032 the information concerning a temporary restraining order issued under sub. (2t) or

20652065 not be maintained after the order or injunction is no longer in effect.
20662066 (d) 1. The court may schedule a hearing to surrender firearms for any reason
20672067 relevant to the surrender of firearms.
20682068 2. If the respondent does not comply with an order issued at a hearing to
20692069 surrender firearms, or a law enforcement officer has probable cause to believe that
20702070 the respondent possesses a firearm, the law enforcement officer shall request a

21212121 adequate to be given to all persons who have or may have an interest in the firearm

21242124 If the court returns a firearm under this paragraph, the court shall inform the person
21252125 to whom the firearm is returned of the requirements and penalties under s. 941.2905.
21262126 (c) The director of state courts shall develop a petition for the return of firearms
21272127 form that is substantially the same as the form under s. 813.1285 (5) (b).
21282128 (8) NOTICE OF FULL FAITH AND CREDIT. A temporary restraining order issued
21292129 under sub. (2t) and an injunction issued under sub. (3) shall include a statement that
21302130 the order or injunction may be accorded full faith and credit in every civil or criminal
21312131 court of the United States, civil or criminal courts of any other state, and Indian
21322132 tribal courts to the extent that such courts may have personal jurisdiction over
21332133 nontribal members.

27582758 possesses, or goes armed with an undetectable firearm is guilty of a Class G felony.
27592759 2. Whoever sells, offers to sell, transfers, posts, provides to another, or

28562856 governmental civil or criminal investigative demand, intentionally withholds,
28572857 misrepresents, removes from any place, conceals, covers up, destroys, mutilates,
28582858 alters, or falsifies any record or oral testimony that is the subject of the demand.
28592859 (b) Intentionally, by offer of consideration, threat or force, or
28602860 misrepresentation, influences, obstructs, or impedes any proceeding before a court,
28612861 court commissioner, administrative law judge, or department or agency of the state
28622862 or any inquiry or investigation by the legislature.
