9	9	AN ACT to amend 632.895 (17) (b) 2. of the statutes; relating to: coverage of
10	10	sterilization procedures and patient education and counseling under health
11	11	insurance policies and plans.

13	13	Under current law, health insurance policies and self-insured governmental
14	14	health plans that provide coverage of outpatient health care services, preventive
15	15	treatments and services, or prescription drugs and devices are required to provide
16	16	coverage of certain contraceptives and related services, including outpatient
17	17	consultations, examinations, procedures, and medical services that are necessary to
18	18	prescribe, administer, maintain, or remove a contraceptive. This bill requires that
19	19	health insurance policies and self-insured governmental health plans that are
20	20	required to provide such contraceptive coverage under current law also provide
21	21	coverage for sterilization procedures and patient education and counseling. Health
22	22	insurance policies are referred to in the statutes as disability insurance policies.
23	23	This proposal may contain a health insurance mandate requiring a social and
24	24	financial impact report under s. 601.423, stats.

26	26	an appendix to this bill.
27	27	The people of the state of Wisconsin, represented in senate and assembly, do
28	28	enact as follows:

34	34	SECTION 1. 632.895 (17) (b) 2. of the statutes is amended to read:
35	35	632.895 (17) (b) 2. Outpatient consultations, examinations, procedures, and
36	36	medical services that are necessary to prescribe, administer, maintain, or remove a
37	37	contraceptive, if covered for any other drug benefits under the policy or plan
38	38	sterilization procedures, and patient education and counseling.
39	39	SECTION 2.0Initial applicability.
40	40	(1) For policies and plans containing provisions inconsistent with this act, this
41	41	act first applies to policy or plan years beginning on the effective date of this
42	42	subsection, except as provided in sub. (2).
43	43	(2) For policies and plans that are affected by a collective bargaining agreement
44	44	containing provisions inconsistent with this act, this act first applies to policy or plan
45	45	years beginning on the effective date of this subsection or on the day on which the
46	46	collective bargaining agreement is newly established, extended, modified, or
47	47	renewed, whichever is later.
48	48	SECTION 3.0Effective date.
49	49	(1) This act takes effect on the first day of the 4th month beginning after
50	50	publication.
