58 | 58 | | systems and water suppliers must also use laboratories certified to analyze drinking |

---|
61 | 61 | | Soil cleanup standards for PFAS |
---|
62 | 62 | | Under current law, when a responsible party conducts a cleanup action to |
---|
63 | 63 | | address soil contamination, the cleanup must be designed and implemented to |
---|
64 | 64 | | restore the contaminated soil to certain designated residual contaminant levels or |
---|
65 | 65 | | performance standards. Under the bill, DNR must require responsible parties to |
---|
66 | 66 | | establish residual contaminant levels for the cleanup of contaminated soil and |
---|
67 | 67 | | sediment, or select a soil performance standard, as a result of a discharge of any |
---|
68 | 68 | | PFAS. |
---|
69 | 69 | | Emergency rules for PFAS |
---|
70 | 70 | | The bill also requires DNR to promulgate emergency rules establishing |
---|
71 | 71 | | acceptable levels and standards, performance standards, monitoring requirements, |
---|
72 | 72 | | and required response actions for any PFAS that DNR determines may be harmful |
---|
73 | 73 | | to human health or the environment in drinking water, groundwater, surface water, |
---|
74 | 74 | | air (if the standards are needed to provide adequate protection for public health or |
---|
75 | 75 | | welfare), solid waste and solid waste facilities, beds of navigable waters, and soil and |
---|
76 | 76 | | sediment. These emergency rules must cover, at a minimum, PFOS, PFOA, PFHxS, |
---|
77 | 77 | | PFNA, and PFBS. |
---|
78 | 78 | | Rule-making exemptions for PFAS |
---|
79 | 79 | | Current law requires an agency to suspend working on a permanent rule if it |
---|
80 | 80 | | determines that the proposed rule may result in more than $10,000,000 in |
---|
81 | 81 | | implementation and compliance costs over any two-year period. Current law also |
---|
82 | 82 | | allows standing committees of the legislature and the Joint Committee for the |
---|
83 | 83 | | Review of Administrative Rules (JCRAR) to review, approve, object to, or modify a |

92 | 92 | | permanent rule that contains the same substance as the suspended emergency rule. |
---|
93 | 93 | | The bill creates exemption from these provisions for any proposed or existing DNR |
---|
94 | 94 | | rule that establishes acceptable levels and standards, performance standards, |
---|
95 | 95 | | monitoring requirements, or required response actions for any PFAS compound or |
---|
96 | 96 | | group or class of PFAS in groundwater, drinking water, surface water, air, soil, or |

---|
98 | 98 | | The bill also exempts such DNR rules from the requirements under current law |
---|
99 | 99 | | to prepare a statement of the scope of any proposed rule; to have the statement of |
---|
100 | 100 | | scope approved by the governor; to hold a preliminary public hearing on a proposed |
---|
101 | 101 | | rule if ordered to do so by JCRAR; to prepare an economic impact analysis of the |
---|
102 | 102 | | proposed rules; and to prepare a report to the legislature of final rules. |
---|
103 | 103 | | PFAS community grant program |
---|
104 | 104 | | The bill creates a PFAS community grant program, administered by DNR, to |
---|
105 | 105 | | address PFAS. Under the program, DNR must provide grants to cities, towns, |
---|
106 | 106 | | villages, counties, tribal governments, utility districts, lake protection districts, |
---|
107 | 107 | | sewerage districts, municipal airports, schools, and daycares (municipalities). DNR |
---|
108 | 108 | | may award a grant only if the applicant tested or trained with a PFAS-containing |
---|
109 | 109 | | fire fighting foam in accordance with applicable state and federal law, or if a third |
---|
110 | 110 | | party tested or trained with PFAS-containing fire fighting foam within three miles |
---|
111 | 111 | | of a public or private water supply; the applicant applied biosolids to land under a |
---|
112 | 112 | | water pollution permit issued by DNR; or PFAS are affecting the applicant's drinking |
---|
113 | 113 | | water supply or surface water or groundwater within the municipality and the |
---|
114 | 114 | | responsible party is unknown or is unwilling or unable to take the necessary |
---|
115 | 115 | | response actions. |
---|
116 | 116 | | Under the bill, grants provided under this program may be used to do any of the |
---|
117 | 117 | | following: 1) investigate potential PFAS impacts in order to reduce or eliminate |
---|
118 | 118 | | environmental contamination; 2) treat or dispose of PFAS-containing fire fighting |
---|
119 | 119 | | foam or fire fighting foam containers or purchase PFAS-free fire fighting foam; 3) |
---|
120 | 120 | | sample a private water supply within three miles of a site or facility known to contain |
---|
121 | 121 | | PFAS or to have caused a PFAS discharge; 4) provide a temporary emergency water |
---|
122 | 122 | | supply, a water treatment system, or bulk water to replace water contaminated with |
---|
123 | 123 | | PFAS; 5) conduct emergency, interim, or remedial actions to mitigate, treat, dispose |
---|
124 | 124 | | of, or remove PFAS contamination; 6) remove or treat PFAS in public water systems |
---|
125 | 125 | | in areas where PFAS levels exceed the maximum contaminant level for PFAS in |
---|
126 | 126 | | drinking water or an enforcement standard for PFAS in groundwater or in areas |
---|
127 | 127 | | where the state has issued a health advisory for PFAS; 7) sample and test water in |
---|
128 | 128 | | schools and daycares for PFAS contamination; or 8) pay the costs of a mediator to |
---|
129 | 129 | | negotiate between municipalities for an alternate source of clean drinking water. |
---|
130 | 130 | | An applicant for a grant under this program must apply on a form prescribed |
---|
131 | 131 | | by DNR and must include any information that DNR finds necessary to determine |
---|

136 | 136 | | program, DNR must consider the applicant's demonstrated commitment to |
---|
137 | 137 | | performing and completing eligible activities, including the applicant's financial |
---|
138 | 138 | | commitment and ability to successfully administer grants; the degree to which the |
---|
139 | 139 | | project will have a positive impact on public health and the environment; and any |
---|
140 | 140 | | other criteria that DNR finds necessary to prioritize the funds available for awarding |
---|
141 | 141 | | grants. |
---|
142 | 142 | | The bill creates a sum sufficient appropriation from the general fund for this |
---|
143 | 143 | | purpose. |
---|
144 | 144 | | County PFAS well testing grant program |
---|
145 | 145 | | The bill also creates a grant program, under which DNR provides grants to |
---|
146 | 146 | | counties to provide sampling and testing services to private well owners to sample |
---|
147 | 147 | | and test for PFAS, nitrates, bacteria, and lead. The bill appropriates $2,000,000 per |
---|
148 | 148 | | fiscal year from the segregated PFAS fund and creates one additional position at |
---|
149 | 149 | | DNR for this purpose. |
---|
150 | 150 | | Aid for private wells with PFAS contamination |
---|
151 | 151 | | The bill requires DNR to administer a program to provide financial assistance |
---|
152 | 152 | | to municipalities located in an area where soil is contaminated with PFAS. Under |
---|
153 | 153 | | the program, DNR would award grants from the PFAS fund to municipalities for |
---|
154 | 154 | | eligible costs related to (1) construction of a municipal water system, (2) connection |
---|
155 | 155 | | to an existing municipal water system, and (3) assisting owners of private wells, if |
---|
156 | 156 | | appropriate, with the cost of installation of filters, remediation, or well replacement. |
---|
157 | 157 | | PFAS under the Safe Drinking Water Loan Program |
---|
158 | 158 | | Under current law, the Department of Administration and DNR administer the |
---|
159 | 159 | | Safe Drinking Water Loan Program (SDWLP), which provides financial assistance |
---|
160 | 160 | | from the environmental improvement program to municipalities, and to the private |
---|
161 | 161 | | owners of community water systems that serve municipalities, for projects that will |
---|
162 | 162 | | help the municipality comply with federal drinking water standards. DNR |
---|
163 | 163 | | establishes a funding priority list for SDWLP projects, and DOA allocates funding |
---|
164 | 164 | | for those projects. |
---|
165 | 165 | | The bill requires DNR, when ranking the priority of SDWLP projects, to rank |
---|
166 | 166 | | a project relating to PFAS in the same manner as if a maximum contaminant level |
---|
167 | 167 | | for PFAS had been attained or exceeded, if DHS has recommended an enforcement |
---|
168 | 168 | | standard for the type of PFAS involved in the project. |
---|
169 | 169 | | Products containing PFAS |
---|
170 | 170 | | Beginning January 1, 2028, the bill prohibits the sale or distribution of certain |
---|
171 | 171 | | products that contain intentionally added PFAS, including food packaging, cleaning |
---|
172 | 172 | | products, cosmetics, and textile furnishings. The bill prohibits the sale or |
---|
173 | 173 | | distribution of all products containing intentionally added PFAS beginning January |
---|
174 | 174 | | 1, 2034. The bill provides certain exemptions to this ban, including by allowing DNR |
---|
175 | 175 | | to identify, by rule, products in which the use of PFAS is an unavoidable use. |
---|
176 | 176 | | The bill allows DNR to require manufacturers to test certain products for PFAS. |
---|
177 | 177 | | A person that violates the prohibition on sales and distribution is subject to a civil |
---|

182 | 182 | | Mediator for municipalities seeking alternate water sources due to PFAS |
---|
183 | 183 | | The bill creates an option for DNR to appoint a neutral, third-party mediator |
---|
184 | 184 | | to help negotiate between municipalities and responsible parties when one |
---|
185 | 185 | | municipality needs to obtain an alternate water source or connect to a water source |
---|
186 | 186 | | within a different municipality as a result of PFAS contamination. |
---|
187 | 187 | | Under the bill, the mediator may assist the parties in coming to an agreement |
---|
188 | 188 | | or, if no agreement is reached, recommend a solution. The parties to the mediation |
---|
189 | 189 | | are responsible for the costs of mediation, as determined by the mediator. The |
---|
190 | 190 | | mediator may add additional parties to the negotiation if necessary, and DNR must |
---|
191 | 191 | | provide the mediator with technical assistance. |
---|
192 | 192 | | PFAS-containing fire fighting foam appropriation |
---|
193 | 193 | | Current law establishes a continuing appropriation from the environmental |
---|
194 | 194 | | fund for the collection of PFAS-containing fire fighting foam. The bill allows this |
---|
195 | 195 | | appropriation to also be used to provide assistance to local fire departments in |
---|
196 | 196 | | replacing PFAS-containing fire fighting foam with PFAS-free fire fighting foam. |
---|
197 | 197 | | WPDES permit conditions |
---|
198 | 198 | | Under current law, a wastewater treatment facility, and any person that wishes |
---|
199 | 199 | | to land spread biosolids or other sludge, must obtain a water pollution permit |
---|
200 | 200 | | (WPDES permit) from DNR. DNR is required to include conditions in such permits |
---|
201 | 201 | | to ensure compliance with water quality standards. |
---|
202 | 202 | | Under the bill, a WPDES permit that allows the permittee to land spread |
---|
203 | 203 | | biosolids must also include a condition that requires the permittee to test the sludge |
---|
204 | 204 | | for PFAS, and prohibits the land spreading of the biosolids if PFAS levels exceed |

205 | 205 | | levels set by DNR in the WPDES permit. Additionally, a WPDES permit issued to |

640 | 640 | | (4) NEGOTIATION. The mediator, immediately upon being appointed, shall |
---|
641 | 641 | | contact the department, the municipalities, and any participating responsible |
---|
642 | 642 | | parties and shall schedule negotiating sessions. The mediator shall schedule the |
---|
643 | 643 | | first negotiating session no later than 20 days after being appointed. The mediator |
---|
644 | 644 | | may meet with all parties to the negotiation, individual parties, or groups of parties. |
---|
645 | 645 | | The mediator shall facilitate a discussion between the municipalities and any |
---|
646 | 646 | | participating responsible parties to attempt to reach an agreement on the provision |
---|
647 | 647 | | of an alternate source of water to the requesting municipality or the connection to |
---|
648 | 648 | | a public water supply or another private water supply and the contribution of funds |
---|
649 | 649 | | by the municipalities and any responsible parties. |
---|
650 | 650 | | (5) ADDITION OF PARTIES. The mediator shall permit the addition to the |
---|
651 | 651 | | negotiation, at any time, of any responsible party or any other person who wishes to |
---|
652 | 652 | | be a party to the negotiated agreement. |

---|
809 | 809 | | or surface water or groundwater within the municipality and the responsible party |
---|
810 | 810 | | is unknown or is unwilling or unable to take the necessary response actions. |
---|
811 | 811 | | (4) ELIGIBLE ACTIVITIES. The department may award a grant under sub. (2) for |

854 | 854 | | standard for PFAS under ch. 160 or where the state has issued a health advisory for |

855 | 855 | | PFAS. |

856 | 856 | | (g) Paying a municipality's costs for a mediator under s. 281.79. |
---|
857 | 857 | | (h) Sampling and testing water for PFAS contamination in a public, private, |
---|
858 | 858 | | or tribal elementary or secondary school, a child care center that is licensed under |
---|
859 | 859 | | s. 48.65, a child care program that is established or contracted for under s. 120.13 |

861 | 861 | | (5) APPLICATION. A municipality shall apply for a grant on a form prescribed |

863 | 863 | | necessary to determine the eligibility of the project, identify the funding requested, |

864 | 864 | | determine the priority of the project, and calculate the amount of a grant. |

---|

---|

1113 | 1113 | | that a product contains intentionally added PFAS and the product is being |

1114 | 1114 | | distributed, sold, or offered for sale, the department may direct the manufacturer of |
---|
1115 | 1115 | | the product to, within 30 days, provide the department with testing results that |
---|
1116 | 1116 | | demonstrate the amount of each of the PFAS in the product. If testing shows that |
---|
1117 | 1117 | | the product does not contain intentionally added PFAS, the manufacturer shall |
---|
1118 | 1118 | | provide the department with the testing results and a certificate attesting that the |
---|
1119 | 1119 | | product does not contain intentionally added PFAS. If testing shows that the product |
---|
1120 | 1120 | | contains intentionally added PFAS, the manufacturer shall provide the department |
---|
1121 | 1121 | | with the testing results and the information required under sub. (4). |
---|
1122 | 1122 | | (6) FINANCIAL RESPONSIBILITY. The manufacturer of any new product that |
---|
1123 | 1123 | | contains intentionally added PFAS that is distributed, sold, or offered for sale shall |

1124 | 1124 | | provide proof of financial responsibility as required under s. 292.74. |

1125 | 1125 | | (7) PENALTY. A person that violates sub. (2) (a) or (c) shall be subject to a |

---|
1172 | 1172 | | (1) EMERGENCY RULES FOR PFAS COMMUNITY GRANT PROGRAM. The department |

1274 | 1274 | | (c) Notwithstanding any finding required under par. (a) or (b), emergency rules |

1275 | 1275 | | promulgated under pars. (a) and (b) shall cover, at a minimum, perfluorooctane |

1276 | 1276 | | sulfonic acid, perfluorooctanoic acid, perfluorohexane sulfonic acid, |
