9	9	AN ACT to create 115.28 (66), 118.40 (2r) (b) 2. m., 118.40 (2x) (b) 2. m. and 121.02
10	10	(1) (L) 9. of the statutes; relating to: model curriculum for pupils in grades 5
11	11	to 12 on interacting with law enforcement and granting rule-making authority.

13	13	This bill requires the state superintendent of public instruction, in consultation
14	14	with organizations representing law enforcement, to promulgate rules to develop a
15	15	model curriculum for pupils in grades 5 to 12 to instruct pupils on how to interact
16	16	with law enforcement with mutual cooperation and respect.
17	17	The bill requires a school board or operator of an independent charter school to
18	18	include in at least two grades from 5 to 8 and at least two grades from 9 to 12
19	19	instruction in law enforcement interactions that is consistent with the model
20	20	curriculum, unless the school board or governing board of the independent charter
21	21	school opts out of including such instruction. The bill specifies that a school board
22	22	that elects not to include such instruction must adopt a resolution making that
23	23	election.

26	26	The people of the state of Wisconsin, represented in senate and assembly, do
27	27	enact as follows:

33	33	SECTION 1. 115.28 (66) of the statutes is created to read:
34	34	115.28 (66) POLICE INTERACTIONS EDUCATION. Promulgate rules to develop a
35	35	model curriculum for pupils in grades 5 to 12 to instruct pupils on how to interact
36	36	with law enforcement with mutual cooperation and respect. The state
37	37	superintendent shall consult with organizations representing law enforcement and
38	38	shall ensure that the model curriculum includes instruction on all of the following:
39	39	(a) The role and responsibilities of law enforcement officials in providing for
40	40	public safety.
41	41	(b) The responsibilities of an individual to comply with directives from law
42	42	enforcement officials.
43	43	(c) The legal rights of an individual in interactions with law enforcement
44	44	officials.
45	45	SECTION 2. 118.40 (2r) (b) 2. m. of the statutes is created to read:
46	46	118.40 (2r) (b) 2. m. If the contract is for the operation of a charter school that
47	47	includes a grade from 5 to 12, a requirement that the charter school's curriculum
48	48	include the instruction required under s. 121.02 (1) (L) 9., so far as applicable, unless
49	49	the charter school governing board elects not to include the instruction.
50	50	SECTION 3. 118.40 (2x) (b) 2. m. of the statutes is created to read:
51	51	118.40 (2x) (b) 2. m. If the contract is for the operation of a charter school that
52	52	includes a grade from 5 to 12, a requirement that the charter school's curriculum
53	53	include the instruction required under s. 121.02 (1) (L) 9., so far as applicable, unless
54	54	the charter school governing board elects not to include the instruction.
55	55	SECTION 4. 121.02 (1) (L) 9. of the statutes is created to read:
56	56	121.02 (1) (L) 9. a. Except as provided in subd. 9. b., include instruction on
57	57	interacting with law enforcement that is consistent with the model curriculum

87	87	developed under s. 115.28 (66) in at least 2 grades from 5 to 8 and in at least 2 grades
88	88	from 9 to 12.
89	89	b. If the school board elects not to include instruction as provided under subd.
90	90	9. a., adopt a resolution making that election. Any election by a school board under
91	91	this subd. 9. b. requires the affirmative vote of a majority of the full membership of
92	92	the school board.
93	93	SECTION 5.0Initial applicability.
94	94	(1) SCHOOL BOARDS. The treatment of s. 121.02 (1) (L) 9. first applies to
95	95	curriculum for the 2025-26 school year.
96	96	(2) INDEPENDENT CHARTER SCHOOLS. The treatment of s. 118.40 (2r) (b) 2. m. and
97	97	(2x) (b) 2. m. first applies to a contract that is entered into, renewed, or modified on
98	98	the effective date of this subsection.
