5-71.05 (6) (b) 28. (intro.) and 321.40 (1) (c) 2.; and to create 36.27 (2r) of the statutes; relating to: the Minnesota−Wis-
6-consin tuition reciprocity agreement.
7-The people of the state of Wisconsin, represented in
8-senate and assembly, do enact as follows:
9-SECTION 3.  36.27 (2r) of the statutes is created to
10-read:
11-36.27 (2r)  MINNESOTA−UNIVERSITY OF WISCONSIN
12-SYSTEM STUDENT RECIPROCITY AGREEMENT.  (a)  There is
13-established, to be administered by the board, a Minne-
14-sota−University of Wisconsin System student reciprocity
15-agreement, the purpose of which shall be to ensure that
16-neither state shall profit at the expense of the other and
17-that the determination of any amounts owed by either
18-state under the agreement shall be based on an equitable
19-formula that reflects the educational costs incurred by the
20-2 states, reflects any differentials in usage by residents of
21-either state of the public institutions of higher education
22-located in the other state, and reflects any differentials in
23-the resident tuition charged at comparable public institu-
24-tions of higher education of the 2 states.  The board, rep-
25-resenting this state, shall enter into an agreement meeting
26-the requirements of this subsection with the designated
27-body representing the state of Minnesota.
28-(b)  The agreement under this subsection shall pro-
29-vide for the waiver of nonresident tuition for residents of
30-either state who are enrolled in public institutions of
31-higher education located in the other state.  The agree-
32-ment shall also establish a reciprocal fee structure for res-
33-idents of either state who are enrolled in public institu-
34-tions of higher education located in the other state.  The
35-reciprocal fee may not exceed the higher of the resident
36-tuition that would be charged the student at the public
37-institution of higher education in which the student is
38-enrolled or the resident tuition that would be charged the
39-student at comparable public institutions of higher edu-
40-cation located in the student’s state of residence, as speci-
41-fied in the annual administrative memorandum under par.
42-(c).  The agreement is subject to the approval of the joint
43-committee on finance.
44-(c)  Prior to each academic year, the board and the des-
45-ignated body representing the state of Minnesota shall
46-prepare an administrative memorandum that establishes
47-policies and procedures for implementation of the agree-
48-ment for the upcoming academic year, including a
49-description of how the reciprocal fee structure shall be
50-determined for purposes of par. (b), and the board shall
51-submit the administrative memorandum to the joint com-
52-mittee on finance. If the cochairpersons of the committee
53-do not notify the board that the committee has scheduled
54-a meeting for the purpose of reviewing the administrative
55-memorandum within 14 working days after the date of
56-the submittal, the administrative memorandum may be
57-implemented as proposed by the board.  If, within 14
58-working days after the date of the submittal, the cochair-

61-persons of the committee notify the board that the com-
62-mittee has scheduled a meeting for the purpose of review-
63-ing the administrative memorandum, the administrative
64-memorandum may be implemented only upon approval
65-of the committee.
66-(d)  No resident of this state whose name appears on
67-the statewide support lien docket under s. 49.854 (2) (b)
68-may receive a waiver of nonresident tuition under this
69-subsection unless the resident provides to the board a
70-payment agreement that has been approved by the county
71-child support agency under s. 59.53 (5) and that is consis-
72-tent with rules promulgated under s. 49.858 (2) (a).
73-(e)  At the end of each semester or academic term, the
74-board and the designated body representing the state of
75-Minnesota shall determine the number of students for
76-whom nonresident tuition has been waived under the
77-agreement.  The board and the designated body repre-
78-senting the state of Minnesota shall certify to each other,
79-in addition to the number of students so determined, the
80-aggregate amount of its reimbursement obligation.  The
81-entity with the larger reimbursement obligation shall pay
82-as provided in the agreement an amount determined by
83-subtracting the reimbursement obligation of the entity
84-with the smaller reimbursement obligation from the
85-reimbursement obligation of the entity with the larger
86-reimbursement obligation.  The agreement shall provide
87-a reasonable date for payment of any such sums due and
88-owing, after which date interest may be charged on the
89-amount owed.  The methodology for determination of the
90-appropriate interest rate shall be included in the agree-
91-ment.  All tuition and fees received by this state under this
92-subsection and any net obligations received under this
93-paragraph shall be credited to the appropriation account
94-under s. 20.285 (1) (gb).
95-(f)  In allocating funding for each institution under s.
96-36.09 (1) (h), the board shall ensure that each institution
97-is allocated the amounts received pursuant to par. (e) in
98-proportion to the total amount each institution charged its
99-students with Minnesota residence in tuition and fees
100-under the agreement under this subsection.
101-SECTION 4.  39.42 of the statutes is amended to read:
102-39.42  Interstate agreements.  The board, with the
103-approval of the joint committee on finance, or the govern-
104-ing boards of any publicly supported institution of post−
105-high school education, with the approval of the board and
106-the joint committee on finance, may enter into agree-
107-ments or understandings which include remission of non-
108-resident tuition for designated categories of students at
109-state institutions of higher education with appropriate
110-state agencies and institutions of higher education in
111-other states to facilitate use of public higher education
112-institutions of this state and other states.  Such agree-
113-ments and understandings shall have as their purpose the
114-mutual improvement of educational advantages for resi-
115-dents of this state and such other states or institutions of
116-other states with which agreements are made.  This sec-
117-tion does not apply to the agreement under s. 36.27 (2r).
118-SECTION 5.  39.47 (title) of the statutes is amended to
119-read:
120-39.47 (title)  Minnesota−Wisconsin public voca-
121-tional school student reciprocity agreement.
122-SECTION 6.  39.47 (1) of the statutes is amended to
123-read:
124-39.47 (1)  There is established, to be administered by
125-the board, a Minnesota−Wisconsin public vocational
126-school student reciprocity agreement, the purpose of
127-which shall be to ensure that neither state shall profit at
128-the expense of the other and that the determination of any
129-amounts owed by either state under the agreement shall
130-be based on an equitable formula which reflects the edu-
131-cational costs incurred by the 2 states, reflects any differ-
132-entials in usage by residents of either state of the public
133-institutions of higher education located in the other state,
134-and reflects any differentials in the resident tuition
135-charged at comparable public institutions of higher edu-
136-cation of the 2 states.  The board, representing this state,
137-shall enter into an agreement meeting the requirements of
138-this section with the designated body representing the
139-state of Minnesota.
140-SECTION 7.  39.47 (2) of the statutes is amended to
141-read:
142-39.47 (2)  The agreement under this section shall pro-
143-vide for the waiver of nonresident tuition fees for a resi-
144-dent of either state who is enrolled in a public vocational
145-school located in the other state.  The agreement shall also
146-establish a reciprocal fee structure for residents of either
147-state who are enrolled in public institutions of higher edu-
148-cation, other than vocational schools, located in the other
149-state.  The reciprocal fee may not exceed the higher of the
150-resident tuition fees that would be charged the student at
151-the public institution of higher education vocational
152-school in which the student is enrolled or the resident
153-tuition fees that would be charged the student at a compa-
154-rable public institutions of higher education vocational
155-school located in his or her state of residence, as specified
156-in the annual administrative memorandum under sub.
157-(2g).  The agreement shall take effect on July 1, 2007.
158-The agreement is subject to the approval of the joint com-
159-mittee on finance under s. 39.42.
160-SECTION 8.  45.20 (2) (a) 1. of the statutes is amended
161-to read:
162-45.20 (2) (a) 1.  The department shall administer a
163-tuition reimbursement program for eligible veterans
164-enrolling as undergraduates in any institution of higher
165-education in this state, enrolling in a school that is
166-approved under s. 45.03 (11), enrolling in a proprietary
167-school that is approved under s. 440.52, enrolling in a
168-public or private high school, enrolling in a tribal school,
169-as defined in s. 115.001 (15m), in any grade from 9 to 12,  − 3 − 2023 Wisconsin Act 104 2023 Senate Bill 161
170-or receiving a waiver of nonresident tuition under s.
171-36.27 (2r) or 39.47.
172-SECTION 9.  45.20 (2) (c) 1. of the statutes is amended
173-to read:
174-45.20 (2) (c) 1.  A veteran who meets the eligibility
175-requirements under par. (b) 1. may be reimbursed upon
176-satisfactory completion of an undergraduate semester in
177-any institution of higher education in this state, or upon
178-satisfactory completion of a course at any school that is
179-approved under s. 45.03 (11), any proprietary school that
180-is approved under s. 440.52, any public or private high
181-school, any tribal school, as defined in s. 115.001 (15m),
182-that operates any grade from 9 to 12, or any institution
183-from which the veteran receives a waiver of nonresident
184-tuition under s. 36.27 (2r) or 39.47.  Except as provided
185-in par. (e), the amount of reimbursement may not exceed
186-the total cost of the veteran’s tuition minus any grants or
187-scholarships that the veteran receives specifically for the
188-payment of the tuition, or, if the tuition is for an under-
189-graduate semester in any institution of higher education,
190-the standard cost of tuition for a state resident for an
191-equivalent undergraduate semester at the University of
192-Wisconsin−Madison, whichever is less.
193-SECTION 10.  45.20 (2) (d) 1. (intro.) of the statutes is
194-amended to read:
195-45.20 (2) (d) 1. (intro.)  Subject to subd. 1m., a veter-
196-an’s eligibility for reimbursement under this subsection
197-at any institution of higher education in this state, at a
198-school that is approved under s. 45.03 (11), at a propri-
199-etary school that is approved under s. 440.52, at a public
200-or private high school, at a tribal school, as defined in s.
201-115.001 (15m), that operates any grade from 9 to 12, or
202-at an institution where he or she is receiving a waiver of
203-nonresident tuition under s. 36.27 (2r) or 39.47 is limited
204-to the following:
205-SECTION 11.  71.05 (6) (b) 28. (intro.) of the statutes
206-is amended to read:
207-71.05 (6) (b) 28. (intro.)  An amount paid by a
208-claimant for tuition expenses and mandatory student fees
209-for a student who is the claimant or who is the claimant’s
210-child and the claimant’s dependent, as defined under sec-
211-tion 152 of the Internal Revenue Code, to attend any uni-
212-versity, college, technical college or a school approved
213-under s. 440.52, that is located in Wisconsin or to attend
214-a public vocational school or public institution of higher
215-education in Minnesota under the Minnesota−Wisconsin
216-a reciprocity agreement under s. 36.27 (2r) or 39.47, cal-
217-culated as follows:
218-SECTION 12.  321.40 (1) (c) 2. of the statutes is
219-amended to read:
220-321.40 (1) (c) 2.  A public institution of higher educa-
221-tion under the Minnesota−Wisconsin Minnesota−Uni-
222-versity of Wisconsin System student reciprocity agree-
223-ment under s. 36.27 (2r) or a public vocational school
224-under the Minnesota−Wisconsin public vocational
225-school reciprocity agreement under s. 39.47.
226-SECTION 13.0Nonstatutory provisions.
227-(1)  MINNESOTA−WISCONSIN TUITION RECIPROCITY
228-AGREEMENT.  The higher educational aids board and the
229-Board of Regents of the University of Wisconsin System
230-shall provide to the designated body representing the
231-state of Minnesota notice of intent to modify and make
232-changes to the student reciprocity agreement under s.

17+Under current law, the Higher Educational Aids Board administers and has
18+authority to renegotiate the Minnesota-Wisconsin tuition reciprocity agreement.
19+The agreement provides for the waiver of nonresident tuition for residents of either
20+state who are enrolled in public vocational schools and for a reciprocal fee structure
21+for residents of either state who are enrolled in public institutions of higher
22+education located in the other state.
23+This bill requires the University of Wisconsin System to enter into, administer,
24+and renegotiate with Minnesota a tuition reciprocity agreement that provides for the
25+waiver of nonresident tuition and for a reciprocal fee structure for residents of either
26+state who are enrolled in public institutions of higher education located in the other
27+state. The bill requires that all the tuition paid by Minnesota students attending UW
28+institutions under the agreement, including tuition commonly referred to as
29+differential reciprocity tuition, be credited to a UW System appropriation account
30+from which UW System expenditures are authorized. The bill requires the Board of
31+Regents to ensure that each institution is allocated the amounts received under the

39+tuition reciprocity agreement in proportion to the total amount each institution
40+charged its students with Minnesota residence in tuition and fees.
41+This bill also requires HEAB to enter into, administer, and renegotiate with
42+Minnesota a fee reciprocity agreement that provides for the waiver of nonresident
43+fees for residents of either state who are enrolled in public vocational schools in the
44+other state.

47+The people of the state of Wisconsin, represented in senate and assembly, do
48+enact as follows:
49+SECTION 1. 20.235 (1) (e) (title) of the statutes is amended to read:
50+20.235 (1) (e) (title) Minnesota-Wisconsin public vocational school student
51+reciprocity agreement.
52+SECTION 2. 20.285 (1) (gb) of the statutes is amended to read:
53+20.285 (1) (gb) General program operations. All moneys received from the
54+operation of educational programs and related programs and as earnings from
55+investments under s. 36.11 (11m) to carry out the purposes for which received,
56+including the transfer of funds to par. (gj), and for payment of any reimbursement
57+obligation under s. 36.27 (2r) (e). In each fiscal year, the Board of Regents shall
58+transfer no more than $30,338,500 from this appropriation account to the medical
59+assistance trust fund.
60+SECTION 3. 36.27 (2r) of the statutes is created to read:

162+sums due and owing, after which date interest may be charged on the amount owed.

311+from which the veteran receives a waiver of nonresident tuition under s. 36.27 (2r)
312+or 39.47. Except as provided in par. (e), the amount of reimbursement may not exceed
313+the total cost of the veteran's tuition minus any grants or scholarships that the
314+veteran receives specifically for the payment of the tuition, or, if the tuition is for an
315+undergraduate semester in any institution of higher education, the standard cost of
316+tuition for a state resident for an equivalent undergraduate semester at the
317+University of Wisconsin-Madison, whichever is less.

362+SECTION 12. 321.40 (1) (c) 2. of the statutes is amended to read:
363+321.40 (1) (c) 2. A public institution of higher education under the
364+Minnesota-Wisconsin Minnesota-University of W isconsin System student
365+reciprocity agreement under s. 36.27 (2r) or a public vocational school under the
366+Minnesota-Wisconsin public vocational school reciprocity agreement under s. 39.47.
367+SECTION 13.0Nonstatutory provisions.
368+(1) MINNESOTA-WISCONSIN TUITION RECIPROCITY AGREEMENT. The higher
369+educational aids board shall provide to the designated body representing the state
370+of Minnesota notice of the termination of the agreement under s. 39.47, 2021 stats.,
371+with the agreement's termination to become effective on July 1, 2023. The higher
372+educational aids board and the Board of Regents of the University of Wisconsin
373+System shall negotiate new agreements to replace the agreement under s. 39.47,
374+2021 stats., with these new agreements to become effective on July 1, 2023.

403+SECTION 14.0Effective dates. This act takes effect on the day after publication,
404+except as follows:
405+(1) MINNESOTA-WISCONSIN TUITION RECIPROCITY AGREEMENTS. The treatment of
406+ss. 20.235 (1) (e), 20.285 (1) (gb), 36.27 (2r), 39.42, 39.47 (title), (1), and (2), 45.20 (2)
407+(a) 1., (c) 1., and (d) 1. (intro.), 71.05 (6) (b) 28. (intro.), and 321.40 (1) (c) 2. takes effect
408+on July 1, 2023.
