11	11	AN ACT to create 8.10 (7), 8.15 (9) and 8.20 (10) of the statutes; relating to: the
12	12	number of signatures on nomination papers.
13	13	Analysis by the Legislative Reference Bureau
14	14	Under current law, generally, a candidate for a state or local office must file
15	15	nomination papers in order to have his or her name on the ballot. The nomination
16	16	papers must be signed by a certain number of voters residing in the jurisdiction of
17	17	the office the candidate seeks. For example, a candidate for a statewide office at a
18	18	spring election must collect at least 2,000, but no more than 4,000, valid signatures.
19	19	The filing official, typically the Elections Commission or a municipal clerk, must
20	20	determine whether the candidate has collected a sufficient number of valid
21	21	signatures to have his or her name on the ballot. If the number of valid signatures
22	22	is less than the minimum number required, the candidate is ineligible to have his or
23	23	her name on the ballot.
24	24	Under this bill, if a candidate submits nomination papers with more than the
25	25	maximum number of required signatures, but the filing official determines that the
26	26	maximum number of required signatures does not result in a sufficient number of
27	27	valid signatures, the filing official must review the additional signatures to the
28	28	extent necessary to determine whether the candidate has collected a sufficient
29	29	number of valid signatures to have his or her name on the ballot.
30	30	The people of the state of Wisconsin, represented in senate and assembly, do
31	31	enact as follows:

36	36	SECTION 1. 8.10 (7) of the statutes is created to read:
37	37	8.10 (7) If a candidate submits nomination papers with more than the
38	38	maximum number of required signatures prescribed under sub. (3), but the filing
39	39	official determines that the maximum number of required signatures does not result
40	40	in a sufficient number of valid signatures, the filing official shall review the
41	41	additional signatures to the extent necessary to determine whether the candidate
42	42	has collected a sufficient number of valid signatures.
43	43	SECTION 2. 8.15 (9) of the statutes is created to read:
44	44	8.15 (9) If a candidate submits nomination papers with more than the
45	45	maximum number of required signatures prescribed under sub. (6), but the filing
46	46	official determines that the maximum number of required signatures does not result
47	47	in a sufficient number of valid signatures, the filing official shall review the
48	48	additional signatures to the extent necessary to determine whether the candidate
49	49	has collected a sufficient number of valid signatures.
50	50	SECTION 3. 8.20 (10) of the statutes is created to read:
51	51	8.20 (10) If a candidate submits nomination papers with more than the
52	52	maximum number of required signatures prescribed under sub. (4), but the filing
53	53	official determines that the maximum number of required signatures does not result
54	54	in a sufficient number of valid signatures, the filing official shall review the
55	55	additional signatures to the extent necessary to determine whether the candidate
56	56	has collected a sufficient number of valid signatures.
