1111 AN ACT to create 8.10 (7), 8.15 (9) and 8.20 (10) of the statutes; relating to: the
1212 number of signatures on nomination papers.
1313 Analysis by the Legislative Reference Bureau
1414 Under current law, generally, a candidate for a state or local office must file
1515 nomination papers in order to have his or her name on the ballot. The nomination
1616 papers must be signed by a certain number of voters residing in the jurisdiction of
1717 the office the candidate seeks. For example, a candidate for a statewide office at a
1818 spring election must collect at least 2,000, but no more than 4,000, valid signatures.
1919 The filing official, typically the Elections Commission or a municipal clerk, must
2020 determine whether the candidate has collected a sufficient number of valid
2121 signatures to have his or her name on the ballot. If the number of valid signatures
2222 is less than the minimum number required, the candidate is ineligible to have his or
2323 her name on the ballot.
2424 Under this bill, if a candidate submits nomination papers with more than the
2525 maximum number of required signatures, but the filing official determines that the
2626 maximum number of required signatures does not result in a sufficient number of
2727 valid signatures, the filing official must review the additional signatures to the
2828 extent necessary to determine whether the candidate has collected a sufficient
2929 number of valid signatures to have his or her name on the ballot.
3030 The people of the state of Wisconsin, represented in senate and assembly, do

3636 SECTION 1. 8.10 (7) of the statutes is created to read:
3737 8.10 (7) If a candidate submits nomination papers with more than the
3838 maximum number of required signatures prescribed under sub. (3), but the filing
3939 official determines that the maximum number of required signatures does not result
4040 in a sufficient number of valid signatures, the filing official shall review the
4141 additional signatures to the extent necessary to determine whether the candidate
4242 has collected a sufficient number of valid signatures.
4343 SECTION 2. 8.15 (9) of the statutes is created to read:
4444 8.15 (9) If a candidate submits nomination papers with more than the
4545 maximum number of required signatures prescribed under sub. (6), but the filing
4646 official determines that the maximum number of required signatures does not result
4747 in a sufficient number of valid signatures, the filing official shall review the
4848 additional signatures to the extent necessary to determine whether the candidate
4949 has collected a sufficient number of valid signatures.
5050 SECTION 3. 8.20 (10) of the statutes is created to read:
5151 8.20 (10) If a candidate submits nomination papers with more than the
5252 maximum number of required signatures prescribed under sub. (4), but the filing
5353 official determines that the maximum number of required signatures does not result
5454 in a sufficient number of valid signatures, the filing official shall review the
5555 additional signatures to the extent necessary to determine whether the candidate
5656 has collected a sufficient number of valid signatures.
