Amendment 1 
2023 SENATE BILL 324 
2023 Senate Bill 324 prohibits any state agency or local governmental unit from prohibiting or 
otherwise limiting the use of certain refrigerants. Specifically, if the U.S. Environmental Protection 
Agency (EPA) has designated a refrigerant as an acceptable alternative to ozone-depleting refrigerants, 
a state agency or local governmental unit may not prohibit or otherwise limit the use of the refrigerant. 
The equipment containing the refrigerant must be listed and installed in accordance with safety 
standards and use conditions imposed pursuant to the EPA designation as an acceptable alternative. 
SENATE SUBSTITUTE AMENDMENT 1 
Senate Substitute Amendment 1 maintains the general prohibition, but applies it more specifically to 
building codes, rather than general use, as established or enforced by the Department of Safety and 
Professional Services (DSPS), or a county, city, village, or town. Under the substitute amendment, DSPS 
and a county, city, village, or town may not enact or enforce a building code that prohibits or otherwise 
limits the use of a refrigerant that the EPA has designated as an acceptable alternative. As under the 
bill, the equipment containing the refrigerant must be listed and installed in accordance with safety 
standards and use conditions imposed pursuant to the EPA designation as an acceptable alternative.

the Senate Committee on Labor, Regulatory Reform, Veterans and Military Affairs recommended 
adoption of the substitute amendment, and passage of the bill, as amended, on votes of Ayes, 5; Noes, 0.
