1111 AN ACT to amend 20.931 (title); and to create 20.931 (3) of the statutes; relating
1212 to: restrictions on use of certain refrigerants.
1313 Analysis by the Legislative Reference Bureau
1414 Current federal law provides that, to the extent practicable, certain
1515 ozone-depleting substances must be replaced by chemicals, product substitutes, or
1616 alternative manufacturing processes that reduce risks to human health and the
1717 environment. The U.S. Environmental Protection Agency is required to promulgate
1818 administrative rules identifying acceptable alternatives to these ozone-depleting
1919 substances.
2020 This bill provides that no state agency and no local governmental unit may
2121 prohibit or limit the use of a refrigerant that the EPA has designated as acceptable
2222 for use.
2323 The people of the state of Wisconsin, represented in senate and assembly, do
2424 enact as follows:
2525 SECTION 1. 20.931 (title) of the statutes is amended to read:
2626 20.931 (title) Prohibited boycotts governmental actions.
2727 SECTION 2. 20.931 (3) of the statutes is created to read:

3535 20.931 (3) PROHIBITIONS OF CERTAIN REFRIGERANTS. No state agency and no local
3636 governmental unit may prohibit or otherwise limit the use of a refrigerant
3737 designated as acceptable for use pursuant to 42 USC 7671k, provided that any
3838 equipment containing the refrigerant is listed and installed in accordance with
3939 safety standards and use conditions imposed pursuant to the designation of the
4040 refrigerant as acceptable for use.
