2023 Wisconsin Act 76
[2023 Senate Bill 324]
Use of Acceptable Alternatives to
Ozone-Depleting Refrigerants
2023 Wisconsin Act 76 prohibits the Department of Safety and Professional Services (DSPS), and a city,
village, town, or county from prohibiting or otherwise limiting the use of certain refrigerants.
Specifically, if the U.S. Environmental Protection Agency (EPA) has designated a refrigerant as an
acceptable alternative to ozone-depleting refrigerants, DSPS, and a city, village, town, or county may
not enact or enforce a building code that prohibits or otherwise limits the use of the refrigerant.
Any equipment containing an acceptable alternative refrigerant must be listed and installed in
accordance with safety standards and use conditions pursuant to the EPA designation as an acceptable
alternative refrigerant.
Effective date: December 8, 2023
