99 AN ACT to amend 457.03 (2) of the statutes; relating to: rules defining
1010 unprofessional conduct by marriage and family therapists, professional
1111 counselors, and social workers and suspension of a portion of a rule of the
1212 Marriage and Family Therapy, Professional Counseling, and Social Work
1313 Examining Board.

1515 This bill prohibits the Marriage and Family Therapy, Professional Counseling,
1616 and Social Work Examining Board from promulgating any rule that establishes as
1717 unprofessional conduct employing or promoting any intervention or method that has
1818 the purpose of attempting to change a person's sexual orientation or gender identity,
1919 including attempting to change behaviors or expressions of self or to reduce sexual
2020 or romantic attractions or feelings toward individuals of the same gender.
2121 This bill is introduced as required by s. 227.26 (2) (f), stats., in support of the
2222 action of the Joint Committee for Review of Administrative Rules in suspending
2323 section MPSW 20.02 (25), Wis. Adm. Code, a rule of the Marriage and Family
2424 Therapy, Professional Counseling, and Social Work Examining Board on January 12,
2525 2023.
2626 The suspended rule provided that unprofessional conduct related to the
2727 practice of marriage and family therapists, professional counselors, and social
2828 workers includes employing or promoting any intervention or method that has the
2929 purpose of attempting to change a person's sexual orientation or gender identity,

3737 including attempting to change behaviors or expressions of self or to reduce sexual
3838 or romantic attractions or feelings toward individuals of the same gender.
3939 The people of the state of Wisconsin, represented in senate and assembly, do
4040 enact as follows:
4141 SECTION 1. 457.03 (2) of the statutes is amended to read:
4242 457.03 (2) Upon the advice of the social worker section, marriage and family
4343 therapist section, and professional counselor section, promulgate rules establishing
4444 a code of ethics to govern the professional conduct of certificate holders and licensees.
4545 The rules shall specify the services included within the practice of social work,
4646 advanced practice social work, or independent social work that an individual who is
4747 certified under this chapter as a social worker, advanced practice social worker, or
4848 independent social worker may perform and the degree of supervision, if any,
4949 required to perform those services. The rules promulgated under this subsection
5050 may not establish as unprofessional conduct employing or promoting any
5151 intervention or method that has the purpose of attempting to change a person's
5252 sexual orientation or gender identity, including attempting to change behaviors or
5353 expressions of self or to reduce sexual or romantic attractions or feelings toward
5454 individuals of the same gender.
5555 SECTION 2. MPSW 20.02 (25) of the administrative code is repealed.
5656 SECTION 3.0Effective date.
5757 (1) Notwithstanding s. 227.265, this act takes effect on the day after
5858 publication.
