9	9	AN ACT to amend 457.03 (2) of the statutes; relating to: rules defining
10	10	unprofessional conduct by marriage and family therapists, professional
11	11	counselors, and social workers and suspension of a portion of a rule of the
12	12	Marriage and Family Therapy, Professional Counseling, and Social Work
13	13	Examining Board.

15	15	This bill prohibits the Marriage and Family Therapy, Professional Counseling,
16	16	and Social Work Examining Board from promulgating any rule that establishes as
17	17	unprofessional conduct employing or promoting any intervention or method that has
18	18	the purpose of attempting to change a person's sexual orientation or gender identity,
19	19	including attempting to change behaviors or expressions of self or to reduce sexual
20	20	or romantic attractions or feelings toward individuals of the same gender.
21	21	This bill is introduced as required by s. 227.26 (2) (f), stats., in support of the
22	22	action of the Joint Committee for Review of Administrative Rules in suspending
23	23	section MPSW 20.02 (25), Wis. Adm. Code, a rule of the Marriage and Family
24	24	Therapy, Professional Counseling, and Social Work Examining Board on January 12,
25	25	2023.
26	26	The suspended rule provided that unprofessional conduct related to the
27	27	practice of marriage and family therapists, professional counselors, and social
28	28	workers includes employing or promoting any intervention or method that has the
29	29	purpose of attempting to change a person's sexual orientation or gender identity,

37	37	including attempting to change behaviors or expressions of self or to reduce sexual
38	38	or romantic attractions or feelings toward individuals of the same gender.
39	39	The people of the state of Wisconsin, represented in senate and assembly, do
40	40	enact as follows:
41	41	SECTION 1. 457.03 (2) of the statutes is amended to read:
42	42	457.03 (2) Upon the advice of the social worker section, marriage and family
43	43	therapist section, and professional counselor section, promulgate rules establishing
44	44	a code of ethics to govern the professional conduct of certificate holders and licensees.
45	45	The rules shall specify the services included within the practice of social work,
46	46	advanced practice social work, or independent social work that an individual who is
47	47	certified under this chapter as a social worker, advanced practice social worker, or
48	48	independent social worker may perform and the degree of supervision, if any,
49	49	required to perform those services. The rules promulgated under this subsection
50	50	may not establish as unprofessional conduct employing or promoting any
51	51	intervention or method that has the purpose of attempting to change a person's
52	52	sexual orientation or gender identity, including attempting to change behaviors or
53	53	expressions of self or to reduce sexual or romantic attractions or feelings toward
54	54	individuals of the same gender.
55	55	SECTION 2. MPSW 20.02 (25) of the administrative code is repealed.
56	56	SECTION 3.0Effective date.
57	57	(1) Notwithstanding s. 227.265, this act takes effect on the day after
58	58	publication.
