Telehealth by Out-of-State 
Providers Under the Medical 
Assistance Program 
2023 WISCONSIN ACT 180 
2023 Wisconsin Act 180 prohibits the Department of Health Services (DHS) from requiring a health 
care provider that is licensed, certified, registered, or otherwise authorized to provide health care 
services in this state and that exclusively offers health care services in this state through telehealth to 
maintain a physical address or site in this state to be eligible for enrollment as a certified provider 
under the Medical Assistance program. 
The act similarly prohibits DHS from requiring a provider group with health care providers that are 
licensed, certified, registered, or otherwise authorized to provide health care services in this state and 
that exclusively offer health care services in this state through telehealth to maintain a physical address 
or site in this state to be eligible for enrollment as a provider group under the Medical Assistance 
program. 
Effective date: March 24, 2024
