10	10	services through telehealth by out-of-state providers under the Medical
11	11	Assistance program.

13	13	Under current administrative code, out-of-state health care providers that
14	14	regularly provide services to Wisconsin Medical Assistance recipients and that
15	15	provide services to Wisconsin Medical Assistance recipients through telehealth may
16	16	apply for certification as a Medical Assistance provider in Wisconsin regardless of
17	17	the provider's location. This bill codifies this administrative code provision by
18	18	prohibiting the Department of Health Services from requiring a health care provider
19	19	that is licensed, certified, registered, or otherwise authorized to provide health care
20	20	services in this state and that exclusively offers health care services in this state
21	21	through telehealth to maintain a physical address or site in this state to be eligible
22	22	for enrollment as a certified provider under the Medical Assistance program.
23	23	Additionally, this bill prohibits DHS from requiring a provider group with health
24	24	care providers that are licensed, certified, registered, or otherwise authorized to
25	25	provide health care services in this state and that exclusively offer health care
26	26	services in this state through telehealth to maintain a physical address or site in this
27	27	state to be eligible for enrollment as a provider group under the Medical Assistance

33	33	program. The Medical Assistance program is a joint state and federal program that
34	34	provides health services to individuals who have limited financial resources.
35	35	The people of the state of Wisconsin, represented in senate and assembly, do
36	36	enact as follows:
37	37	SECTION 1. 49.45 (61m) of the statutes is created to read:
38	38	49.45 (61m) SERVICES PROVIDED THROUGH TELEHEALTH BY OUT-OF-STATE
39	39	PROVIDERS. (a) In this subsection, “telehealth” has the meaning given in sub. (61) (a)
40	40	4.
41	41	(b) The department may not require a health care provider that is licensed,
42	42	certified, registered, or otherwise authorized to provide health care services in this
43	43	state and that exclusively offers health care services in this state through telehealth
44	44	to maintain a physical address or site in this state to be eligible for enrollment as a
45	45	certified provider under the Medical Assistance program.
46	46	(c) The department may not require a provider group with health care
47	47	providers that are licensed, certified, registered, or otherwise authorized to provide
48	48	health care services in this state and that exclusively offer health care services in this
49	49	state through telehealth to maintain a physical address or site in this state to be
