10	10	AN ACT to create 115.7915 (4m) (em), 118.40 (2r) (e) 3n., 118.40 (2x) (e) 3., 118.60
11	11	(4) (d) and 119.23 (4) (d) of the statutes; relating to: payments for pupils who
12	12	withdraw from a parental choice program, the Special Needs Scholarship
13	13	Program, or an independent charter school.
14	14	Analysis by the Legislative Reference Bureau
15	15	Under current law, for each pupil attending a private school under the parental
16	16	choice program or the Special Needs Scholarship Program and for each pupil
17	17	attending an independent charter school, the Department of Public Instruction pays
18	18	a per pupil amount to the private school participating in a parental choice program
19	19	or the Special Needs Scholarship Program or the independent charter school. DPI
20	20	pays the annual per pupil amount to the private school or independent charter school
21	21	in four equal installments. Under the bill, if, during the school year, a pupil
22	22	withdraws from a private school participating in a parental choice program or the
23	23	Special Needs Scholarship Program or from an independent charter school and
24	24	enrolls in a school district, DPI must pay any remaining amount due to the private
25	25	school or independent charter school for that pupil to the school district in which the
26	26	pupil is enrolled.

35	35	The people of the state of Wisconsin, represented in senate and assembly, do
36	36	enact as follows:
37	37	SECTION 1. 115.7915 (4m) (em) of the statutes is created to read:
38	38	115.7915 (4m) (em) Notwithstanding pars. (a), (cm), and (e), if a child attending
39	39	a private school under the scholarship program under this section withdraws from
40	40	the private school under this section during a school year and enrolls in a school
41	41	district, the department shall pay the remainder of the scholarship amount due to
42	42	the private school for the child for that school year to the school district in which the
43	43	child enrolls.
44	44	SECTION 2. 118.40 (2r) (e) 3n. of the statutes is created to read:
45	45	118.40 (2r) (e) 3n. Notwithstanding subd. 2p., if a pupil attending a charter
46	46	school established by or under a contract with an entity under par. (b) 1. for whom
47	47	a payment is due under this paragraph withdraws from the charter school during the
48	48	school year and enrolls in a school district, the department shall pay any remaining
49	49	amount due to the operator for that pupil for that school year to the school district
50	50	in which the pupil enrolls.
51	51	SECTION 3. 118.40 (2x) (e) 3. of the statutes is created to read:
52	52	118.40 (2x) (e) 3. Notwithstanding subd. 1m., if a pupil attending a charter
53	53	school established under this subsection for whom a payment is due under this
54	54	paragraph withdraws from the charter school during the school year and enrolls in
55	55	a school district, the department shall pay any remaining amount due to the operator
56	56	for that pupil for that school year to the school district in which the pupil enrolls.
57	57	SECTION 4. 118.60 (4) (d) of the statutes is created to read:

83	83	118.60 (4) (d) Notwithstanding par. (bg), if a pupil attending a private school
84	84	under this section for whom a payment is due under this subsection withdraws from
85	85	the private school during the school year and enrolls in a school district, the
86	86	department shall pay any remaining amount due to the private school for that pupil
87	87	for that school year to the school district in which the pupil enrolls.
88	88	SECTION 5. 119.23 (4) (d) of the statutes is created to read:
89	89	119.23 (4) (d) Notwithstanding par. (bg), if a pupil attending a private school
90	90	under this section for whom a payment is due under this subsection withdraws from
91	91	the private school during the school year and enrolls in a school district, the
92	92	department shall pay any remaining amount due to the private school for that pupil
93	93	for that school year to the school district in which the pupil enrolls.
94	94	SECTION 6.0Effective date.
95	95	(1) This act takes effect on July 1, 2024.
