1010 AN ACT to create 115.7915 (4m) (em), 118.40 (2r) (e) 3n., 118.40 (2x) (e) 3., 118.60
1111 (4) (d) and 119.23 (4) (d) of the statutes; relating to: payments for pupils who
1212 withdraw from a parental choice program, the Special Needs Scholarship
1313 Program, or an independent charter school.
1414 Analysis by the Legislative Reference Bureau
1515 Under current law, for each pupil attending a private school under the parental
1616 choice program or the Special Needs Scholarship Program and for each pupil
1717 attending an independent charter school, the Department of Public Instruction pays
1818 a per pupil amount to the private school participating in a parental choice program
1919 or the Special Needs Scholarship Program or the independent charter school. DPI
2020 pays the annual per pupil amount to the private school or independent charter school
2121 in four equal installments. Under the bill, if, during the school year, a pupil
2222 withdraws from a private school participating in a parental choice program or the
2323 Special Needs Scholarship Program or from an independent charter school and
2424 enrolls in a school district, DPI must pay any remaining amount due to the private
2525 school or independent charter school for that pupil to the school district in which the
2626 pupil is enrolled.

3535 The people of the state of Wisconsin, represented in senate and assembly, do
3636 enact as follows:
3737 SECTION 1. 115.7915 (4m) (em) of the statutes is created to read:
3838 115.7915 (4m) (em) Notwithstanding pars. (a), (cm), and (e), if a child attending
3939 a private school under the scholarship program under this section withdraws from
4040 the private school under this section during a school year and enrolls in a school
4141 district, the department shall pay the remainder of the scholarship amount due to
4242 the private school for the child for that school year to the school district in which the
4343 child enrolls.
4444 SECTION 2. 118.40 (2r) (e) 3n. of the statutes is created to read:
4545 118.40 (2r) (e) 3n. Notwithstanding subd. 2p., if a pupil attending a charter
4646 school established by or under a contract with an entity under par. (b) 1. for whom
4747 a payment is due under this paragraph withdraws from the charter school during the
4848 school year and enrolls in a school district, the department shall pay any remaining
4949 amount due to the operator for that pupil for that school year to the school district
5050 in which the pupil enrolls.
5151 SECTION 3. 118.40 (2x) (e) 3. of the statutes is created to read:
5252 118.40 (2x) (e) 3. Notwithstanding subd. 1m., if a pupil attending a charter
5353 school established under this subsection for whom a payment is due under this
5454 paragraph withdraws from the charter school during the school year and enrolls in
5555 a school district, the department shall pay any remaining amount due to the operator
5656 for that pupil for that school year to the school district in which the pupil enrolls.

8282 SENATE BILL 502
8383 118.60 (4) (d) Notwithstanding par. (bg), if a pupil attending a private school
8484 under this section for whom a payment is due under this subsection withdraws from
8585 the private school during the school year and enrolls in a school district, the
8686 department shall pay any remaining amount due to the private school for that pupil
8787 for that school year to the school district in which the pupil enrolls.
8888 SECTION 5. 119.23 (4) (d) of the statutes is created to read:
8989 119.23 (4) (d) Notwithstanding par. (bg), if a pupil attending a private school
9090 under this section for whom a payment is due under this subsection withdraws from
9191 the private school during the school year and enrolls in a school district, the
9292 department shall pay any remaining amount due to the private school for that pupil
9393 for that school year to the school district in which the pupil enrolls.
9494 SECTION 6.0Effective date.
9595 (1) This act takes effect on July 1, 2024.
