1111 AN ACT to amend 121.91 (7); and to create 121.91 (4) (m) of the statutes;
1212 relating to: a school district revenue limit adjustment for the cost of employing
1313 school nurses.
1414 Analysis by the Legislative Reference Bureau
1515 Current law generally limits the total amount of revenue per pupil that a school
1616 district may receive from general school aids and property taxes in a school year to
1717 the amount of revenue allowed per pupil in the previous school year plus a per pupil
1818 increase, if any, as provided by law. However, current law also includes several
1919 adjustments to the general revenue limit. For example, if a school district increases
2020 the services that it provides by adding responsibility for providing a service
2121 transferred to it from another governmental unit, the school district's revenue limit
2222 is increased by the cost of that service.
2323 This bill creates a school district revenue limit adjustment for the costs of
2424 employing school nurses. Under the bill, if a school board adopts a resolution, the
2525 school district's revenue limit is increased by the amount the school district spent
2626 during the second previous school year on salaries and benefits for school nurses.

2929 The people of the state of Wisconsin, represented in senate and assembly, do

3636 SECTION 1. 121.91 (4) (m) of the statutes is created to read:
3737 121.91 (4) (m) 1. If a school board adopts a resolution to do so, the limit
3838 otherwise applicable to the school district under sub. (2m) in any school year is
3939 increased by the amount spent by the school district in the 2nd previous school year
4040 to pay the salary and fringe benefit costs of school nurses employed by the school
4141 board and school nurses providing nursing services in the school district under a
4242 contract with the school board.
4343 2. Any additional revenue received by a school district under this paragraph
4444 shall not be included in the base for determining the school district's limit under sub.
4545 (2m) for the following school year.
4646 SECTION 2. 121.91 (7) of the statutes is amended to read:
4747 121.91 (7) Except as provided in subs. (4) (f) 2. and (n) (m) to (qe) and (8), if an
4848 excess revenue is approved under sub. (3) for a recurring purpose or allowed under
4949 sub. (4), the excess revenue shall be included in the base for determining the limit
5050 for the next school year for purposes of this section. If an excess revenue is approved
5151 under sub. (3) for a nonrecurring purpose, the excess revenue shall not be included
5252 in the base for determining the limit for the next school year for purposes of this
5353 section.
5454 SECTION 3.0Initial applicability.
5555 (1) This act first applies to the calculation of a school district's revenue limit
5656 for the school year beginning after the effective date of this subsection.
