8	8	AN ACT to create 51.42 (7) (b) 12., 457.01 (8r), 457.03 (4) and 457.035 (3) of the
9	9	statutes; relating to: provision of psychotherapy by qualified treatment
10	10	trainees and applicants for certain training licenses in outpatient mental
11	11	health clinics.

13	13	Under current administrative code, qualified treatment trainees may provide
14	14	psychotherapy to consumers through outpatient mental health clinics certified by
15	15	the Department of Health Services. Under current administrative code, “qualified
16	16	treatment trainee” is defined to mean either a graduate student who is enrolled in
17	17	an accredited institution in psychology, counseling, marriage and family therapy,
18	18	social work, nursing, or a closely related field or a person with a graduate degree from
19	19	an accredited institution and course work in psychology, counseling, marriage and
20	20	family therapy, social work, nursing, or a closely related field who has not yet
21	21	completed applicable supervised practice requirements. This bill adds to the
22	22	definition of qualified treatment trainee for purposes of providing psychotherapy to
23	23	consumers through outpatient mental health clinics a person with a graduate degree
24	24	from an accredited institution in psychology, counseling, marriage and family
25	25	therapy, social work, nursing or a closely related field who has submitted an
26	26	application for a training license as a social worker, marriage and family therapist,
27	27	or professional counselor until the person is granted a training license or for one year
28	28	following the date that the person submitted an application for a training license,
29	29	whichever occurs first.

36	36	Further, this bill codifies current administrative code by directing DHS to
37	37	promulgate rules to allow qualified treatment trainees and persons with a graduate
38	38	degree from an accredited institution in psychology, counseling, marriage and family
39	39	therapy, social work, nursing, or a closely related field who have submitted an
40	40	application for a training license as a social worker, marriage and family therapist,
41	41	or professional counselor within the previous year but have not yet been granted a
42	42	training license to provide psychotherapy to patients through an outpatient mental
43	43	health clinic certified by DHS while under clinical supervision as defined by DHS.
44	44	Additionally, the bill directs the Marriage and Family Therapy, Professional
45	45	Counseling, and Social Work Examining Board to promulgate rules establishing
46	46	standards of conduct for qualified treatment trainees to engage in psychotherapy in
47	47	an outpatient mental health clinic certified by DHS including a requirement that
48	48	qualified treatment trainees be supervised while engaging in psychotherapy.

50	50	an appendix to this bill.
51	51	The people of the state of Wisconsin, represented in senate and assembly, do
52	52	enact as follows:
53	53	SECTION 1. 51.42 (7) (b) 12. of the statutes is created to read:
54	54	51.42 (7) (b) 12. Allow qualified treatment trainees, as defined in s. 457.01 (8r),
55	55	and persons with a graduate degree from an accredited institution in psychology,
56	56	counseling, marriage and family therapy, social work, nursing, or a closely related
57	57	field who have submitted an application for a training license under s. 457.09,
58	58	457.11, or 457.13 within the previous year but have not yet been granted a training
59	59	license to provide psychotherapy to patients through an outpatient mental health
60	60	clinic certified by the department while under clinical supervision as defined by the
61	61	department by rule.
62	62	SECTION 2. 457.01 (8r) of the statutes is created to read:
63	63	457.01 (8r) “Qualified treatment trainee” means either of the following:
64	64	(a) A graduate student who is enrolled in an accredited institution in
65	65	psychology, counseling, marriage and family therapy, social work, nursing, or a
66	66	closely related field.

85	85	(b) A person with a graduate degree from an accredited institution and course
86	86	work in psychology, counseling, marriage and family therapy, social work, nursing,
87	87	or a closely related field who has not yet completed the applicable supervised clinical
88	88	training that must be completed for licensure as a clinical social worker, marriage
89	89	and family therapist, or professional counselor under rules promulgated pursuant
90	90	to this chapter.
91	91	SECTION 3. 457.03 (4) of the statutes is created to read:
92	92	457.03 (4) Upon the advice of the social worker section, marriage and family
93	93	section, and professional counselor section, promulgate rules establishing standards
94	94	of conduct for qualified treatment trainees to engage in psychotherapy through an
95	95	outpatient mental health clinic certified by the department of health services
96	96	including a requirement that qualified treatment trainees be supervised while
97	97	engaging in psychotherapy.
98	98	SECTION 4. 457.035 (3) of the statutes is created to read:
99	99	457.035 (3) The individual is a qualified treatment trainee and the individual
100	100	engages in psychotherapy through an outpatient mental health clinic certified by the
101	101	department of health services while supervised as provided by the examining board
102	102	by rule.
103	103	SECTION 5. DHS 35.03 (17m) (b) of the administrative code is amended to read:
104	104	DHS 35.03 (17m) (b) A person with a graduate degree from an accredited
105	105	institution and course work in psychology, counseling, marriage and family therapy,
106	106	social work, nursing or a closely related field who has not yet completed the
107	107	applicable supervised practice requirements described under ch. MPSW 4, 12, or 16,
108	108	or Psy 2 as applicable. For purposes of this paragraph, a person with a graduate
109	109	degree from an accredited institution in psychology, counseling, marriage and family

139	139	qualified treatment trainee until the person is granted a training license or for one
140	140	year following the date that the person submitted an application for a training
141	141	license, whichever occurs first.
142	142	SECTION 6.0Effective date.
143	143	(1) Notwithstanding s. 227.265, this act takes effect on the day after
144	144	publication.
