88 AN ACT to amend 343.61 (4) (b) of the statutes; relating to: the location and
99 operation of driver schools.
1010 Analysis by the Legislative Reference Bureau
1111 Current law provides that a driver school may not be established within 1,500
1212 feet of a Department of Transportation office where operator's licenses are issued or
1313 official driving skills tests are given. This bill eliminates that prohibition.
1414 Current Department of Transportation administrative rules prohibit a driver
1515 school from soliciting business within 1,500 feet of a DOT office where operator's
1616 driving skills tests are given. This prohibition does not apply if the municipality
1717 where the DOT office is located has a population less than 10,000 and the business
1818 district in which the DOT office is located is less than 1,500 feet long. This bill
1919 modifies that exception to provide that the prohibition does not apply if the
2020 municipality where the DOT office is located has a population less than 15,000 and
2121 eliminates any requirement relating to the size of the business district were the DOT
2222 office is located.
2323 The people of the state of Wisconsin, represented in senate and assembly, do
2424 enact as follows:
2525 SECTION 1. 343.61 (4) (b) of the statutes is amended to read:
2626 343.61 (4) (b) The location of each driver school office shall be identified in the
2727 license. Except as provided by the department by rule, no licensee may establish any

3535 driver school office within 1,500 feet of a department office where operator's licenses
3636 are issued, nor within 1,500 feet of any headquarters where official driving skills
3737 tests are given. Any change in address of any driver school office or driver school
3838 classroom must be reported to and approved by the department. A driver school may
3939 maintain driver school classrooms at locations other than the driver school office.
4040 A driver school may provide driver training instruction by means of the Internet in
4141 addition to providing instruction at a driver school classroom or, if the driver school
4242 also offers behind-the-wheel instruction in this state, instead of providing
4343 instruction at a driver school classroom.
4444 SECTION 2. Trans 105.06 (5) (b) of the administrative code is amended to read:
4545 Trans 105.06 (5) (b) The municipality where the department office is located
4646 has a population less than 10,000 and the business district in which the office is
4747 located is less than 1500 feet long 15,000.
